Abstract

The purpose of this research is to analyze and understand the legal protection of workers whose employment relationship is terminated and the legal liability of employers who carry out layoffs according to Law Number 06 of 2023 concerning Job Creation. The urgency of this research requires regulations regarding layoffs due to serious or urgent violations contained in the Job Creation Law and its supporting laws and regulations. Employers carry out layoffs on the grounds of serious or urgent violations without going through a criminal law process that has permanent legal force. This decision was further strengthened by the existence of SEMA Number 03 of 2015 concerning the Implementation of the Formulation of the Results of the Plenary Meeting of the Supreme Court Chamber where layoffs can be carried out without having to wait for a legally binding court decision. This research uses a juridical-normative method, through a statutory legal approach. The results of research by workers who have been laid off and representatives of workers who have suffered losses due to serious or urgent violations have examined legal regulations regarding the Job Creation Law and PP 35 of 2021, Article 52 which regulates urgent violations, so that workers cannot be a termination by the Company without waiting for legally binding court, and the Employer carries out the rules following the previous rules regarding serious violations. Tujuan penelitian ini menganalisis dan memahami perlindungan hukum tenaga kerja yang diputus hubungan kerjanya dan pertanggungjawaban hukum pengusaha yang melakukan PHK menurut UU Nomor 06 Tahun 2023 tentang Cipta Kerja. Urgensi penelitian ini perlu pengaturan mengenai PHK karena pelanggaran berat atau bersifat mendesak yang terdapat pada UU Cipta Kerja dan peraturan perundangan pendukungya. Pengusaha melakukan PHK dengan alasan pelanggaran berat atau bersifat mendesak tanpa melalui proses hukum pidana yang berkekuatan hukum tetap. Keputusan tersebut dikuatkan lagi dengan adanya SEMA Nomor 03 tahun 2015 tentang Pemberlakuan Rumusan Hasil Rapat Pleno Kamar MA dimana PHK dapat dilakukan tanpa harus menunggu putusan pidana berkekuatan hukum tetap. Penelitian ini menggunakan Metode yuridis-normatif, melalui pendekatan hukum perundang-undangan. Hasil penelitian pihak pekerja yang di PHK maupun perwakilan pekerja yang dirugikan karena pasal pelanggaran berat atau bersifat mendesak melakukan pengujian peraturan perundangan mengenai UU Cipta kerja dan PP 35 tahun 2021, pasal 52 yang mengatur mengenai pelanggaran bersifat mendesak, agar pekerja tidak dapat di PHK secara sewenang-wenang oleh Perusahaan tanpa menunggu keputusan pengadilan pidana yang bersifat mengikat, serta Pengusaha menjalankan aturan sesuai dengan aturan terdahulu mengenai pelanggaran berat.

Abstract

This research aims to analyze the legal implications of providing severance pay to employees who are absent without valid reasons and are not regulated in the employment contract. After the 1998 reform, labor law in Indonesia underwent significant changes aimed at creating a harmonious and fair industrial relationship. One important aspect is the regulation of termination of employment (layoffs) and the provision of compensation to workers, including severance pay. However, not all conditions of layoffs and compensation are specifically regulated in collective labor agreements or company regulations. The research method used is normative juridical with a case approach. The research findings indicate that the ambiguity of regulations regarding severance pay can lead to disputes between workers and employers, as well as legal uncertainty. The novelty of this research lies in the analysis of court decisions and applicable regulations regarding compensation for absent workers, which have not been regulated in employment agreements. This research suggests the need for clearer regulations to avoid legal conflicts in the future. Penelitian ini bertujuan untuk menganalisis implikasi hukum pemberian uang pisah kepada pekerja yang mangkir tanpa keterangan yang sah dan tidak diatur dalam perjanjian kerja. Setelah reformasi tahun 1998, hukum ketenagakerjaan di Indonesia mengalami perubahan signifikan dengan tujuan menciptakan hubungan industrial yang harmonis dan adil. Salah satu aspek penting adalah pengaturan pemutusan hubungan kerja (PHK) dan pemberian kompensasi kepada pekerja, termasuk uang pisah. Namun, tidak semua kondisi PHK dan pemberian kompensasi diatur secara spesifik dalam perjanjian kerja bersama atau peraturan perusahaan.. Metode penelitian yang digunakan adalah yuridis normatif dengan pendekatan kasus. Hasil penelitian menunjukkan bahwa ketidakjelasan aturan mengenai uang pisah dapat menimbulkan perselisihan antara pekerja dan pengusaha, serta ketidakpastian hukum. Kebaruan penelitian ini terletak pada analisis putusan pengadilan dan peraturan yang berlaku terkait kompensasi bagi pekerja mangkir, yang belum diatur dalam perjanjian kerja. Penelitian ini menyarankan adanya regulasi yang lebih jelas untuk menghindari konflik hukum di masa depan.

Abstract

This research aims to analyze the judge's considerations when deciding industrial relations court cases with separate filings and the legal consequences of differences in rulings from industrial relations court cases with separate filings (splitting). The urgency of this research is that currently, courts consider factors beyond the literal interpretation of the law when making decisions, therefore legal professionals, including judges, must have empathy for individuals which is reflected in their decisions. This type of research is normative juridical. The research results show that splitting in the resolution of industrial relations cases refers to the separation of interest disputes and employment termination (PHK) disputes in decisions. However, this separation creates legal uncertainty and a damaged sense of justice. This separation of cases also has the impact of separating settlements and decisions, resulting in two different decisions for each type of dispute, with different legal consequences. The Civil Procedure Law (HIR) and Field Room (RBg) systems are used in industrial relations courts, but high costs, especially for workers, are the main obstacle. Apart from that, differences in decisions between judges also give rise to injustice. Penelitian ini bertujuan untuk menganalisis pertimbangan hakim pada saat memutuskan perkara pengadilan hubungan industrial dengan pemberkasan yang terpisah dan akibat hukum dari perbedaan amar putusan dari perkara pengadilan hubungan industrial dengan pemberkasan yang terpisah (splitsing). Urgensi penelitian ini yaitu saat ini, pengadilan mempertimbangkan faktor-faktor di luar penafsiran hukum secara harafiah ketika mengambil keputusan, oleh karena itu para profesional hukum, termasuk hakim, harus memiliki empati terhadap individu yang tercermin dalam putusannya. Jenis penelitian ini yaitu yuridis normatif. Hasil penelitian menunjukkan bahwa splitsing dalam penyelesaian perkara hubungan industrial mengacu pada pemisahan perselisihan kepentingan dan perselisihan pemutusan hubungan kerja (PHK) dalam putusan. Namun, pemisahan ini menimbulkan ketidakpastian hukum dan rasa keadilan yang tercederai. Pemisahan perkara ini juga berdampak pada pemisahan penyelesaian dan putusan, menghasilkan dua amar putusan yang berbeda untuk setiap jenis perselisihan, dengan konsekuensi hukum yang berbeda pula. Sistem Hukum Acara Perdata (HIR) dan Ruang Bidang (RBg) digunakan dalam pengadilan hubungan industrial, namun biaya tinggi, terutama bagi pekerja, menjadi kendala utama. Selain itu, perbedaan putusan antara hakim juga menimbulkan ketidakadilan.

Abstract

This research aims to analyze the process of implementing a voluntary non-execution movable object auction at PT JBA Indonesia Semarang City Branch. As well as to analyze legal protection for winners of non-voluntary execution movable object auctions at PT JBA Indonesia Semarang City Branch. The urgency of this research is so that auction winners are not deceived by the condition of movable objects when they are declared to have won the auction. And so that the auction winner gets legal protection and understands the legal standing at the time of the auction. This writing is empirical juridical research with a statutory approach and a case approach. The research specifications used in this research are analytical descriptive. The data collection method used by the author is by examining primary data obtained through interviews with employees and assistants to the leadership of the private auction house PT JBA Indonesia, Semarang City Branch, which was conducted directly at the PT JBA Indonesia Semarang City Branch office and secondary data obtained from materials. References. The results of the research explain that the auction implementation at the private auction center PT JBA Indonesia uses a voluntary non-execution auction type, then the auction implementation is also divided into several categories, namely pre-auction, during the auction, and post-auction. There are several categories of legal protection for winners of auctions for non-voluntary movable objects, namely disclosure of information about auction winners, private auction houses daring to take responsibility for errors in auction implementation and special complaints regarding auction implementation.
