Abstract

This article seeks to discuss the issue of inheritance in Indonesia and the solution offered through studying the Quranic verses of inheritance according to Abdullah Saeed. Saeed’s methodological approach is used as a tool of analysis to reconstruct the law of inheritance in Indonesia. On the one hand, Saeed’s theory of ‘value hierarchy’ is formulated in order to maintain the principle of Islam’s universality. On the other hand, this theory is applied in order for Islam to be valid for every time and place (sâlih li kull zamân wa makân). Saeed’s theory of ‘value hierarchy’ consists of among others obligatory values, fundamental values, protectional values, implementational values, and instructional values. Based on Saeed’s theory of value hierarchy, the division of inheritance based of customary law (adat) called dumdum kupat (the portion of inheritance for son and that for daughter is the same) is valid and can be applied.

Abstract

Penelitian ini mencoba menemukan kembali ayat-ayat yang membangun Hukum Keluarga dan peristiwa yang menjadi latar belakang turunnya, lalu memahaminya dalam bingkai maqāșid dengan pendekatan gender. Ayat-ayat tersebut dapat diklasifikasi dalam 3 bidang antara lain; (a) ayat-ayat hukum keluarga (usrah) yang dimulai dari peminangan sampai perpisahan, baik karena ada yang wafat maupun karena terjadi perceraian, (b) ayat-ayat hukum perwalian terhadap anak yang belum dewasa; (c) ayat-ayat hukum kekayaan keluarga (amwāl al-usrah) yang mencakup waris, wasiyat, wakaf dan sejenisnya yang berkaitan dengan penerimaan dan atau pemberian. Penafsiran terhadap ayat-ayat tersebut menggunakan perspektif maqāșid dengan pendekatan gender berpijak dari QS.al-Rūm (30): 21; bahwa aturan perkawinan bertujuan membangun keluarga yang sakīnah (harmonis), yang melahirkan hubungan saling cinta diantara suami, istri, dan kasih sayang diantara anak-anak mereka. Keharmonisan tersebut terbangun melalui hubungan antara suami, isteri, dan anak yang mampu memenuhi hak dan kewajiban masing-masing dengan penuh cinta dan kasih sayang. Masing-masing memiliki kemampuan mengontrol hak dan kewajiban tersebut secara bebas dan proporsional.

Abstract

This research focuses on rediscovering the verses about the establishment of the family law and the events or the reason of the revelation of the verses. It is then analyzed within the frame of maqāşid and gender approach. The verses can be classified into 3 areas, among others; (a) family law verses starting from marriage to separation either due to death or divorce, (b) the guardianship law verses of the immature child; (c) verses of family wealth law (amwāl al-usrah) which includes inheritance, wasiyat, endowment and everything related to acceptance and or giving. The usage of maqāşid and gender perspectives are based on chapter al-Rūm (30): 21; that marriage rules are aimed to building a harmonious family, which spawns a loving relationship between husband and wife, and compassion among their children. The harmony is awakened through close relationship among husband, wife, and children who are able to fulfill their rights and obligations of each with full of love and affection. Each has the ability to control such rights and obligations freely and proportionately.

Abstract

Islamic law is deduced from the Qur’anic verses and the practices of the prophet Muhammad SAAS, during his period in Mecca as well as in Medina. Laws and rules scattered in the Qur’an is those for all humanity regardless their religious conviction. Thus, when the Prophet was successful in establishing an Islamic state in Media, the Qur’an relentlessly stressed the inclusiveness of its law and regulation to whoever needs it, be he or she a Muslim or otherwise. This inclusiveness is also shown on those verses from Mecca as well as Medina period about commercial transactions and business activities. Those rules and laws are not intended only for Muslims but for whoever parties involve in such activities. Therefore, those rules are open for any party willing to uphold principles of justice, mutual guarantee, and benefit. This inclusiveness of rules and law of business in the Qur’an and their implementation are the main focus of this article.

Abstract

The Quran contains verses and letters that are systematically and coherently structured, as supported by al-Zarkashi and al-Suyuti. But Richard Bell took a different view. For example, according to him, the letter Al-Hijr needed to be more systematic, and there were some errors in laying verses. Meanwhile, Michel Cuypers is serious about the Semitic Rhetorical Analysis (SRA) approach in analyzing the structure of the Qur'anic text to find a concentric, mirror, and parallel symmetrical patterns in the form of the Qur'anic text. Even this approach is Considered a modern methodology with a new type of dialogue. It is interesting to look for bright spots in the structure of surat al-Hijr from the perspective of SRA. So that raises the question of what is the form of the text of surat al-Hijr from the standpoint of SRA. A Semitic Rhetorical Analysis (SRA) approach is used to answer this question. That is by analyzing the pairing pattern of the text of surat al-Hijr so that it forms groups of text at the bottom level. The bottom level has reanalyzed the design to get groups of text at the level above it, and so on, until the top level is obtained, namely surat al-Hijr. This article concludes that SRA, according to surat al-Hijr, is a Book consisting of 13 Sections arranged in a concentric symmetrical pattern (A-B-C-B*-A*). Richard Bell's opinion is refuted because each verse in surah al-Hijr is capable of symmetry with other poems from the lowest level of the text to the top level, so this conclusion indicates that surat al-Hijr is systematically and Coherently arranged.

Abstract

During the Covid-19 pandemic, the family cluster was among the clusters that caused the spread of this virus. For families exposed to this virus, their family's resilience has been tested. This article discusses the resilience of families exposed to Covid-19 to be analyzed in maqasid al-shari’ah. The method used in this research is qualitative and field research. Data were collected through observation, interviews, and documentation. The collected data were analyzed as normative-descriptive. This study concluded that families exposed to Covid-19 work together to fight this virus by adjusting their respective conditions. For the mild, they self-isolate at home, and those with severe illnesses are hospitalized. If a family dies from Covid-19, the family left behind is isolated. What the family exposed to Covid does is maintain family resilience and maintain the physical and psychic health of the family. From the perspective of maqasid al-shari'ah, the effort corresponds to the concepts of hifz al-din (guarding religion), hifz al-nasl (guarding offspring), hifz al-nafs (guarding the soul), and hifz al-'aql (guarding reason).

Abstract

With this research, it can be known whether or not BRI Syariah Bank is healthy through the application of the RGEC method from 2016 to 2020. In carrying out an analysis of the health of BRI Syariah banks, the author uses technical analysis of the data through the application of the RGEC method. This research uses a descriptive quantitative approach that uses the RGEC method or steps through 4 analysis components consisting of Risk Profile, GCG, Earnings, and Capital. Where the ratios contained in each component of the analysis are contained in a financial report. This study resulted in a conclusion that the soundness of BRI Syariah banks in 2016-2020 that applied the RGEC method assessed through four analysis components and eight ratios consisting of NPF, FDR, PDN, ROA, ROE, NI, BOPO, and CAR obtained a healthy rating.

Abstract

As a hidden crime, violence against wives is considered a disgrace to be discussed in public, especially reported to state and non-state actors. At first, victims feel able to resolve violence without outside intervention from outside their household, but repetition after repetition of violence requires them to choose what kind of resolution is right for them. This choice should be made after they have the support of individuals in their social environment. This study aims to explore the knowledge and experience of victims of violence against wives in choosing one among legal norms favorable to them. This study uses a critical realist approach by collecting qualitative data with dialogue techniques and observations of three women who were victims and six people who provided support to victims. We conclude that victims experience a dynamic psychological state, where initially, they always try to maintain the integrity of their household. The dominance of men and the subordination of women as a reality of cultural norms are essential factors in choosing ways of resolving conflicts at the community level, and we consider that the community has succeeded in providing social support to victims so that victims feel they get help and defense. However, we hope that this social support can be carried out through structured, systematic, and massive protection of victims of violence from State and non-state actors while considering the cultural norms of the community and supporting the identification of violence.

Abstract

Hazairin is a leading figure in legal reform in Indonesia and is famous as the pioneer of the idea of Indonesian madhhab. This paper examines Hazairin's interpretation of the Qur’an issued to bilateral and mawāly theories in the inheritance system in Indonesia and the implications of his interpretation. This study uses a hermeneutic approach to interpreting the Qur'an, which looks at how Hazairin reads and provides interpretations of inheritance law verses in the context of inheritance in Indonesia. The results showed that Hazairin interprets the inheritance verses differently as he tries to present these verses by considering local values. Hazairin's interpretation of the Qur'an Surah al-Nisa (4): 7 has found the bilateral system, which is adopted in article 174 of the Compilation of Islamic Law (KHI), and his interpretation of the Qur'an Surah al-Nisa (4): 33 has found the new concept of mawāly system and is adopted the Compilation of Islamic Law Article 185. For this reason, this study argues that the interpretation by referring to prevailing local values as carried out by Hazairin can provide a strong foundation, but it should always refer to the source of Islamic law.
