Abstract

This research aims to know and understand the impact of ASN non-neutrality in the implementation of Pilkada in Baubau City and what factors can influence ASN non-neutrality in the implementation of Pilkada in Baubau City. The type of research used is empirical juridical research, field research by examining and seeing what happens in the field and the use of laws and regulations in practice in the public arena of society by using legal material collection techniques, namely library research and field research. The results of this study indicate that the impact of ASN non-neutrality in the regional elections is that public interests are distorted, services are not optimal, position placements tend to involve involvement in the elections, and positions in the bureaucracy are filled by incompetent ASN.

Abstract

This study aims to determine the Implementation of Civil Servant Discipline Based on Law Number 5 of 2014 concerning State Civil Apparatus at Baubau City Hospital and to determine the factors that obstruct the Implementation of Civil Servant Discipline Based on Law Number 5 of 2014 concerning State Civil Apparatus at Baubau City Hospital. This research method uses juridical empirical method. The data collected in this paper uses field research in two ways, observation and interviews. The results showed that the implementation of Civil Servant discipline in terms of Regional Regulation Number 5 of 2014 concerning State Public Devices at the Baubau City Hospital was adequate but not maximally implemented. The factors that hinder the implementation of Civil Servant discipline in terms of the Regional Regulation are the fading discipline of Baubau City Hospital employees, the lack of facilities and infrastructure of Baubau City Hospital, the lack of awareness of Baubau City Hospital employees.

Abstract

The purposes of this study are: 1) To find out the restrictions on the political rights of ex-convicts to participate in the election of Regional Heads 2) To find out the legal consequences of restrictions and revocation of political rights of ex-convicts to be elected in regional head elections.  The type of normative legal research is doctrinal legal research or library research. The results of the researchare: 1) Limiting the political rights of ex-convicts to be elected is contrary to the hierarchy higher regulations. Based on Law No.12 of 2011 concerning the Formation of Legislation and  Invitation and is not in line with the principle (Lex Superior Derogat Legi Inferiori) meaning that the reshould be nolower regulations contrary to higher regulations. 2) Due to the law limiting the political rights of ex-convicts to be elected, it can be canceled through are quest for examination. Judicial review at the Supreme Court based on Law Number 12 of 2011 concerning the Establishment of Legislation, Law Number 39 of 1999 concerning Human Rights and Law Number 7 of 2017 concerning General Elections

Abstract

This research aims to understand the efforts of the Election Supervisory Agency (Bawaslu) in preventing money politics, especially in Tarafu Village, Batupoaro Subdistrict, Baubau City, and the inhibiting factors faced by the Election Supervisory Agency in eradicating money politics in Tarafu Village, Batupoaro Subdistrict, Baubau City. The research method employed is literature review and field study with the principles approach using Law Number 7 of 2017 and the Constitution of the Republic of Indonesia. The research specification is descriptive. Data sources involve direct question and answer sessions with election organizers including the General Election Commission (KPU), the Election Supervisory Agency (Bawaslu), involved legislative candidates, and the residents of Tarafu Village, Batupoaro Subdistrict, Baubau City, as well as books and internet articles related to the researched title. The data collection method is literature review. The data presentation method is in the form of narrative text, systematically outlined. Data analysis is qualitative. Based on the results of the research and discussion in this thesis, it can be concluded that the efforts of the Election Supervisory Agency in preventing money politics, especially in Tarafu Village, Batupoaro Subdistrict, Baubau City, are through intensive socialization, direct enforcement against violations, and internal capacity building. Although there are reports from the Subdistrict Election Supervisory Committee (Panwascam), most do not meet the material criteria for further action. Overall, these efforts by Bawaslu have succeeded in reducing the practice of money politics, although there are still challenges in collecting evidence and handling reports. The inhibiting factors faced by the Election Supervisory Agency in combating Money Politics in Tarafu Village, Batupoaro Subdistrict, Baubau City are as follows: Economic Factors, Cultural Factors, and Lack of Public Knowledge About Politics.

Abstract

Customary law has become an important part of the life of the people of North Toraja, its existence in solving social problems that occur is evidence that its role is very strategic. This research aims to understand how the people of North Toraja view and adapt customary law in the context of national law. Along with the challenges of globalization and social change, a deep understanding of the synchronization of these laws is very important. In this study, researchers used a case study research method with an explanatory research approach. The subjects in this study amounted to 3 (three) people consisting of traditional leaders, community leaders and local government. Based on the results of this study, it shows that synchronization between customary law and national law in North Toraja is a strategic step to create a more comprehensive and effective legal system for the needs of society. By integrating local values into the national legal framework, it is expected to build a harmonious and respectful society between tradition and modernity. The synchronization of customary law and national law in North Toraja shows that the integration of these two legal systems is essential to create justice and sustainability in society.

Abstract

Abstrak   Kekerasan adalah setiap perbuatan yang berakibat kesengsaraan dan penderitaan baik fisik, psikis, seksual, psikologis dan termasuk penelantaran, ancaman serta tindakan tertentu yang merupakan pemaksaan atau perampasan kemerdekaan secara sewenang-wenang baik yang dilakukan di depan umum atau dalam kehidupan pribadi. Pada berbagai kasus kekerasan yang terjadi, pada umumnya korbannya lebih banyak menimpa kalangan perempuan dan anak karena di pandang lemah (tidak berdaya/mampu melawan). Adapun metode pemecahan yaitu dengan melakukan pelatihan ke instansi pemerintahan dan sekolah-sekolah yang berada di Buton Tengah (Buteng). Hasil dari pengabdian ini adalah memberikan penyampaian mengenai keberadaan lembaga Pusat Pelayanan Terpadu Pemberdayaan Perempuan dan Anak (P2TP2PA) yang bertujuan memberikan pelayanan bagi perempuan dan anak korban kekerasan serta berupaya memberikan kontribusi terhadap pemberdayaan perempuan dan anak dalam rangka terwujudnya  kesetaraan dan keadilan gender. Bentuk dari manajemen dan penanganan yaitu dengan proses pengelolaan tindakan penanganan kasus yang meliputi asesment, perencanaan, pelaksanaan pelayanan, pemantauan/monitoring dan evaluasi untuk menangani secara sistematis dengan berkoordinasi dan melibatkan sumber-sumber yang dibutuhkan. Kata Kunci:   Manajemen dan penanganan, kasus kekerasan, perempuan, anak.

Abstract

This study aims to determine the role of the Gegana Corps Brirnob Polri in countering terrorist crimes. To determine the standard operating procedures for countering terrorist crimes by Gegana Corps Brirnob Polri This study is a normative legal research using a statutory approach, a conceptual approach, a historical approach, and a philosophical approach. The results of this study conclude that the Role and Function of the Gegana Detachment of the Brimob Unit in Countering Terrorism Terrorist crimes are generally carried out by clandestine elements (underground networks) that are organized and specially trained. Security measures are carried out on team members before carrying out terrorist acts. Usually they are made into a cell system before carrying out the destruction of targets. Surveillance of terror targets is carried out by personnel who are specifically tasked as scouts. The crime of terrorism is regulated in Law Number 15 of 2003 concerning the Stipulation of Government Regulation in Lieu of Law Number 1 of 2002 concerning the Eradication of Criminal Acts of Terrorism into Law (Terrorism Law).The Terrorism Law was enacted at the time due to a pressing need, namely a series of bombings in the Republic of Indonesia, such as the Bali bombing and the Marriott bombing in 2003. These incidents had caused widespread public fear, resulting in loss of life and property damage, thus negatively impacting Indonesia's social, economic, and political life, and international relations. These bombings are a common tactic used by terrorists in several countries.
