Abstract

The rapid evolution of technology has significantly impacted commerce, transforming traditional buyer-seller interactions. New payment systems, notably Cash on Delivery (COD), have emerged, where buyers either prepay or settle upon delivery. However, COD has faced challenges, with some buyers exploiting loopholes by rejecting deliveries for various reasons. This study employs a juridical normative approach to investigate legal safeguards for sellers against unilateral cancellations within the COD system. Analyzing the ordering process and relevant regulations, the research asserts that issues in online purchases, including COD, arise only when either party breaches the agreement. A product return feature addresses discrepancies in received goods. The legal foundation for sellers' protection lies in Article 1243 of the Civil Code, reinforced by Articles 1320, 1338, 1313, and 1458. This framework provides certainty for businesses engaged in online transactions with COD, securing rights and obligations for both parties. The research emphasizes the importance of these legal measures to mitigate financial losses resulting from unjustified cancellations, ensuring a fair and regulated environment for online commerce.

Abstract

In the Professional Standards for Curators and Administrators issued by the Association of Curators and Administrators of Indonesia (AKPI), a curator is defined as an individual or civil association that possesses the special expertise required to manage and settle bankrupt assets and that has been registered with the Ministry of Justice and Human Rights, as outlined in Articles 69 and 70 of the Bankruptcy Law and its implementing regulations. In this study, the author employs a qualitative descriptive research methodology. The results of this study are to find out what the process and mechanism for the implementation of the distribution of proceeds from the bankruptcy estate by the curator to each creditor against a decision that has permanent legal force (inkracht) and then also discusses the legal protection for creditors against the implementation of the distribution of settlement proceeds. bankrupt assets by the curator if there are objections to the value of the distribution.Keywords: Curator; Creditors; Bankruptcy Assets  Abstrak Dalam Standar Profesi Kurator dan Pengurus yang diterbitkan oleh Asosiasi Kurator dan Pengurus Indonesia (AKPI) dijelaskan kurator adalah perseorangan atau persekutuan perdata yang memiliki keahlian khusus sebagaimana diperlukan untuk mengurus dan membereskan harta pailit dan telah terdaftar pada Departemen Kehakiman dan Hak Asasi Manusia, sebagaimana dimaksud dalam Pasal 69 dan 70 Undang-Undang Kepailitan dan peraturan pelaksanaannya. Hasil penelitian ini adalah untuk mengetahui bahwa seperti apa proses dan mekanisme pelaksanaan pembagian hasil pemberesan harta pailit oleh kurator kepada masing-masing kreditor terhadap putusan yang sudah berkekuatan hukum tetap (inkracht) dan kemudian juga membahas mengenai perlindungan hukum bagi para kreditur terhadap pelaksanaan pembagian hasil pemberesan harta pailit oleh kurator jika terjadi keberatan-keberatan atas nilai pembagian tersebut.Kata Kunci: Kurator; Kreditor; Harta Pailiti

Abstract

In the digital era marked by rapid advancements in information and communication technology, e-commerce transactions have become increasingly common, transforming traditional trading methods. This article discusses consumer legal protection in e-commerce transactions from the perspective of the Consumer Protection Act in Indonesia. Although e-commerce offers convenience and efficiency, consumers often face risks such as product discrepancies, delivery delays, and payment security issues. This research employs a normative juridical method with secondary data collection through literature studies. The findings indicate that despite laws designed to protect consumers, suboptimal implementation and a lack of consumer awareness about their rights exacerbate the situation. Effective legal protection requires collective efforts from the government, businesses, and consumers to enhance awareness and compliance with existing regulations.

Abstract

The research will discuss the execution of industrial relations court decisions with permanent legal force, aiming to reveal and analyze how the process of implementing industrial relations court decisions with permanent legal force and what factors hinder the execution of industrial relations court decisions with permanent legal force. This is a literature study using normative legal research. The data collected by library research, namely by the study of written information about the law that comes from various sources and is widely published and is needed in normative legal research. The findings highlight that the procedure for the execution of industrial relations court decisions that have permanent legal force has not been explicitly regulated in Law Number 2 of 2004 concerning Industrial Relations Dispute Settlement. However, Industrial Relations Dispute Settlement confirms that the Industrial Relations Court applies procedural law applicable to civil procedural law within the General Courts as stated in Article 57 of Industrial Relations Dispute Settlement. The lack of good faith on the part of the losing party to voluntarily carry out their obligations as stated in the verdict is one of the factors impeding the execution of the Industrial Relations Court's decision, which has permanent legal force. In addition, it is difficult for the winning party, in this case the workers, to determine which company assets can be executed against the losing party, and the execution cost is too high for the court to issue an execution order.

Abstract

In the context of rapid technological development, digital space presents significant challenges in law enforcement, especially in relation to the crime of sexual violence. Law No. 12 of 2022 on Criminal Acts of Sexual Violence provides a firm legal framework to address the problem, but is still faced with various obstacles, such as the complexity of the vast digital space, difficult identification of perpetrators, and lack of public legal awareness. Collaboration between the government, legal institutions, the technology sector, and the community is key to strengthening the prevention and handling of sexual violence cases in the digital space. Advanced forensic technology and training of skilled human resources are needed to support effective law enforcement. In addition, the integration of legal education and digital literacy programs can strengthen public understanding of the legal rights of victims and collective responsibility in maintaining digital security. This collective effort is expected to create a safe and inclusive ecosystem, and ensure better access to justice for all victims of sexual violence in the digital space.

Abstract

The research aims to analyze the legal consequences of creditors for failure to submit mortgage guarantee certificates that have been paid off which are analyzed using collateral law theory. The research method uses normative juridical with a statutory approach, conceptual approach, analytical approach, and case approach. The technique for collecting legal materials is carried out by identifying and inventorying positive legal rules, book literature, journals and other sources of legal materials. The analysis technique for legal materials is carried out using grammatical and systematic legal interpretation, as well as the analogous legal construction method. The research results concluded that the legal consequences of a creditor's default in submitting a KPR guarantee certificate that has been paid off violates Article 1238 of the Civil Code and can harm the debtor. The debtor has the right to demand that the bank immediately submit the certificate and, if this is not fulfilled, can sue through legal channels, either through a lawsuit for breach of contract (Article 1243 of the Civil Code) or an unlawful act (Article 1365 of the Civil Code). If the debtor experiences losses due to delays in submitting the certificate, the bank may be required to pay compensation

Abstract

This study aims to examine the debate on Islamic family law regarding same-sex marriage in the context of human rights. In Islamic law, same-sex marriage is considered contrary to religious teachings, while human rights emphasize the principles of equality and non-discrimination. The conflict between religious norms and human rights demands is a major challenge, especially in countries with Islamic-based laws, including Indonesia. The research method used is a literature review by examining academic and legal sources. Data sources include the Qur'an, Hadith, fiqh books, and laws and regulations related to marriage in Indonesia. Secondary sources include academic books, scientific journals, and international legal documents related to human rights. Data were collected through literature studies from various academic databases and official legal sources. The results of the study show that Islamic family law still maintains the view that marriage is only valid between a man and a woman. Meanwhile, the human rights movement demands equality for the LGBT community. Countries with Islamic law, including Indonesia, still reject same-sex marriage despite global pressure. Therefore, a dialogue-based approach is needed to balance individual rights, religious values, and social harmony. Further studies are needed to formulate inclusive and fair solutions to this issue

Abstract

Kepailitan pada Badan Usaha Milik Negara (BUMN) PT. Merpati Nusantara Airlines merupakan fenomena yang mencerminkan tantangan serius dalam manajemen perusahaan milik negara. Artikel ini menyelidiki penyebab dan dampak kebangkrutan perusahaan penerbangan nasional tersebut. Kepailitan Merpati Nusantara Airlines dipicu oleh berbagai faktor, termasuk masalah manajemen, utang yang tinggi, dan persaingan ketat di industri penerbangan. Akibatnya, perusahaan ini mengalami kesulitan finansial yang parah hingga akhirnya dinyatakan pailit. Kepailitan Merpati Nusantara Airlines berdampak pada ratusan karyawan yang kehilangan pekerjaan, serta menimbulkan kerugian besar bagi pemerintah sebagai pemegang saham mayoritas. Artikel ini juga mengevaluasi langkah-langkah yang dapat diambil oleh pemerintah untuk menghindari kebangkrutan BUMN lainnya dan menjaga keberlanjutan perusahaan negara dalam industri penerbangan. Dengan memahami kasus ini, kita dapat belajar dari kesalahan masa lalu untuk memperkuat manajemen dan keberlanjutan BUMN di masa depan.

Abstract

Artikel ini bertujuan untuk mengkaji urgensi perubahan frasa “tidak wajib dibuktikan terlebih dahulu tindak pidana asal” dalam Pasal 69 Undang-Undang Tindak Pidana Pencucian Uang (UU TPPU), dikaitkan dengan perlindungan hak asasi tersangka dan/atau terdakwa. Metode penelitian yang digunakan adalah yuridis normatif dengan pendekatan perundang-undangan, konseptual, dan kasus. Hasil penelitian menunjukkan bahwa frasa tersebut berpotensi menimbulkan ketidakpastian hukum dan bertentangan dengan asas praduga tak bersalah, karena beban pembuktian dibalikkan kepada terdakwa tanpa kejelasan tindak pidana asal. Kesimpulan dari penelitian ini adalah pentingnya reformulasi pasal tersebut agar sejalan dengan prinsip keadilan, kepastian hukum, dan perlindungan hak asasi manusia dalam proses peradilan pidana.

Abstract

The guarantee of product halal has a very important role in various aspects, especially for Muslim consumers. In Indonesia, the authority related to halal product assurance has indeed been regulated and guaranteed in various laws and regulations. This research focuses on the analysis of the comparison of halal product guarantee laws in Indonesia and Malaysia using an analytical framework with responsive legal theory. This research is a normative legal study with a conceptual, legislative, and comparative approach. The research results emphasize that the main difference in halal certification regulations is that in Indonesia, the important roles of BPJPH and MUI are highlighted, whereas in Malaysia, it is accommodated within a single institution, namely JAKIM. The implementation of halal certification in Malaysia is simpler because everything is regulated by a single body, whereas in Indonesia, halal certification is carried out by several institutions such as BPJPH, LPH, and MUI. From the perspective of responsive law theory, halal product assurance can be considered more responsive because it has involved the role of state governments in halal certification policies for micro, small, and medium enterprises, whereas in Indonesia, local governments have not yet been optimally involved in halal certification policies for micro, small, and medium enterprises. This research recommends that local governments in Indonesia should be involved in formulating regulations and policies to successfully implement halal product guarantees in Indonesia
