Abstract

This research is a juridical review of Health Service Facilities based on Law Number 17 of 2023. This study aims to analyze and interpret the legal provisions contained in the law relating to the implementation of health service facilities in Indonesia. The research method used is a normative juridical approach, by examining in depth the text of Law Number 17 of 2023, especially in Articles 165-196 which regulate Health Service Facilities. The analysis is conducted to understand the substance, implications, and scope of these provisions in the practice of health services. The results of this study are expected to provide a deeper understanding of the role of health service facilities in the new legal framework. In addition, this research also aims to identify potential obstacles or problems that may arise in the implementation of the provisions of the law and provide recommendations for future improvements and policy development. This research is expected to contribute to the development of health law, as well as provide a more comprehensive view of the roles and responsibilities of health care facilities in supporting the achievement of national health goals in accordance with applicable regulations

Abstract

Medical records are simply a history of health services and illnesses faced by patients. The use of electronic medical records is predicted to be the most effective method of reducing errors, improving the quality of health services, and reducing costs. With the recommendation for the use of electronic medical records, many health service providers are implementing electronic medical records in an effort to improve service quality, increase patient satisfaction, and reduce medical errors. In Minister of Health Regulation no. 269 of 2008 Chapter II article 2 states that: (1) Medical records must be made in writing, complete and clear or electronically. (2) The administration of medical records using electronic information technology is further regulated by separate regulations. Before the issuance of Regulation of the Minister of Health of the Republic of Indonesia Number 24 of 2022 concerning Medical Records. The problem arises that to create an electronic medical record system, hospitals must entrust people or institutions who are competent to create a medical record system that can be accessed electronically. What about the confidentiality of the medical record history contained in it, can the third-party company access the electronic medical record system easily? Using normative juridical research methods, the author explores and learns from various sources the rules regarding the legal responsibilities of third parties and hospitals regarding the implementation of Electronic Medical Redord. The conclusion from this research is that in fact third parties are free from legal responsibility if later problems arise such as system leaks from the system that has been built. Please note that the warranty or maintenance period has passed, and the third party's connection cannot be proven.

Abstract

The legal relationship between medical personnel and patients in carrying out their services as health workers often results in incidents where health workers intentionally or unintentionally ignore the patient's rights until a problem or dispute arises. Mediation is a means of alternative dispute resolution outside of court. Medical malpractice is an action carried out by health workers regarding evil practices or not, in the case of failure to fulfill a standard that was initially determined by the profession. Regulations regarding the resolution of medical disputes through mediation are regulated in Article 29 of Law Number 36 of 2009, there are vague norms in it where the article regulates mediation but does not clearly explain what mediation is meant to be, more specifically it does not explain the penal mediation efforts involved. results in implicit in the settings, so it needs to be researched. PP No. 47 of 2021 CHAPTER III Hospital Obligations Article 27 paragraph (1) point r states that "preparing and implementing internal hospital regulations". This means that the law has mandated hospital management to create and establish their own rules regarding resolving disputes if a medical dispute occurs in the future. The method used in this research is a normative juridical research method where this is done by researching library materials or what is often said using secondary data in the form of positive law. The results of this discussion show that hospital management has established an initial mechanism for resolving medical disputes, namely mediation. As an alternative solution to problems in a very good and structured manner.

Abstract

Legal legitimacy of national health services is recognition or approval from the public for the laws governing national health services. This legal legitimacy is important to maintain the stability and continuity of national health services. The right to health is a human right recognized by various international legal instruments, including the Universal Declaration of Human Rights and the International Covenant on Economic, Social and Cultural Rights. The right to health is a fundamental right, because it is a prerequisite for the fulfillment of other human rights. The national health service law in Indonesia mandates that everyone has the right to health. However, in practice, there are still many people who cannot access quality and affordable health services. This is caused by various factors, including limited resources, lack of public awareness about the importance of health, and discrimination against vulnerable groups. Increasing the legal legitimacy of national health services can be done through various efforts, including: a) Disseminating information about the law: The government needs to socialize and educate the public about the laws governing national health services; b) Improving the quality of health services: The government needs to improve the quality of health services, both in terms of availability, affordability and quality; c) Increasing the accessibility of health services: The government needs to increase the accessibility of health services, so that people can easily access the health services they need; and d) Increasing the legal legitimacy of national health services is important for realizing the right to health for all citizens.

Abstract

Considering the risk of infection and spread of disease in the workplace, it is necessary to provide health checks or what is called a medical check-up (MCU) for workers. This research aims firstly to find out how medical check-ups are implemented for workers and, secondly to find out the supporting and inhibiting factors for implementing medical check-ups at the Santika Premiere Dyandra Hotel Medan. This research uses qualitative research, which is descriptive using a theoretical basis to present information according to facts in the field, interview data collection techniques, and documentation. The results of the research show firstly, Hotel Santika Premiere Dyandra Medan has implemented medical check-ups for its workforce but it is still not optimal by Minister of Manpower Regulation 02 of 1980 concerning the Implementation of Occupational Health Checks. Supporting factors for carrying out medical check-ups are government regulations and hotel SOP rules which require workers to carry out medical check-ups, while the inhibiting factor for carrying out medical check-ups at hotels is the high cost of medical check-ups at hospitals/clinics.Key words: Hotels; Occupational health and safety (K3); Medical check-up

Abstract

Penelitian ini bertujuan untuk mengeksplorasi peran dan yurisdiksi mediator kesehatan sebagai fasilitator dalam penyelesaian sengketa medis melalui metode alternatif penyelesaian sengketa (APS). Dengan meningkatnya kasus sengketa medis, pentingnya proses mediasi untuk menawarkan solusi yang efektif, efisien, dan memuaskan bagi kedua belah pihak menjadi sangat signifikan. Penelitian ini juga menyoroti dukungan legislatif untuk mediasi dalam sengketa medis sebagai upaya untuk mengurangi beban pengadilan dan memperkuat hubungan antara pasien dan penyedia layanan kesehatan.Metode yang digunakan dalam penelitian ini meliputi studi literatur dan analisis dokumen terkait yurisdiksi mediator kesehatan dalam undang-undang kesehatan dan peraturan terkait lainnya. Selain itu, penelitian ini juga menggunakan wawancara dengan mediator kesehatan yang berpengalaman serta pihak-pihak yang pernah terlibat dalam mediasi sengketa medis untuk memperoleh perspektif praktis tentang proses dan tantangan mediasiHasil penelitian menunjukkan bahwa mediator kesehatan memiliki peran penting dalam menyelesaikan sengketa medis, dengan berfokus pada pencapaian solusi win-win bagi kedua belah pihak. Regulasi seperti Undang-Undang Nomor 17 Tahun 2023 tentang Kesehatan dan Undang-Undang Nomor 30 Tahun 1999 tentang Arbitrase dan Alternatif Penyelesaian Sengketa memberikan landasan hukum yang kuat untuk praktik mediasi. Namun, penelitian ini juga mengidentifikasi beberapa tantangan, termasuk perbedaan pengetahuan medis antara pasien dan penyedia layanan kesehatan serta masalah kepercayaan terhadap proses mediasi. Berdasarkan hasil penelitian, disarankan untuk meningkatkan pelatihan dan sertifikasi untuk mediator kesehatan, meningkatkan kesadaran publik tentang mediasi sebagai alternatif penyelesaian sengketa, dan memperkuat kerangka hukum yang mendukung mediasi dalam konteks kesehatan. Selain itu, integrasi proses mediasi ke dalam sistem kesehatan secara luas dapat memfasilitasi akses yang lebih mudah bagi pasien dan penyedia layanan kesehatan untuk menggunakan mediasi.

Abstract

Perawatan pasien di Ruang Intensive Care Unit (ICU) memerlukan kolaborasi erat antara dokter dan perawat. Praktik pelimpahan wewenang oleh dokter kepada perawat di ICU Rumah Sakit Pabatu mengungkapkan dinamika kompleks dan tantangan yang ada dalam penerapannya. Kesenjangan profesional dan kurangnya kejelasan regulasi menjadi sorotan utama yang mempengaruhi efektivitas kerja sama tim dalam menyediakan perawatan kesehatan. Studi ini bertujuan untuk menganalisis yuridis pelimpahan wewenang oleh dokter kepada perawat di ICU dan mengidentifikasi kesenjangan serta tantangan yang dihadapi, khususnya dalam konteks hukum dan praktik profesional.Penelitian ini menggunakan pendekatan yuridis-sosiologis, menggabungkan analisis dokumen hukum yang relevan dan wawancara dengan dokter dan perawat di ICU Rumah Sakit Pabatu untuk mengumpulkan data mengenai praktik pelimpahan wewenang. Hasil penelitian menunjukkan adanya ketidakjelasan dalam regulasi yang mengatur pelimpahan wewenang di ICU, yang berpotensi menyebabkan praktik pelimpahan yang tidak konsisten dan menimbulkan risiko hukum bagi dokter dan perawat. Selain itu, ditemukan pula kesenjangan dalam pengakuan profesional dan koordinasi tim yang mempengaruhi kualitas perawatan pasien.Penelitian ini merekomendasikan pengembangan regulasi yang lebih spesifik tentang pelimpahan wewenang, peningkatan pelatihan bersama dokter dan perawat, serta penerapan mekanisme pemantauan untuk memastikan praktik pelimpahan yang aman dan bertanggung jawab. Rekomendasi ini diharapkan dapat meningkatkan kerjasama tim dan kualitas perawatan pasien di ICU.

Abstract

Introduction: This study aims to analyze the Standard Operating Procedure (SOP) for anesthesia, the implementation of anesthesia procedures in the operating room without an anesthetist, and the legal protection for anesthesia practitioners in such cases. This issue highlights the importance of policy implementation and its impact on patient safety and legal accountability. Methods: The research utilized an analytical-qualitative method, which is descriptive in nature and emphasizes analysis. Data were collected through interviews with specialist anesthetists and stylists at Prima Inti Medika Hospital. This approach allowed for an in-depth understanding of the policy implementation and related challenges. Results: The findings reveal that the delegation of authority for anesthesia procedures and communication among related teams are implemented effectively. However, challenges were identified, including issues with policy standards, resource adequacy, and the disposition or attitudes of implementers. These challenges have hindered the optimal implementation of delegation policies, thereby impacting legal protection for anesthesia practitioners. Conclusion: The study emphasizes the critical need for effective policy implementation regarding the delegation of authority in anesthesia services. Hospital management must actively monitor and evaluate the implementation process while ensuring administrative compliance. Supporting the development and competence of health workers, particularly anesthesia administrators, is essential to achieving quality services that prioritize patient and staff safety.

Abstract

Emergency services are stipulated in Law No. 17 of 2023 concerning Health, which stipulates that hospitals may not reject emergency patients for any reason. However, there are still cases of rejection of emergency patients that result in legal consequences for hospitals and health workers. This study aims to analyze the responsibility of hospitals in handling emergency patients based on applicable regulations reviewed from civil, criminal, and administrative law for cases of patient rejection. This study uses a normative juridical method with a statutory approach and relevant concrete cases. The analysis was carried out by referring to the provisions of Law No. 17 of 2023 concerning Health, the Regulation of the Minister of Health, and the Supreme Court Decision Number 68/G/TF/2019/PTUN-SRG and the case of patient rejection at Hermina Hospital Malang on March 11, 2024. The results of the study indicate that patient rejection by hospitals can result in serious legal consequences, including civil lawsuits, criminal sanctions, and administrative sanctions for the responsible parties. Based on these findings, it is necessary to strengthen the monitoring system, increase awareness of health workers, and comply with standard operating procedures to ensure that emergency services run optimally and in accordance with legal provisions.

Abstract

The existence of doctors and nurses or other health professionals in hospitals in the implementation of health services must be able to realize the highest degree of health for the community, integrated and comprehensive health efforts are carried out in the form of individual health efforts and public health efforts. This certainly makes it interesting to discuss the legal position of doctors and nurses as implementers of health services in hospitals, and the legal position of hospitals as places where health services are implemented. This study uses the theory of legal protection so as to obtain results where the legal position of doctors and nurses as implementers of health services and as parties who provide treatment to people who need it, while the legal position of hospitals as a place where health services are implemented or as a place for patients who receive health services which in this case is carried out by medical personnel, specifically doctors and nurses and the position of patients as the party who needs health services, where this relationship is a very personal relationship because it is based on the trust of the patient in the doctor which is called a therapeutic transaction while the nurse in the medical action carried out by the doctor is based on the delegation of authority regulated by law.
