Abstract

The inheritance rights  of nasabiyyah  children outside of marriage, religion or the state will not get inheritance because the status of the child  follows his mother, not his father. The serious problem is how to maintain the rights that should be obtained by children born out of wedlock, and whether the development of science and technology is ignored, even though in the rules of a change in a law is dependent on the time, place, and context of the problem. This study uses a comprehensive juridical law method that is comparatively analyzed to present data and facts from the perspective of positive law and Islamic law as well as the role of technology and science. The data is sourced from articles, books, legal rules and other juridical sources. This study concludes that in positive law, especially civil law of inheritance, the status of the child's inheritance rights outside of marriage can be recognized as long as the biological father recognizes the child's destiny as his destiny. As for Islamic civil law, there is no legal leniency for children outside of marriage, if the child is born without a clear status from both parents, then the child follows his mother and not his father. Islam has flexible laws that can adapt to the existing context. From the point of view of Islamic law, there are several ways to determine nasab, one of which is the qiyafah technique. The technique can be qiyas-kan with the reading of the nasab through a DNA test because it has almost the same legal 'illat. With the advancement of technology and the development of science, the method of determining the nasab can also be developed.

Abstract

Pendahuluan: Mahkamah Agung menerbitkan Peraturan Mahkamah Agung (PERMA) No. 7 Tahun 2015 guna meningkatkan profesionalisme dan efektivitas administrasi peradilan, khususnya dalam kepaniteraan pidana. Pengadilan Negeri Banjarmasin sebagai salah satu lembaga peradilan menerapkan regulasi ini untuk meningkatkan transparansi dan akuntabilitas administrasi perkara pidana. Tujuan: Penelitian ini bertujuan untuk menganalisis implementasi PERMA No. 7 Tahun 2015 dalam kepaniteraan muda pidana di Pengadilan Negeri Banjarmasin serta mengidentifikasi kendala dan solusi dalam penerapannya. Metode: Penelitian ini menggunakan metode kualitatif dengan pendekatan deskriptif-analitis dan service learning. Data dikumpulkan melalui observasi langsung, wawancara dengan panitera muda pidana serta studi dokumen terkait regulasi tersebut. Hasil: Hasil penelitian menunjukkan bahwa implementasi PERMA No. 7 Tahun 2015 di PN Banjarmasin telah meningkatkan efisiensi administrasi peradilan melalui sistem E-Berpadu dan SIPP. Simpulan: Namun, kendala seperti gangguan jaringan dan keterbatasan SDM masih menjadi tantangan, seajalan dengan hal tersebut maka diadakannya upaya perbaikan dilakukan dengan menyediakan generator cadangan serta hal lainnya, selain itu, Pengadilan Negeri Banjarmasin juga menyediakan berbagai inovasi pelayanan yang tentu sangat bermanfaat bagi masyarakat.

Abstract

In early 1977, Indonesia faced significant difficulties in its development, triggered by the collapse of the government and the global monetary crisis. Until now, the impact of the economic crisis continues to be felt, especially in industrial life which is filled with losses and layoffs as a company survival strategy. This issue of layoffs, especially when companies go bankrupt, becomes an important focus, involving labor rights which continue to be threatened. The resilience of the power between labor and employment news is revealed in the ongoing recognition of Labor Day, demanding fairer working conditions. Even though there are regulations regarding layoffs, weak law enforcement is a serious obstacle. The era of globalization and industrial growth adds to the complexity of employment problems, especially in Indonesia with a high number of workers and the potential for layoffs. Factors triggering layoffs are very diverse, including globalization, economic transformation, and company bankruptcy. In this context, the Job Creation Law (UU CK) introduced significant changes, but also received criticism. This research focuses on the provisions for layoffs resulting from bankrupt companies in the CK Law, exploring the regulatory basis, legal protection for laid-off workers, and mechanisms for resolving their rights. The research method used is normative legal research, with a detailed explanation of the basis for layoff arrangements, legal protection for workers, and mechanisms for resolving workers’ rights in the context of bankrupt companies. This research aims to provide a comprehensive understanding of the problem of layoffs due to bankrupt companies, analyzing related provisions of the CK Law, and provides an overview of the legal protection provided to workers. It is hoped that the results of this research can contribute to policy development and improvement of labor rights protection in the context of company bankruptcy in Indonesia.
