Abstract

Penelitian ini bertujuan untuk melihat bagaimana realisasi hak dan kewajiban rumah sakit serta pasien dalam pelayanan kesehatan, berdasarkan UU Nomor 44 Tahun 2009, serta bagaimana efektifitas dan perlindungan hukum dalam pelayanan kesehatan di rumah sakit umum terhadap peserta BPJS kesehatan studi rumah sakit umum sembiring deli tua. Hasil penelitian yaitu Hak dan kewajiban rumah sakit serta pasien, termasuk peserta BPJS Kesehatan, telah diatur secara jelas dalam berbagai peraturan dan Undang-Undang di Indonesia. Pasien umum dan peserta BPJS memiliki hak yang sama dalam mendapatkan akses dan pelayanan kesehatan yang bermutu dan aman. Namun, peserta BPJS memiliki kewajiban membayar iuran dan harus mengikuti sistem rujukan yang ditetapkan. Rumah Sakit Umum Sembiring Deli Tua beroperasi sesuai dengan berbagai peraturan dan Undang-Undang, termasuk sistem rujukan pelayanan kesehatan. Selama periode Juli, RSU Sembiring berhasil melayani 8318 pasien BPJS. Meskipun demikian, tantangan dan hambatan di lapangan tetap ada dan memerlukan perhatian dari pembuat kebijakan. RSU Sembiring secara umum berhasil dalam melayani peserta BPJS Kesehatan dengan efektif dan mematuhi hukum. RSU Sembiring merupakan contoh bagaimana fasilitas kesehatan harus terus beradaptasi dan bekerja sama dengan BPJS dan pemerintah untuk mencari solusi terhadap tantangan yang ada, demi memastikan pelayanan kesehatan yang efektif dan perlindungan hukum bagi peserta BPJS.

Abstract

Kesehatan merupakan kebutuhan dasar bagi siapapun, tentu sehat adalah sebuah anugerah yang amat sangat tinggi nilainya, terlebih ada satu sisi dimana orang-orang banyak berupaya untuk tetap sehat atau bahkan mengharapkan kesembuhan dengan mengonsumsi obat-obatan, mulai dari obat yang tergolong biasa, hingga sampai obat yang tergolong keras, mulai dari obat yang bebas di beli dimanapun hingga sampai obat yang wajib mengantongi resep dokter. Hal itulah yang menjadi locus penelitian kami. Bagaimana sebenarnya pertanggungjawaban hukum akan peredaran obat keras yang diperjual belikan atau dikonsumsi dengan tanpa resep dokter. Dengan metode penelitian yuridis normati kami berharap dapat memaksimalkan tema ini untuk dibahas hingga nantinya mendapatkan klimaks atau kesimpulan yang dapat menjadi acuan para akademisi dan dapat dipertanggungjawabkan. Hasil penelitian kami setelah membaca berbagai regulasi dan undang-undang didapati bahwa tidak diperbolehkan memperjualbelikan obat keras yang sudah ditentukan tanpa mengantongi resep dokter, buruknya pengaruh terhadap pendidikan Islam. Seperti yang diatur pada pasal 196 sampai pasal 198 Undang Undang Nomor 36 Tahun 2009 tentang kesehatan. Bahwa pelaku dapat dijatuhi hukuman 10 tahun atau denda 1 miliar, begitupun dengan konsumen sebagai pengguna dapat dijerat undang-undang narkotika apabila obat keras dimaksud mengandung psikotropika, Undang Undang Nomor 35 tahun 2009 tentang Narkotika.

Abstract

The phenomenon of prisoner escapes impacts the criminal law enforcement process, which aims to prevent the public from becoming victims of crime and halt the correctional process in prisons. Sanctions for prisoners who escape from correctional institutions still impose disciplinary penalties in the form of reclusion and the suspension or revocation of certain rights in accordance with applicable laws and regulations without additional criminal proceedings for the inmates. The purpose of this study is to determine law enforcement against prisoners who escaped from correctional institutions, factors that cause prisoners to escape from correctional institutions, and criminal law enforcement against prisoners who escaped from the Class IIA Langkat Narcotics Correctional Institution. This study is a descriptive study with a normative juridical research type using qualitative analysis methods. From the results of the study, the laws and regulations related to prisoners and convicts who escape from detention centers and correctional institutions are Articles 34 and 85 of the Criminal Code, Article 67 of Law Number 22 of 2022 concerning Corrections and Regulation of the Minister of Law and Human Rights of the Republic of Indonesia Number 6 of 2013 concerning the Rules of Procedure for Correctional Institutions and State Detention Centers, Factors for prisoners escaping from correctional institutions or state detention centers are caused by Internal Factors such as Willingness with personal encouragement, Long prison sentences and External Factors such as Over capacity, Environment and Social Relations, Lack of prison security officers, Inadequate Building Conditions, and Opportunity Factors and Law enforcement against prisoners who escape is by giving sanctions for serious disciplinary violations by entering them into a silent lockup for 12 days and to officers who are negligent or intentionally allow prisoners or detainees to escape is by applying administrative sanctions in the form of warnings to delays in promotions to dismissal from office or with criminal sanctions in prison

Abstract

In the current digital era, the increasing reliance on information technology in the healthcare sector, especially through the use of Hospital Management Information Systems (SIMRS) as an effort for administrative orderliness and also to avoid medical disputes in health services, brings significant risks related to cybercrime. SIMRS, which integrates the management of sensitive health data such as medical records and financial information, has become a primary target for cybercriminals. Cybercrime, particularly hacking, is a real threat that not only disrupts hospital operations but also damages public trust in the healthcare system and threatens the loss or misuse of data. This study aims to identify the legal vulnerabilities in SIMRS in Indonesia, analyze the legal implications of cybercrime hacking, and evaluate the effectiveness of existing regulations against hacking as an evaluation and protection for the present and the future. The research method used is doctrinal, focusing on the normative analysis of relevant regulations and legal documents, including the Indonesian Law No. 11 of 2008 as amended by Indonesian Law No. 19 of 2016 on Information and Electronic Transactions, and the Minister of Health Regulation of the Republic of Indonesia No. 82 of 2013 on Hospital Management Information Systems. This approach involves data collection through literature studies and analysis of existing regulations to identify gaps and the need for legal reforms. The results of the research show that although the ITE Law provides a strong legal foundation, there is still a need for revision and adaptation to accommodate technological developments and the ever-changing hacking practices. Based on these findings, the recommendations proposed include revising the ITE Law to include more specific aspects of health data security, adopting international cybersecurity standards, enhancing human resource capacity, and fostering closer cooperation between sectors in developing cybersecurity solutions. The implementation of these recommendations is expected to strengthen data security in SIMRS and improve the resilience of the health sector against cyber threats. Thus, the integrity and privacy of patient data can be maintained, ensuring smooth hospital operations.

Abstract

Medical disputes continue to grow in complexity as public expectations for high-quality healthcare and legal awareness increase. Within this context, the Medical Committee holds a crucial role as an internal hospital mechanism responsible for providing professional and objective assessments of medical actions before disputes escalate to external forums. This study aims to examine the normative position, authority, and effectiveness of the Medical Committee in the resolution of medical disputes within the framework of existing legislation. The research employs a normative juridical method by analyzing the provisions of the Health Law No. 17 of 2023, Hospital Law No. 44 of 2009, Medical Practice Law No. 29 of 2004, and Minister of Health Regulation No. 755/MENKES/PER/IV/2011. The findings indicate that the Medical Committee possesses strong legal legitimacy to conduct medical audits, maintain professional standards, and provide technical recommendations in dispute resolution. However, its effectiveness varies due to inconsistent implementation, overlapping authority with other internal bodies, and the absence of uniform operational guidelines. This study highlights the need for strengthened regulation and standardized procedures to enhance the role of the Medical Committee as an effective early-stage dispute filter and a provider of legal certainty within hospital-based medical dispute mechanisms..

Abstract

Surgical procedures in children with tumors constitute high-risk medical services that have the potential to give rise to medical disputes. Within the framework of health law, hospitals function not only as healthcare providers but also as legal entities responsible for service quality, patient safety, and the resolution of medical disputes. This study aims to analyze the legal responsibilities and roles of hospitals in resolving medical disputes arising from pediatric surgical procedures in children with tumors, based on Minister of Health Regulation Number 24 of 2022, Law Number 17 of 2023 on Health, and Government Regulation Number 28 of 2024. The research employs normative and empirical juridical approaches, supported by field studies conducted at H. Adam Malik General Hospital, Medan. The findings indicate that hospital legal responsibility is comprehensive, encompassing the actions of medical personnel, healthcare service systems, compliance with patient safety standards, and medical record documentation. Hospitals also play a strategic role in resolving medical disputes through non-litigation mechanisms, particularly internal mediation and patient complaint systems, in order to provide legal protection and prevent the escalation of disputes.

Abstract

Health service activities at Community Health Centers (Puskesmas) are increasingly dependent on electronic systems, so system failures can cause service delays and potentially violate patients’ rights. This condition requires legal protection and clear accountability of health service providers. This study aims to analyze electronic system failures at Puskesmas, their impact on services, the forms of legal protection available to patients, and the legal liability that may be applied. The research uses a normative juridical method based on the Health Law, the Electronic Information and Transactions Law, and the Personal Data Protection Law. The results show that system failures lead to service delays and access barriers, with providers’ liability potentially taking administrative, civil, or criminal forms. This study emphasizes the importance of strengthening digital infrastructure and technical regulations to ensure the reliability of electronic health services at Puskesmas.

Abstract

This study examines the legal role of informed consent in high-risk dental medical procedures under Law Number 17 of 2023 on Health. Informed consent represents not only an ethical obligation but also a legal mechanism ensuring patient autonomy and professional accountability. Using a normative juridical method with statutory, conceptual, and case approaches, this research analyzes how the new legal framework strengthens patient protection and defines the professional responsibilities of dental practitioners. The findings indicate that despite the law’s explicit provisions particularly Articles 293 and 294 implementation remains constrained by limited legal literacy, ineffective communication, and insufficient documentation among practitioners. From the ethical perspective, informed consent reflects respect for autonomy, while legally it serves as preventive protection against malpractice claims. Therefore, enhancing professional understanding, integrating bioethics and health law in education, and ensuring standardized consent documentation are essential to achieving transparent, fair, and patient-centered dental services in Indonesia.
