Abstract

This article reveals efforts to overcome sexual violence against women and children in the city of Makassar and the factors that influence efforts to overcome sexual violence against women and children in the city of Makassar. The empirical research method was chosen to describe the legal reality in the community in an area that became the research location. The results of this study indicate that efforts to overcome sexual violence against women and children in the city of Makassar are still not maximized. Efforts to overcome sexual violence against women and children in Makassar City carried out by the PPA Unit of the Sul-Sel Regional Police are in the form of pre-emtif, preventive, and repressive efforts. The factors that influence countermeasures carried out by investigators are external and internal factors which include the lack of quantity and quality of investigators, lack of facilities and infrastructure, lack of operational costs, lack of evidence, and lack of community participation. Abstrak: Artikel ini mengungkapkan upaya penanggulangan kekerasan seksual terhadap perempuan dan anak di kota makassar serta faktor-faktor yang memengaruhi upaya penanggulangan kekerasan seksual terhadap perempuan dan anak di kota makassar. Metode penelitian empiris dipilih untuk mendeskripsikan kenyataan hukum pada masyarakat pada sebuah wilayah yang menjadi lokasi penelitian. Hasil penelitian ini menunjukkan bahwa upaya penanggulangan kekerasan seksual terhadap perempuan dan anak di kota makassar masih kurang maksimal. Upaya penanggulangan kekerasan seksual terhadap perempuan dan anak di Kota makassar yang dilakukan oleh Unit Pelayanan Perempuan dan Anak Kepolisian Daerah Sulawesi Selatan yaitu berupa upaya pre-emtif, preventif, dan upaya represif. Adapun faktor-faktor yang mempengaruhi upaya penanggulangan yang dilakukan oleh penyidik berupa faktor eksternal dan internal yang meliputi kurangnya kuantitas dan kuaitas penyidik, kurangnya sarana dan prasarana, kurangnya biaya operasional, kurangnya alat bukti, serta kurangnya partisipasi masyarakat.

Abstract

This study aims to identify and analyze the factors that cause violent crimes committed by children in Makassar City. This research method uses empirical legal research methods with primary and secondary data. The results of this study indicate, first, that the factors that cause the crime of theft with violence committed by children in Makassar City are caused by three main factors, namely social and environmental factors, instant mindset factors, and family dysfunction. In addition to these main factors, there are supporting factors that influence the occurrence of theft with violence by children in Makassar City, namely the victim factor, especially women who are mostly the targets of the perpetrators. Second, the efforts made by the National Police to prevent the occurrence of criminal acts of theft with violence committed by children in Makassar City have three main efforts, namely pre-emptive efforts, preventive efforts and repressive efforts in preventing the crime of theft by violence. by children. Recommendations or suggestions for this research are in making efforts to prevent theft with violence committed by children in Makassar City, it requires the cooperation of all parties to encourage the creation of peace and suppress the level of violent theft committed by children in Makassar City. . Then the role of law enforcement in providing treatment by imposing criminal sanctions indirectly, or imposing punishment in the form of punishment for children who commit theft with violence must be further enhanced, the punishment given must provide a deterrent effect and raise awareness of the perpetrator to improve his life, so that the perpetrators are punished. later have no intention to repeat or commit the crime.

Abstract

This study aims to analyze the application of the principle lex specialis derogat legi generali through Law Number 23 of 2004 in cases of domestic violence with unofficial marriage status. This study uses a normative legal research method. The collected legal material is then qualitatively analyzed to describe the problem and answer the study objectives. The results show that Law Number 23 of 2004 effectively applies in cases of domestic violence with unofficial marriage status. An unofficial marriage, even though not registered at the Religious Affairs Office, receives recognition and legal protection under Islamic law provisions. Furthermore, the lex specialis derogat legi generali principle ensures that Law Number 23 of 2004 supersedes the Penal Code in handling domestic violence cases. The Gorontalo District Court Decision Number 323/Pid.Sus/2016/PN Gto has also reinforced this validity, which applied Law Number 23 of 2004 in a case of domestic violence with unofficial marriage status. Conversely, applying the Penal Code in cases of domestic violence with unofficial marriage status would contradict the principle of lex specialis derogat legi generali. Therefore, it is recommended that the Police increase awareness and training on the importance of recognizing unofficial marriage status according to Islamic law in the context of applying Law Number 23 of 2004. For the Public Prosecutor, there needs to be a consistent approach in applying Law Number 23 of 2004 as the foundation for prosecution, ensuring that Law Number 23 of 2004 is prioritized over the Penal Code. Meanwhile, for Judges, it is crucial to continue strengthening jurisprudence that supports the supremacy of Law Number 23 of 2004 in cases of domestic violence with unofficial marriage status, as established in the Gorontalo District Court Decision. It will enhance justice and legal protection for victims in future cases of domestic violence.

Abstract

Tujuan penelitian menganalisis efektivitas restoratif justice dalam penyelesaian tindak pidana penganiayaan di Kepolisian Resor Pangkep, dan 2). Untuk mengetahui dan menganalisis faktor yang menghambat restoratif justice dalam penyelesaian tindak pidana penganiayaan di Kepolisian Resor Pangkep. Tipe penelitian ini adalah yuridis empiris. Hasil Penelitian penulis mendapatkan bahwa: 1). Efektivitas restoratif justice dalam penyelesaian tindak pidana penganiayaan di Kepolisian Resor Pangkep, belum berjalan secara efektif dalam penyelesaian tindak pidana penganiayaan. Hal ini dikarenakan kunci dari proses penyelesaian secara mediasi adalah harus didasari adanya kesepakatan oleh para pihak. 2). Pada ketiga faktor tersebut yang paling menghambat adalah pihak pelaku dan korban dikarenakan belum tercapainya syarat materil yang harus dipenuhi untuk dapat mencapai penyelesaian tindak pidana penganiayaan melalui restoratif justice. The research objective is to analyze the efforts to resolve the crime of land grabbing in ParePare City. This type of research is empirical, the results of the author's research found that: 1) Law enforcement efforts against land grabbing in the city of ParePare are less effective, as for efforts that can be made by law enforcers in the city of ParePare through Pre-Emtive Efforts (prevention with understanding the law), Efforts Preventive (Prevention through socialization and counselling) and Repressive Efforts (social control efforts carried out after a violation occurs to restore harmony that was disturbed due to conflict or deviation). As with disputes in other fields, land disputes can be resolved in various ways, including through arbitration, alternative dispute resolution, and judicial bodies. The inhibiting factors in law enforcement against criminal acts of land grabbing are; Economic conditions, lack of legal awareness in society, community habits, and historical factors.

Abstract

The COVID-19 pandemic that shocked Indonesia has resulted in not only a health issue, but also additional problems such as a sudden rise in domestic violence (KDRT). This study aims to analyze the form of legal protection for victims of domestic violence during the COVID-19 pandemic as well as find out the obstacles faced in the process. This study is empirical legal research that uses a statutory approach and a case approach to analyze primary and secondary data. The research activities was carried out in Makassar City, namely at the Women and Children Protection Unit of the Makassar City Police (PPA Polrestabes Unit) and the Makassar City Women and Children Empowerment Integrated Services Unit (UPTPPA). The results of the study show that legal protection for victims of domestic violence that occurred during the COVID-19 Pandemic have been carried out in accordance with existing legal provisions but have not been optimal due to several factors related to restrictions on community activities and strict health protocols. A number of obstacles that affected the legal protection of victims during the pandemic included: 1) The limited number of personnel from the Makassar Polrestabes PPA Unit; 2) limited infrastructure; and 3) restrictions on community activities and strict health protocols.

Abstract

This research aims to analyze the regulation of criminal offenses punishable by the death penalty and compare the formulation of the death penalty between the Penal Code under Law Number 1 of 1946 (Dutch Colonial Penal Code) and Law Number 1 of 2023 concerning the Penal Code (National Penal Code). This study employs a normative legal research method with a statutory approach and a case approach. Legal data were collected through literature studies and analyzed qualitatively. The findings of this research indicate that the regulation of criminal offenses punishable by the death penalty in Indonesia is found in the Penal Code, the Narcotics Law, the Human Rights Law, the Corruption Crime Law, the Human Rights Court Law, and the Law on the Misuse of Firearms and Explosives. Furthermore, a comparison of the death penalty between the Dutch Colonial Penal Code and the National Penal Code of 2023 reveals a shift from the death penalty as a principal punishment to a death sentence with a probationary period and an alternative life imprisonment sentence. The comparison also includes differences in the legal basis, the formulation of the death penalty, the criteria for its application, and the procedures for its execution. This research recommends further studies on severe crimes that have not been explicitly regulated for the application of the death penalty.

Abstract

Purpose: This community service activity aims to improve literacy and digital-based financial recording skills among women entrepreneurs in Padanglampe Village, especially Family Welfare Empowerment (PKK) members who still rely on manual recording. The program is designed to provide ongoing education, introduce relevant digital finance applications, and offer assistance and consultation on their use. Research Design and Methodology: The activities were conducted through presentations on basic accounting materials, training on digital financial recording, demonstrations of the BukuWarung application and similar applications, and interactive discussion sessions. The approach used was socialization, hands-on practice, and participatory mentoring, actively involving partners throughout the entire process. Findings and Discussion: The results of the activity showed an increase in partners' knowledge of digital financial recording concepts and ease of use of smartphone-based financial recording applications. Partners also gained a greater understanding of basic accounting and financial recording, and a greater awareness of the importance of consistent financial recording. The participants' enthusiasm was evident in their active involvement in question-and-answer sessions, discussions, and the practical use of the application. Implications: This activity provides practical benefits for women entrepreneurs, especially in improving the efficiency of digital-based business financial management. The program also opens up opportunities for developing basic accounting consulting services and sustainable digital recording for rural communities.
