Abstract

The era of globalization brings business development and increased dispute potential. Countries are forming multinational agreements to promote free markets and avoid disputes. Litigation in court as a dispute resolution tends to be long and expensive, so business people turn to arbitration which is faster and more efficient. The purpose of this study is to analyze the legal framework and mechanisms for recognition and enforcement of foreign arbitral awards in Indonesia and Singapore, comparing their approaches. It is expected to provide in-depth insights and recommendations to improve the effectiveness of business dispute resolution through international arbitration in cross-border business. This legal research uses the normative legal research method, which involves the analysis of products of legal behavior such as laws as normative case studies. . Such disputes often involve different legal systems, and therefore, a platform is needed that can resolve such disputes. International arbitration has become a popular alternative in business dispute resolution.

Abstract

Masalah kenakalan remaja merupakan masalah yang setiap hari semakin bertambah dan beragam kasusnya seiring dengan perkembangan zaman dan teknologi. Banyak kasus kenakalan remaja yang bisa dijumpai di kehidupan sekitar masyarakat. Sering kali diberitakan bahwa kasus-kasus tindakan kriminal saat ini umumnya dilakukan usia remaja. Akibat merebaknya kenakalan remaja, masyarakat menjadi dirugikan oleh tindakan mereka. tujuan yaitu penyebarluasan atau penanaman nilai-nilai serta norma yang terkandung dalam substansi materi sosialisasi itu sendiri, sosilaisasi ini merupakan tindak lanjut dari penelitian yang sudah dilakukan oleh Tim Peneliti Fakultas Hukum Universitas Singaperbangsa. Skema penelitian dan pengabdian yang dilakukan oleh tim pada kegiatan ini yaitu penelitian pemula yang diintegrasikan dengan Pengabdian Kepada Masyarakat. Kegiatan Sosialisasi yang dilakukan oleh Tim Abdimas kepada mitra sasaran Pengabdian yaitu di Desa Kalijati Kecamatan Jatisari Kabupaten Karawang. Kegiatan ini bertujuan agar mitra sasaran Pengabdian memiliki pemahaman akan peran pemerintah desa dalam pencegahan dan penanggulangan kenakalan remaja serta melakukan sosialisasi desa sadar hukum.

Abstract

Human rights abuses occurring in Gaza, including civilian casualties, have been countlessly reported. Despite numerous resolutions presented, particularly to the United Nations (UN) Security Council (UNSC), data from the UN reveals that they have unfortunately been vetoed. South Africa initiated a legal action before the International Court of Justice (ICJ) accusing Israel of breaching the 1948 Genocide Convention—a treaty to which both nations are Parties to. Based on doctrinal analysis, this paper raises one big question; whether the UNSC, that is supposed to uphold international peace and security, will become a stumbling block in the quest for justice for the Palestinian and fails to serve its purpose? This paper argues that judging from Netanyahu’s statement that Israel will not follow and perform any ICJ’s decisions and the United States, being one of the UNSC permanent members will use any necessary measures within the UNSC to prevent such decision from being enforced. This paper concludes that the veto power within the UNSC hinders the pursuit of justice for the Palestinians and the ability of certain member states to veto resolutions creates challenges in the Council’s effectiveness and compromises its capacity to address the conflict for the pursuit of justice.

Abstract

Education is essential for human development, enabling individuals to cultivate their potential through formal learning processes and other socially recognized means. It serves as a transformative tool that shapes human character and broadens knowledge. This study aims to analyze the implementation of policies related to the fulfillment of children's right to education within the compulsory education program in Dongkal Village, Pedes District, Karawang Regency. The research employs a normative juridical approach, examining the application of legal provisions in practice and their role in addressing legal issues within society. A qualitative research method with a prescriptive analysis approach is utilized to critically evaluate the effectiveness of these policies. This study not only assesses the fulfillment of children's educational rights but also contributes to a broader discourse on sustainable development by integrating legal and socio-economic perspectives. The findings of this research provide valuable insights into the effectiveness of compulsory education policies and their implementation at the local level. Furthermore, this study offers recommendations for policymakers to enhance the legal framework governing compulsory education, ensuring equitable access to quality education for all children. By addressing gaps in policy enforcement and aligning educational initiatives with human rights principles, this research contributes to the development of more inclusive and sustainable education policies in Indonesia.

Abstract

Indonesia’s location between the Indian and Pacific Oceans positions it as a crucial maritime route, thereby revealing significant maritime opportunities. This strategic location also presents significant vulnerabilities, especially from foreign vessels involved in unlawful activities, including illegal, unreported, and unregulated (IUU) fishing. IUU fishing represents a widespread issue that threatens regional security and the sustainability of marine ecosystems, ultimately impacting food security and economic viability.  This research adopts a normative legal methodology, incorporating an extensive literature review to examine the philosophical underpinnings and regulatory benchmarks pertinent to Indonesia's enforcement framework addressing IUU fishing.  This analysis scrutinizes current legal resources and explores the intricate dynamics of overlapping jurisdictions among maritime agencies, intensifying enforcement inefficiencies and generating operational uncertainties. This study proposes implementing the Single Agency Multi-Tasks (SAMT) system as a comprehensive approach to enhance law enforcement efforts targeting foreign vessels involved in IUU fishing within Indonesia's Fisheries Management Areas (FMAs), considering the existing challenges.  The SAMT framework aims to centralize authority within the Marine Security Agency (BAKAMLA) to streamline operations and improve regulatory compliance, ultimately contributing to a strong maritime governance structure. The results highlight the importance of implementing legal reforms and establishing coordinated governance mechanisms by national and international maritime regulations. This study significantly enhances the discussion surrounding optimizing fisheries management and reinforcing Indonesia’s sovereignty in its maritime areas while also tackling the widespread challenges IUU fishing activities present.
