Abstract

Article 1 number 3 of Law Number 11 of 2012 concerning the Juvenile Criminal Justice System has a weakness in that children under 12 (twelve) years of age are not included in the categorization of children in conflict with the law so they cannot be held criminally responsible and diverted. However, in many cases, children under 12 (twelve) years old can be perpetrators of criminal acts. When viewed from a humanitarian and moral perspective, it is unfair for victims who experience physical, mental suffering and/or economic loss if the perpetrator cannot be held criminally responsible, especially if the victim is also a child. Therefore, legal reform is needed in the categorization of children in conflict with the law. The aim of this research is, first, to determine and analyze the urgency of the idea of ​​categorizing children in conflict with the law, and second, to formulate the idea of ​​categorizing children in conflict with the law in Law Number 11 of 2012 concerning the Juvenile Criminal Justice System. This research is normative legal research or also called doctrinal legal research. Research was carried out on legal theories, namely justice and legal reform, as well as a systematic approach to law. The data sources used are statutory regulations, books, journals, scientific works, dictionaries and official websites. This research also uses qualitative analysis and produces descriptive data. Based on the research conducted, there are 2 (two) conclusions obtained. First, the urgency of the idea of ​​categorizing children in conflict with the law which includes children under 12 (twelve) years of age who have the potential to commit criminal acts due to several factors; and the absence of criminal accountability and diversion causes victims to receive different treatment. Second, the idea of ​​categorizing a child in conflict with the law is someone who is not yet 18 (eighteen) years old who is suspected of committing a criminal act. The suggestion from the results of this research is, first, Article 1 number 3 of the Juvenile Criminal Justice System Law needs to be revised with this idea in mind. Second, there is a need for regulations that clarify the criminal procedural law for children so as not to cause confusion after the revision of the categorization of children in conflict with the law in the Juvenile Criminal Justice System Law so that the rights of children in conflict with the law remain protected, especially children in conflict with the law and the victim.

Abstract

Naumbai Village is a village located in Kampar District, Kampar Regency, Riau Province. Naumbai Village was formed and designated as a preparatory village in 2003. The people of Naumbai Village come from the indigenous Malay tribe, the majority of whom work as farmers. With 1,017 women, Naumbai village is well known for its residents' skills in making various kinds of traditional foods such as galopuong, bomban leaf lopek, sarikayo, and leaf palito. Palito daun is very well known and famous among the people of Kampar, because several years ago it was used as a traditional food icon by the Kampar regional government on the anniversary of the district which is known as the veranda of the Mecca of Riau. A business marketing development strategy can be the key to success or even failure in a company. Determining the right target and which business development strategy should be used to achieve business goals can be a risky decision. When a business has a strong strategy, aligned with business goals, and implemented well, the strategy has the potential to increase growth and high profitability.

Abstract

Permasalahan gelandangan di Kota Pekanbaru merupakan isu sosial yang kompleks dan mendesak. Keberadaan mereka sering mengganggu ketertiban umum, menciptakan ketidaknyamanan bagi warga yang menganggap gelandangan sebagai ancaman. Meningkatnya jumlah gelandangan mencerminkan masalah struktural, seperti kemiskinan dan ketidakadilan. Meskipun regulasi seperti Pasal 505 KUHP dan Peraturan Daerah Kota Pekanbaru telah diterapkan, penegakan hukum terhadap gelandangan masih menghadapi kendala, terutama dalam penerapan sanksi pidana yang seharusnya memberikan efek jera. Penelitian ini menggunakan pendekatan sosiologis dengan metode deskriptif, melibatkan wawancara dengan pihak terkait dan penyebaran kuesioner kepada 154 responden. Hasil penelitian menunjukkan bahwa penerapan sanksi pidana tidak menyelesaikan masalah gelandangan. Sebaliknya, diperlukan pendekatan yang lebih manusiawi dan progresif dalam penegakan hukum. Kerjasama antara pemerintah, lembaga sosial, dan masyarakat sangat penting untuk menciptakan solusi yang inklusif dan berkelanjutan. Rekomendasi penelitian ini adalah meningkatkan kolaborasi antara pemerintah dan lembaga sosial, serta fokus pada hak asasi manusia dan dukungan sosial. Program rehabilitasi jangka panjang juga diperlukan untuk membantu gelandangan kembali ke masyarakat, menciptakan lingkungan yang lebih aman dan sejahtera bagi semua.

Abstract

The purpose of this study is to examine the concept of regulating compensation as an additional criminal penalty for perpetrators of crimes involving protected wildlife in the reform of criminal law in Indonesia. The focus of the issue lies in the addition of criminal penalties, where the orientation of punishment involves both retribution and the rectification of the consequences arising from the crime. The research method used is normative juridical research with a principle-based approach, analyzed descriptively. The results of the study show the importance of adding compensation penalties as an additional punishment for perpetrators of crimes involving protected wildlife, considering that protected wildlife is a national asset with a significant role. This concept is feasible by referring to the application of additional criminal penalties, such as substitute money penalties in corruption cases and criminal penalties for rectifying the impact of environmental crimes. Moreover, the practice of compensation penalties has been implemented in wildlife crime cases in countries like the United States and Canada. The responsibility for compensation is imposed on the convicted individual in accordance with the "polluter pays" principle, where the burden of ecological damage recovery is assigned to the environmental offender. The compensation funds received would then be used directly for corrective actions such as wildlife rehabilitation, as well as preventive measures in the future through conservation efforts.

Abstract

State Administrators' Wealth Report (LHKPN) is an obligation for State Administrators as an effort to prevent the occurrence of Corruption, Collusion and Nepotism (KKN) practices. However, there is a weakness in the regulation of sanctions in the regulations related to LHKPN because there are no criminal sanctions that can be imposed for reporting assets incorrectly. This causes the emergence of criminal acts, namely fraud and falsification in reporting. Therefore, criminal sanctions are needed to threaten State Administrators not to falsify their wealth reporting in the LHKPN. The aim of this research is first to describe the urgency of imposing criminal sanctions on State Administrators who report assets incorrectly. Second, formulate arrangements for criminal sanctions in the future for State Officials who report assets incorrectly The type of research used is normative legal research using library materials as data and reference sources. This research requires secondary data consisting of primary, secondary and tertiary legal materials. The data collection technique used by researchers is literature study. This research uses a qualitative analysis method by interpreting legal materials. In drawing conclusions, researchers use a deductive method, namely drawing conclusions from general statements or propositions to specific statements or propositions. From the results of the discussion and research carried out, it can be concluded that, Firstly, the urgency of imposing criminal sanctions on State Administrators who report assets incorrectly is because Law Number 28 of 1999 only regulates administrative sanctions for those who do not comply with reporting LHKPN, preventing the emergence of criminal acts in LHKPN , as well as creating fear and preventing State Administrators from reporting assets incorrectly. Second, the formula for regulating criminal sanctions against State Officials who report assets incorrectly in the future is criminal sanctions in the form of fines and additional criminal sanctions in the form of confiscation of assets that are not officially reported in the LHKPN.

Abstract

The conditional death penalty, as regulated in Article 100 of Law Number 1 of 2023 concerning the Criminal Code, reflects a shift toward a more humanistic and rehabilitative approach to capital punishment in Indonesia. This policy aims not only to provide convicts with an opportunity for reform but also to minimize the risk of wrongful execution and accommodate divergent public opinions on the death penalty. This study employs normative legal research with a focus on the principle of legal certainty. The analysis explores how the conditional nature of capital punishment aligns with or challenges the principle of legal certainty as a core value in Indonesian legal doctrine. Abstract

Stunting merupakan masalah kesehatan serius yang berdampak multidimensional terhadap pembangunan ekonomi dan sosial, khususnya di negara berkembang. Penelitian ini bertujuan untuk mengulas berbagai kebijakan pencegahan stunting dari perspektif ekonomi, studi pembangunan, dan kebijakan kesehatan. Metode yang digunakan adalah tinjauan pustaka sistematis dengan sumber utama dari basis data Web of Science, menggunakan kata kunci “Stunting Policies” pada artikel yang terbit antara tahun 2004 hingga 2023. Sebanyak 68 artikel yang relevan dianalisis berdasarkan kategori ekonomi, pembangunan, kebijakan kesehatan, hukum, dan ilmu politik. Hasil analisis menunjukkan bahwa kebijakan ekonomi yang efektif seperti peningkatan pendapatan rumah tangga miskin, pendidikan perempuan, ketahanan pangan, serta akses terhadap layanan kesehatan dan sanitasi berperan penting dalam pencegahan stunting. Selain itu, Studi pembangunan menegaskan bahwa pengurangan stunting membutuhkan pendekatan yang menyeluruh dan berkelanjutan dengan fokus pada peningkatan pelayanan publik, pemberdayaan perempuan, pengentasan kemiskinan, serta penguatan infrastruktur di daerah tertinggal. Temuan ini menegaskan bahwa penanggulangan stunting memerlukan kebijakan yang inklusif, lintas sektor, dan berkelanjutan, dengan mempertimbangkan konteks sosial serta ekonomi masyarakat secara menyeluruh.

Abstract

The fundamental aim of criminal law is to shield society from potential victimization, allowing for the prosecution of wrongdoers, including the offenders engaged in negligent acts. This objective leads to a legal dilemma when negligence originates from the victim, sparking a debate within law enforcement about the entity to bear the criminal responsibility. Therefore, this study aimed to explore the juridical feasibility of designating victims as suspects in the same case where the offender has been victimized. Real cases were used in this study, accompanied by secondary data and interviews with crucial policymakers. The findings show that designating victims of negligence in traffic accidents as a suspect should not be pursued. Consequently, the investigation process should be suspended when the victim is found to be responsible for the accident, as the incident does not meet the criteria for a criminal act.

Abstract

Conditional death penalty aims to provide an opportunity for convicts to rehabilitate themselves and change for the better. Conditional death penalty also aims to reduce the risk of execution of innocent people, show a humanist attitude and respect for human rights, and accommodate various conflicting views and interests regarding the death penalty in Indonesia. Conditional death penalty is regulated in Article 100 Paragraph of Law Number 1 of 2023 concerning the Criminal Code. The type of research to be carried out is normative legal research. From the perspective of its objectives, normative legal research can be divided into 7 (seven) types, namely in this case research is carried out on the principles of law, namely regarding the Implementation of Conditional Death Penalty in Law Number 1 of 2023 concerning the Criminal Code in the Perspective of Legal Certainty.

Abstract

This study aims to examine the policy of criminalizing sexual intercourse with corpses within the framework of Indonesian criminal law. The primary focus lies in comparing the old Criminal Code, which did not explicitly regulate such acts (only through Article 181 on mistreatment of corpses), with the new Criminal Code, which explicitly criminalizes the act under Article 271. Employing a normative juridical approach, this research is analyzed using the principles of legality, the theory of culpability, and supported by non-legal theories such as morality, legal sociology, and forensic psychology to strengthen the rationale for criminalization. The findings demonstrate that penalizing sexual acts with corpses is legally justifiable, both from the perspective of substantive and procedural criminal law, as it reflects the protection of human dignity even after death. This study also identifies several challenges in the implementation, including low public awareness and evidentiary difficulties, and proposes enhancing legal education and inter-agency collaboration as potential solutions. The research contributes to the development of a more humanistic and responsive Indonesian criminal law in addressing contemporary crimes.
