Abstract

The facts on the ground are that there are often problems due to legal consequences due to the non-registration of fiduciary guarantees by financial institutions. This study aims to determine consumer legal protection measures when fiduciary collateral is not registered at the Fiduciary Registration Office. This study also aims to examine the legal consequences of the withdrawal and confiscation of fiduciary collateral objects that are not registered at the Fiducia Registration Office by PT. Suzuki Finance Indonesia. This study uses a normative juridical method with descriptive-analytical research specifications through a statutory approach. Based on this study, it is concluded that consumer dispute resolution can be pursued through the court or outside the court based on the decision of the disputing parties. One of the legal protections and obligations in using fiduciary guarantees for finance companies was the first issuance of PP No.21 of 2015, Permenkeu No. 130 / PMK.010 / 2012, and POJK 29/2014. The legal consequence of not registering the object of the fiduciary guarantee is that the fiduciary guarantee has not been born so that the legal consequences attached to the fiduciary guarantee do not apply.

Abstract

The implementation of regional autonomy in Indonesia faces complex challenges in creating effective coordination between central and regional governments. This study aims to analyze the legal position of co-administration as a coordination instrument in the regional autonomy system, evaluate the effectiveness of coordination mechanisms, and identify juridical and implementative constraints. The research method uses a qualitative approach with library research to examine the legal construction of co-administration based on Law Number 23 of 2014 concerning Regional Government and its implementing regulations. The results show that co-administration has a strategic position as a bridging mechanism in the regional autonomy system with hybrid characteristics between centralization and decentralization. The juridical construction of co-administration contains four constitutive elements: assignment of partial government affairs, implementation by regional government, not full delegation of authority, and accountability to the assigning party. The effectiveness of coordination through co-administration is hampered by unclear division of authority, normative conflicts between regulations, resource limitations, and vertical-horizontal coordination barriers. The study concludes that optimizing the coordination function of co-administration requires reconstruction of the legal framework through regulatory improvement, strengthening coordination capacity, developing integrated monitoring evaluation systems, and establishing special dispute resolution mechanisms to create sustainable coordination in Indonesia's regional autonomy system.

Abstract

Penelitian ini mengkaji aspek hukum dalam penyelenggaraan sistem pemerintahan daerah di Indonesia dengan fokus pada landasan konstitusional dan regulasi utama yang mengatur otonomi daerah. Analisis dilakukan terhadap ketentuan dalam Undang-Undang Dasar 1945, khususnya Pasal 18B hingga 18J, serta Undang-Undang Pemerintahan Daerah dan Undang-Undang Otonomi Daerah yang mengatur hak, kewenangan, dan bentuk penyelenggaraan pemerintahan daerah. Studi ini menilai bagaimana penerapan prinsip otonomi daerah dijalankan sesuai dengan kerangka hukum yang ada, serta tantangan dalam pelaksanaan kewenangan daerah yang berdampak pada efektivitas pemerintahan dan pembangunan daerah. Hasil analisis menunjukkan bahwa pengaturan hukum yang jelas dan konsisten sangat penting untuk mendukung kemandirian daerah dan penyelenggaraan pemerintahan yang efisien dan akuntabel sesuai prinsip negara hukum. Penelitian ini juga menyoroti pentingnya harmonisasi antara pemerintah pusat dan daerah dalam rangka mewujudkan tata kelola pemerintahan daerah yang baik dan berkeadilan.

Abstract

Parking management falls under the authority of local governments in maintaining public order and transportation. In major cities, the increasing number of motor vehicles has led to various parking-related issues, such as illegal parking, unauthorized charges, and inefficient space utilization. Local governments, through legal policies—both regional regulations and their derivatives—seek to manage the parking sector to support traffic flow and enhance local revenue (PAD). However, practical challenges persist, including weak law enforcement, poor inter-agency coordination, and low public participation. This study aims to analyze local legal policies in parking management, identify prevailing problems, and propose legal and participatory solutions. Using a normative juridical and qualitative approach in several major Indonesian cities, this study finds that policy effectiveness depends greatly on the clarity of regulations, consistency of implementation, and robustness of monitoring. Thus, policy reform, improved administrative integrity, and community involvement are essential to ensure a fair, efficient, and sustainable parking management system.

Abstract

Women's political rights are fundamentally human rights, and human rights are the essence of the democratic framework. Therefore, involving women and men in the decision-making process is an absolute requirement in democracy. In this theory, in fact, there is no longer a female-male dichotomy. But in reality women's rights are still being politicized and mobilized in the name of democracy. With the fulfillment of the 30% quota for women's representation in parliament, there are at least two symptoms that can result from this excess. First, there is the seriousness of women in trying to enter the world of politics. In addition, politics is a state policy that regulates the direction and goals of the state, so that the policy-making process can be carried out by all components of the nation, including women. Second, public awareness to provide opportunities for women not only to vote but also to be elected.Hak politik perempuan pada dasarnya adalah hak asasi manusia, dan hak asasi manusia merupakan esensi dari kerangka demokrasi. Oleh karena itu, melibatkan perempuan dan laki-laki didalam proses pengambilan keputusan menjadi syarat mutlak dalam demokrasi. Dalam teori ini sesungguhnya tidak lagi ada dikotomi perempuan-pria. Tapi pada kenyataannya hak perempuan masih dipolitisasi dan dimobilisasi atas nama demokrasi. Dengan terpenuhinya quota 30 % keterwakilan perempuan diparlemen minimal ada dua gejala yang dapat ditimbulkan dari ekses tersebut. Pertama, adanya kesungguhan perempuan untuk berupaya mau terjun kedunia politik. Selain itu, kesadaran perempuan itu sendiri bahwa politik adalah bidang kebijakan kenegaraan yang mengatur arah dan tujuan negara, sehingga proses pengambilan kebijakan dapat dilakukan secara politis oleh semua komponen bangsa termasuk perempuan. Kedua, kesadaran masyarakat untuk memberikan kesempatan kepada perempuan untuk tidak saja memilih tetapi juga dipilih.
