Abstract

Deforestation is a phenomenon that needs to be addressed seriously to preserve the environment. One of the causes of deforestation is illegal logging activities in forest areas. The purpose of this research is to examine the impact of illegal logging, analyze the law enforcement process against illegal logging perpetrators and analyse obstacles in the implementation of law enforcement against illegal logging in Tojo Una-Una Regency. The research method uses empirical juridical research by using a conceptual approach and a case approach. This research concludes that the investigation of the crime of illegal logging in the Tojo Una-Una Regency area is carried out by Investigators at the Tojo Una-Una Police Station and Civil Servant Investigators of the Sulawesi Regional Environmental and Forestry Law Enforcement and Security Centre and obstacles in the implementation of law enforcement come from technical obstacles such as the difficulty of the terrain that must be traversed to reach the forest area,  lack of facilities and infrastructure and lack of personnel at Tojo Una-Una Police Station and investigators of the Sulawesi Regional Environmental and Forestry Law Enforcement and Security Centre to carry out law enforcement duties against illegal logging crimes, as well as obstacles originating from the rule of law or legal substance, especially after the enactment of the Job Creation law.

Abstract

The rise of globalization values: secularism, capitalism, legal liberalization and democratic freedom that is sweeping the world today can create a disharmony of diversity during legal pluralism that exists in Indonesia between state law, religious law and customary law. The context of reproduction in this study redesigns policies based on Islamic law that have a vision that can moderate diversity in Indonesia so that the existence of Islamic law can be accepted in the context of diversity and diversity in an inclusive manner. To conduct the research, the author uses conceptual approaches and statutory law. As a result, the author concluded that legal pluralism in Indonesia should not occur strong autonomy in each legal system but increasingly interact and interconnect in the context of moderation, this complementary reproduction model of pluralism is being designed in this study.

Abstract

Pada dasarnya undang-undang perlindungan konsumen melindungi Pemilik usaha dan konsumen agar kedudukan para pihak seimbang dalam melakukan transaksi. Hubungan hukum yang terbangun antara pemilik usaha dan kosumen didasari perjanjian, tidak terkecuali dalam usaha jasa laundry. Lahirnya hak dan kewajiban para pihak disebabkan perjanjian yang disepakati. Dalam prakteknya perjanjian yang mengikat para pihak tergolong perjanjian baku yang mencantumkan klausula eksonerasi yang berisi pengalihan tanggung jawab. Perjanjian dalam Islam bernafaskan keadilan, keseimbangan dan kesetaraan sehingga perjanjian yang disepakati tidak merugikan salah satu pihak. Penelitian ini bersifat normatif empiris, dengan metode analisis kualitatif dan ditarik kesimpulan secara deduktif. Jasa Umi Laundry dalam transaksinya menggunakan perjanjian baku yang memuat klausul eksonerasi, berdampak pada pengalihan tanggung jawab jika ada konsumen yang mengajukan komplain kepada pemilik usaha. Dengan adanya klausul eksonerasi berdampak pada konsumen yang tidak dapat menuntut ganti kerugian. Hal ini bertentang dengan pasal 18 ayat 1 undang-undang perlindungan konsumen yang melarang perjanjian baku yang berisi pengalihan tanggung jawab. Dalam hukum Islam perjanjian yang disepakati berimplikasi ukhrawi dan duniawi sehingga pemenuhan akan perjanjian tersebut sangat dianjurkan dipertegas kembali pada adgium al muslimun indhi surutihum “ setiap muslim terikat pada perjanjian-perjanjianya. Akan tetapi jika perjanjian tersebut bertentang dengan asas-asas akad/ perjanjian maka akad tersebut batal demi hukum. Sebagaimana perjanjian baku yang memuat klausul eksonerasi yang berisi pengalihan tanggung jawab seolah-oleh pemilik usaha terbebas dari kewajiban ketika melakukan kesalahan. Klausula eksonerasi bertentang dengan asas-asas dalam akad semisal asas kebebasan, asas kesetaraan, asas keadilan dan asas keridhaan. Pada umumnya akad yang dibuat harus bersifat adil, setaraan dan seimbang untuk mencegah terjadinya kedhaliman.

Abstract

Batanati is a tradition of the Batujungku community on Buru Island which is carried out before a celebration. The community helps each other by handing over a sum of money to the owner of the celebration and is mandatory. This study aims to explore the substantive values ​​of the batanati tradition of the Buru Island community and its coexistence with Islamic law. This study uses empirical research using primary and secondary data. Furthermore, the data obtained is then analyzed based on the perspective of Islamic law. This study uses a conceptual and historical approach to reveal the coexistence of the substantive values ​​of the batanati tradition with Islamic law. The results of the study show that the batanati tradition is an interaction between individuals that contains local wisdom, namely the values ​​of mutual assistance, unity, togetherness and brotherhood. These values ​​become a reference and are cultivated by the community in each generation so that they become a social force. In an Islamic perspective, the batanati tradition is categorized as 'urf Sahih because it is a habit that has been carried out from generation to generation and can also be accepted and carried out by many people and does not conflict with sharia'. Therefore, the Batanati tradition needs to be maintained and the Batanati tradition continues to prioritize deliberation and consensus in order to be in line with Islamic values. Abstract

Legal protection for consumers of halal products has occurred since the old order. At that time, halal regulations did not guarantee legal certainty. The state passed a regulation that specifically regulated the guarantee of halal products. However, it continues to change now. This research aims to analyze the development and direction of legal protection for consumers of halal products after enactment   of Halal Product Guarantee Law. This research was a normative domain using primary and secondary legal materials. Legal materials that have been collected were analyzed by explaining existing theories logically and systematically to obtain significant and scientific results. Furthermore, a transcript was carried out. The results of the research showed that the state has attempted to guarantee legal protection for consumers of halal products through the establishment of regulations. However, the regulation of the halal guarantee system continues to change and tends to be influenced by economic interests so the basic rights of consumers are not fulfilled. Therefore, the government needs to reform the legal system in protecting consumers of halal products based on the principle of balance of rights to provide a sense of justice, and benefit and guarantee legal certainty

Abstract

Interfaith marriage in Indonesia has become a complex legal issue with legal disparities between the Marriage Law and the Population Administration Law. The Marriage Law affirms that marriage is valid if conducted according to each religion's law, while the Population Administration Law allows interfaith marriages to be legalized through court decisions. This disparity creates legal uncertainty in Indonesia, as evidenced by differing legal interpretations by judges at various court levels. This research uses normative legal methods with legislative, conceptual, and case approaches to analyze this phenomenon and find solutions. The research findings suggest the need for harmonization between marriage law and population administration. A short-term solution involves issuing Supreme Court regulations that align with religious values, while a long-term solution requires legal reforms to synchronize regulations, ensuring legal certainty for interfaith marriages in Indonesia.

Abstract

This research examines the application of Islamic criminal law in addressing the negative impacts of online gambling on society, both socially and economically. The main objective of this study is to analyze the effectiveness of applying Islamic criminal law in dealing with the negative impacts caused by online gambling through a normative juridical approach. The method used is normative juridical, examining laws and regulations, fatwas, and the principles of Islamic criminal law relevant to online gambling issues. The findings show that although Islamic criminal law is firm on gambling, its application within Indonesia's positive law has not been fully effective in mitigating the negative impacts of online gambling. In conclusion, the application of Islamic criminal law can be an alternative solution to address the negative impacts of online gambling, but it requires harmonization with the prevailing positive law in Indonesia. Additionally, preventive efforts from the government and society are necessary to prevent the spread of online gambling. Abstract

Law Number 8 of 1999 concerning Consumer Protection (UUPK) has served as the legal foundation for consumer protection in Indonesia for over two decades. However, in practice, various issues continue to arise, particularly concerning the misalignment between existing regulations and the rapid development of digital technology, the complexity of electronic transactions, and the weak enforcement mechanisms against business actors. This article aims to examine the urgency of reconstructing the UUPK through the lens of the theory of legal responsiveness, which emphasizes the adaptability of law to social and economic dynamics. This study employs a normative juridical method with a conceptual and legislative approach. The novelty of this study lies in its theoretical perspective, using legal responsiveness as the basis for proposing reforms to the UUPK, rather than merely offering normative-technical corrections. The findings suggest that reforming the UUPK must address institutional structures, the expansion of digital consumer rights, and the strengthening of enforcement through administrative sanctions and digital governance instruments. The conclusion recommends a comprehensive redrafting of the UUPK to make it more responsive to social, technological, and economic changes, and aligned with adaptive and progressive principles of universal consumer protection.
