Abstract

The inhabitants of Pattiro Village, situated within the Dua Boccoe Subdistrict of Bone Regency, are renowned for their customary practice known as "mappanini bosi." However, it has been observed that adherence to the established rules of this tradition is frequently breached by community members. This research aims to explore the use of mappanini bosi tradition within Bugis society and to examine perspective of Islamic law on the jurisprudential rule of al-ādah muhakkamah. Accordingly, this empirical qualitative research was conducted in Pattiro Village, situated within the Salomekko District of Bone Regency in South Sulawesi Province. The methodology used adopted a synthesis of two theoretical frameworks, namely the reception-exit theory and al-'urf. To achieve the research aim, data were gathered through field studies and literary sources, and subsequently processed and analyzed using reduction, presentation, and conclusion methods. The obtained results showed the significance of mappanini bosi tradition within Bugis community, which was recognized as integral for achieving success in their various endeavors. It was also observed that not all individuals in Pattiro Village actively engage in this custom. Ritual stages of mappanini bosi include the use of leaves, millipede animals, sharpening stones, burning dippers, and underwear. In accordance with this, the fiqh rule al-ādah muhakkamah concerning the practice of mappanini bosi was evaluated in this research. From this evaluation, it was found that some elements deviated from certain Muslim beliefs, but not all aspects contravened mappanini bosi principles. Ritual process comprised the use of specific materials, and intentions, and attributing significance to ritual items believed to influence rainfall. This research urges practitioners of rain-charming ritual and Bugis community to regard mappanini bosi as local wisdom while concurrently respecting Islamic law as an integral component of community life.

Abstract

Tanaman porang memliki nilai ekonomis yang tinggi, namun yang menjadi kendala adalah penyewaan tanah yang nilainya cukup besar. Pokok masalah pada penelitian ini adalah bagaimana pandangan Mazhab Hanafi terhadap ketentuan dan pelaksanaan sewa menyewa tanah untuk budidaya tanaman porang di Desa Belabori, Kecamatan Parangloe, Kabupaten Gowa. penelitian ini bertujuan untuk mengetahui praktik sewa menyewa tanah untuk budidaya tanaman porang dan mengetahui Perspektif Mazhab Hanafi terkait ketentuan dan pelaksanaan sewa menyewa. penelitian ini menggunakan metode field research. Penelitian ini bersumber dari data sekunder dan data primer dengan mengelola data wawancara, penelitian ini menunjukkan bahwa, praktik sewa menyewa yang terjadi di Desa belabori pelaksanaan sewa menyewa tersebut pihak penyewa dapat melaksanakan aktifitas di atas lahan tersebut dalam rangka penanaman porang setelah pihak penyewa membayar lunas sewa lahan yang teah disepakati bersama. Ketentuan dan pelaksanaan sewa menyewa tanah di Desa Belabori, ditinjau berdasarkan perspektif Mazhab Hanafi mempunyai pendapat bahwasanya orang yang menyewakan tanah tidak berhak atas uang sewaannya sebelum tanah tersebut bisa diambil manfaatnya.

Abstract

A polemic that often occurs in the community, especially in Gowa Regency, is the diversion of sunrang to children which often causes problems. So there are often problems in the family that cause disputes between the first child and his other siblings. The main problem in this study is how to transfer sunrang to children in Sapaya village, Bungaya district, Gowa regency, How to analyze the rule of al-'Aadatul Muhakkamah on the phenomenon of transferring sunrang to children in Sapaya Village, Bungaya District, Gowa Regency. This type of research is field research. The approaches used are the Normative Syar'i Approach and the Sociological approach. The methods used in this study are observation, interviews and documentation. From the results of research conducted by researchers on the phenomenon of the transfer of sunrang to children in Sapaya Village, Bungaya District, it shows that the transfer of sunrang to children is carried out in a hereditary manner which is passed on by the community in Sapaya Village. However, the existence of this diversion causes injustice in the provision of sunrang because only the first child is prioritized while the other children do not have the right to receive the transfer of sunrang. The implications of this study are expected to reduce disputes in the diversion of sunrang.

Abstract

This study aims to analyze the transformation of intellectual property rights (IPR) as an object of waqf in the perspective of Islamic law, with a focus on normative studies and their implementation in contemporary practice. The main issue raised is the extent to which IPR, as an intangible asset, can be accepted within the framework of Islamic law as an object of waqf, as well as the challenges that arise in the implementation process. This study uses a qualitative method based on literature studies, with a normative approach to review the provisions of classical and modern Islamic law, as well as analysis of regulations related to waqf and IPR. The results of the study show that IPR meets the criteria of sharia as an object of waqf, especially in the framework of sharia maqasid which focuses on the protection of assets (hifzul maal) and the achievement of the benefits of the people. However, the implementation of IPR waqf still faces obstacles, such as the lack of specific regulations, limited public understanding, and obstacles in the management and distribution of its benefits. The implications of this study emphasize the importance of updating the waqf law to include IPR as one of the waqf assets, accompanied by strengthening the management capacity and synergy between religious institutions, the government, and the community. This transformation is expected to be able to expand waqf's contribution to science-based economic development and increase the sustainability of social benefits.
