Abstract

In this study, the specific case related to the implementation of restitution in a child sexual abuse case is addressed in Decision Number: 114/Pid.Sus/2023/PN Kot Agung, which has become final and legally binding (Inkracht). The judge did not fully grant the restitution request submitted by the child victim of sexual abuse in the decision. The theories utilized in this research are the Theory of Judicial Consideration and the Theory of Legal Utility.. This research is normative or doctrinal legal research. The approach methods used in this study are analytical, statutory, and case approaches. The types and sources of legal materials utilized involve literature review, collecting secondary data consisting of primary legal materials, secondary legal materials, and tertiary legal materials. The data analysis in this legal research employs qualitative data analysis. The research findings indicate that the judge's consideration in decisions regarding restitution requests submitted by victims of sexual abuse, through the public prosecutor's indictment in Decision Number 114/Pid.Sus/2023/PN Kot Agung, is based on a thorough evaluation of the evidence presented, the condition of the victim, and the offender's ability to pay restitution. Besides justice in judicial considerations, the principle of legal utility in the judge's assessment of restitution plays a crucial role in ensuring that legal decisions are not only fair but also practically beneficial to the victim. Furthermore, the ideal concept for implementing restitution as a means of fulfilling rights and providing benefits for child victims of sexual abuse should include several essential elements: comprehensive and clear regulations, consistent law enforcement, easy access for victims, transparency and accountability, and prevention and rehabilitation. This ideal concept aims to offer better protection and justice for crime victims and ensure that offenders are held accountable for the impact of their actions

Abstract

The rapid evolution of technology has significantly impacted commerce, transforming traditional buyer-seller interactions. New payment systems, notably Cash on Delivery (COD), have emerged, where buyers either prepay or settle upon delivery. However, COD has faced challenges, with some buyers exploiting loopholes by rejecting deliveries for various reasons. This study employs a juridical normative approach to investigate legal safeguards for sellers against unilateral cancellations within the COD system. Analyzing the ordering process and relevant regulations, the research asserts that issues in online purchases, including COD, arise only when either party breaches the agreement. A product return feature addresses discrepancies in received goods. The legal foundation for sellers' protection lies in Article 1243 of the Civil Code, reinforced by Articles 1320, 1338, 1313, and 1458. This framework provides certainty for businesses engaged in online transactions with COD, securing rights and obligations for both parties. The research emphasizes the importance of these legal measures to mitigate financial losses resulting from unjustified cancellations, ensuring a fair and regulated environment for online commerce.

In this research, the research addresses two problems, namely: What is the mechanism for using priority rights in the process of extending Building Use Rights (HGB) on Land Management Rights (HPL)? And what is the legal protection for Building Use Rights (HGB) holders if there is a refusal to extend the HGB located on land with Land Management Rights (HPL) status? And uses two theories, namely the land registration theory from Boedi Harsono and legal protection from Satjipto Rahardjo. The method used in this research is normative juridical research specifically a library law research or secondary adata with primary, secondary and tertiary legal sources. As for the research approach used the legislative approach, the conceptual approach and the case approach and the method of collecting the legal materials are carried out by identifying and taking an inventory of positive law, journals and other legalsources. The method used in analyzing materials grammatical interpretation and systematic interpretation are carried out as well as analogical legal construction and Argumnentum A Contrario. For the research results can be obtained the importance of Priority Rights in the context of extending Building Use Rights (HGB) on Land Management Rights (HPL). Priority Rights provide former HGB holders with the opportunity to apply for an extension after their rights expire, with certain conditions stipulated in PP No. 18 of 2021 and ATR/BPN Ministerial Regulation No. 18 of 2021. The extension process includes submitting an application, fulfilling seven requirements, assessment and decision by the authorities, and issuing an extension if approved. Apart from that, HGB holders have two legal protection mechanisms, namely preventive through an agreement stating priority rights, and repressive by filing a lawsuit in court if the application is rejected.

Abstract

The restorative justice approach has increasingly developed as an alternative mechanism for resolving criminal cases by emphasizing the restoration of relationships between offenders, victims, and the community. Nevertheless, the implementation of restorative justice must continue to ensure the protection of offenders’ legal rights, particularly the right to legal counsel. The primary issue addressed in this study concerns how to guarantee that restorative processes, which are inherently dialogical and consensual, remain fair, voluntary, and consistent with the principle of legal protection for offenders as subjects of law with rights and obligations. This research employs a normative legal research method, utilizing statutory and conceptual approaches. The legal materials consist of primary legal sources in the form of laws and policies related to restorative justice, as well as secondary legal sources including books, academic journals, and legal doctrines. Legal materials were collected through library research and analyzed qualitatively using deductive reasoning to examine the role and position of legal counsel within the restorative justice process. The findings of this research indicate that the regulation of restorative justice in the settlement of theft offenses in Indonesia is not contained within a single, unified legal instrument, but is instead dispersed across various complementary statutory and regulatory frameworks, including the objectives of sentencing as stipulated in Article 51 of Law Number 1 of 2023 on the Criminal Code, the provisions of the Criminal Procedure Code, the Law on the Indonesian National Police, Regulation of the Indonesian National Police Number 8 of 2021, and Supreme Court Circular Letter Number 4 of 2014, which collectively and normatively emphasize an orientation toward restoration, conflict resolution, and substantive justice. In practice, restorative justice has been implemented by law enforcement authorities, particularly at the investigation stage through penal mediation mechanisms, involving dialogue between offenders and victims to achieve amicable settlements, restitution of losses, and the affirmation of offender responsibility, especially in cases of minor theft; however, its application remains subject to specific criteria, thereby positioning restorative justice as a complementary mechanism rather than a substitute for the formal criminal justice system

Abstract

The practice of bankruptcy in Indonesia shows that separatist creditors as holders of material security rights on collateral objects registered at the Land Office normatively have a preferred position to execute their guarantees, but in reality the implementation of these rights is often hampered by third party objections through the renvoi procedure mechanism which causes legal uncertainty and delays in execution. Meanwhile, the bankruptcy law system and material security law require certainty, protection, and effectiveness in fulfilling the rights of separatist creditors according to the droit de préférence and droit de suite principles for objects that have been legally registered. The inconsistency between the factual conditions and the normative construction has caused the not optimal regulation and practice of the renvoi settlement procedure for the denial of registered collateral objects, especially related to the limitation of evidence, the protection of land registration certainty, and the guarantee of the certainty of dispute resolution time, so that an in-depth analysis of the form and effectiveness. This research uses normative legal methods with statutory, conceptual, and case approaches. Secondary data consists of primary legal materials such as legislation and court decisions, secondary legal materials including books and scientific journals, and tertiary legal materials. Data collection through library research and analyzed qualitatively using systematic interpretation. The results showed that separatist creditors on collateral belonging to third parties remain as preferred creditors based on the droit de suite principle (Article 7 UUHT), so that the curator's denial that lowers its status to concurrent juridically eliminates the right of independent execution and voting rights guaranteed by law. In this case, the Renvoi procedure becomes a legal protection instrument to correct the curator's actions through proving the validity of the mortgage certificate, as confirmed in Supreme Court Decision No. 689 K / 2012, so that this mechanism serves to restore the material rights of separatist creditors and prevent the unfair distribution of bankruptcy bonds.

Abstract

The development of information technology and digitalization has encouraged the emergence of Online Dispute Resolution (ODR) as an alternative dispute resolution that is more efficient and adaptive to the dynamics of electronic transactions. ODR, supported by Law No. 11/2008 on Electronic Information and Transactions (ITE Law) and its amendments, offers a faster and more affordable solution than traditional mechanisms such as litigation or arbitration. However, the implementation of ODR in Indonesia still faces significant challenges, including the lack of clear regulations regarding the recognition and execution of judgments, as well as the protection of personal data. The ITE Law provides a legal foundation for electronic transactions, but further adjustments are needed to ensure ODR can be legally recognized and accounted for, especially in the context of cross-border disputes. In addition, aspects of transparency, accountability, and data security must be prioritized in the implementation of ODR. This research uses a normative juridical method to analyze the application of ODR in the Indonesian civil law system, assess the suitability of existing regulations, and identify challenges and opportunities faced. Comprehensive regulatory harmonization is needed to ensure ODR can function effectively, fairly, and safely for all parties, and become an integral part of a more modern and relevant Indonesian legal system in the digital era.
