Abstract

This study will examine and analyze the legal consequences for LDMO disclosing the personal data of transacting parties. In addition, this study also aims to determine the legal protection for parties who suffer losses due to violations committed by the LDMO. This study uses a normative juridical method. The collection of primary, secondary, and tertiary legal materials is carried out using literature study techniques. The collected legal material is then analyzed using qualitative data analysis methods with a statute approach. The results show that LDMO will get a sanction of dishonorable dismissal, payment of compensation, imprisonment for a maximum of four years, and or a fine for a maximum of four billion rupiahs. In this case, if the LDMO is legally and convincingly proven to have violated the oath of office and caused loss to several parties by disclosure of personal data. At the same time, forming the LDMO Guiders and Supervisors Council is a form of legal protection for all parties who commit legal acts before LDMO. In this case, any party that suffers a loss can complain about the alleged violation committed by LDMO to the Guiders and Supervisors Council. In addition, any party that suffers a loss also gets compensation from LDMO as regulated in laws and regulations. Therefore, it is recommended that LDMO uphold the oath of office as a moral code regulated in the Code of Ethics and Head of the NLA Regulation. In this case, to maintain their profession’s dignity and public trust in their noble role (officium nobile).

Abstract

Arbitration is a dispute resolution institution that uses an adversarial approach with the result that win lose chosen as an alternative by business people. Alternative dispute resolution that is currently in demand is through arbitration because it is in line with the increase in commercial transactions in the business sector both nationally and internationally. Dispute resolution through arbitration provides benefits for the disputing parties. These advantages include the confidentiality of the disputing parties, relatively cheaper costs, a fast, efficient dispute resolution process and provide flexibility for the disputing parties. International arbitration dispute resolution has a uniqueness which adheres to the principle of final and binding (last resort and binding). An international arbitral award that has been decided abroad if it is brought to Indonesia, there are two possibilities, i.e. the International arbitral award asks to be enforced or annulled. Based on the dispute between PT. Pertamina against Karaha Bodas Company that Pertamina cannot cancel the arbitration award that has been handed down by the Swiss Arbitration Board. The reasons for rejection and cancellation are as stated in the New York Convention and the UNCITRAL Model Law.

Abstract

Perjanjian, esensinya adalah kesepakatan, disifati dengan bertemunya kehendak (meeting of mind, mutual assent ) para pihak untuk mencapai suatu tujuan yang telah disepakati guna memberikan kemanfaatan semaksimal mungkin bagi para pihak. Perjanjian layaknya sebuah dokumen hukum sudah sepantasnya memenuhi minimal tiga unsur sebagaimana dikatakan oleh Gustav Radbruch, yakni keadilan, kemanfaatan dan kepastian hukum, akan tetapi faktanya aspek kepastian hukum (dhi asas Pacta Sunservanda) paling menonjol bahkan kadang mengabaikan keadilan.Tulisan ini bertujuan untuk mengungkap mengapa hal tersebut terjadi, apa sebabnya dan bagaiamana solusinya.Pendekatan penelitian normatif filosofis digunakan untuk menganalisis dokumen kontrak mengacu pada peraturan yang terkait dan asas asas perjanjian. Sebagai kesimpulan tidak tercapainya keadilan bagi para pihak khususnya penerima waralaba, dikarenakan posisi tawar pemberi waralaba (franchisor) yang sangat kuat,  tidak seimbang jika dibandingkan dengan posisi tawar penerima waralaba (franchisee) yang lemah. Hal ini berimbas pada isi kontrak yang sepenuhnya dibuat oleh pemberi waralaba (franchisor), yang tentunya cenderung memberikan manfaat sebesarbesarnya bagi pemberi waralaba (franchisor).

Abstract

Land dispute cases often occur in the community, one of which is the issuance of double land certificates, namely a state where a piece of land has been registered into two or more certificates by BPN Jambi, one of which occurred in the case in decision No. 88 / Pdt.G / 2021 / PN Jember. The research was conducted to determine and analyze the defendant's liability for unlawful acts against the use of double-certified land. The research was conducted using normative and doctrinal juridical methods with descriptive analysis. The results showed that the issuance of multiple land certificates caused losses to overlapping rights to a land so that it became a loss of certainty of the rights and freedoms of one of the aggrieved parties to exercise control and to all control over the land that actually belonged to him. For such losses, then in accordance with Article 1365 of the Civil Code, ordered the defendant to return all double certificates to the Jambi City Land Agency and return the land owned by the plaintiff by legally purchasing the land owned by the plaintiff.

Abstract

The aim of this research is to implement the principle of freedom of contract in the practice of making a design work agreement. The research method used in writing this law is a normative juridical approach. The normative juridical approach is research that uses secondary data sources/data obtained through library materials. The results showed that the process of the design work agreement between the Architecture and the Service User was in accordance with the formulation of Article 1320 of the Civil Code. Then related to the implementation of the principle of freedom of contract in the work agreement design work based on Article 1338 paragraph (1) of the Civil Code, that all agreements made legally and valid as law for those who make them. Keywords: Freedom of Contract, Employment Agreement, Design Abstrak Penelitian bertujuan untuk Implementasi Asas Kebebasan Berkontrak Dalam Praktek Pembuatan Perjanjian Kerja Perancangan. Metode penelitian yang digunakan dalam penulisan hukum ini adalah pendekatan yuridis normatif. Pendekatan yuridis normatif adalah penelitian yang menggunakan sumber data sekunder / data yang diperoleh melalui bahan kepustakaan. Hasil penelitian menunjukan bahwa Proses terjadinya perjanjian kerja pekerjaan perancangan antara Arsitektur dengan Pengguna Jasa telah sesuai dengan rumusan Pasal 1320 KUH Perdata. Kemudian terkait dengan implementasi Asas Kebebasan Berkontrak di Perjanjian Kerja Pekerjaan Perancangan didasarkan pada Pasal 1338 ayat (1) KUH Perdata, bahwa semua perjanjian yang dibuat secara sah dan berlaku sebagai undang-undang bagi mereka yang membuatnya. Kata Kunci:  Asas kebebas Berkontrak, Perjanjian Kerja, Perancangan

Abstract

In the industrial era 4.0 as it is now, the ease and speed of getting something are highly sought after, including the ease and speed of obtaining financial services. Financial Technology (Fintech) is a digital commercial service that offers and provides convenience and speed of financial services. The emergence of Fintech certainly makes it easy for people to get financial assistance. But as a state of law, Indonesia must regulate Fintech's business practices. Including the implementation of Fintech's business, it must be controlled and monitored by existing laws in Indonesia, not just stopping the formation of the rules, but also must be ensured that the rules apply effectively. This study aims to describe the basis for Fintech's business arrangements in Indonesia and will explain the effectiveness of the regulation in society. The writing method used is normative juridical, with a statutory approach, using secondary data by analyzing primary, secondary, and tertiary legal materials. Based on the research results, it is known that in Indonesia, Fintech's business is regulated by three institutions, namely the Ministry of Communication and Information, Bank Indonesia, and the Financial Services Authority. Regarding the effectiveness of the rules regarding the implementation of Fintech in Indonesia has not been going well because there are still shortages both in terms of legal structure, a legal substance, and legal culture.

Abstract

Transaksi jual beli tanah sering memanfaatkan Perjanjian Pengikatan Jual Beli (PPJB) dilengkapi Akta Kuasa Menjual sebelum Akta Jual Beli (AJB) definitif di hadapan PPAT, namun praktik ini rentan menimbulkan sengketa akibat penyalahgunaan kuasa, seperti kuasa mutlak yang bertentangan dengan UU Pokok Agraria dan kewenangan eksklusif PPAT. Notaris wajib menerapkan asas prudentie untuk memverifikasi subjek-objek hukum, maksud kuasa, dan memberikan penjelasan hukum guna menjamin kepastian serta perlindungan hukum. Urgensi penelitian ini muncul dari maraknya litigasi pertanahan akibat kelalaian notarial, yang mengancam tertib administrasi tanah nasional. Pembahasan menganalisis penerapan asas prudentie melalui pendekatan yuridis normatif, termasuk pemeriksaan identitas, status tanah, batasan kuasa, dan konsekuensi hukum pelanggaran, serta peran notaris sebagai pelindung kepentingan pihak melalui fiduciary duty dan kewajiban administratif. Simpulan menegaskan bahwa asas prudentie esensial mencegah penyalahgunaan kuasa, dengan saran penguatan pengawasan profesi dan regulasi tegas untuk optimalisasi peran notaris dalam kenotariatan dan pertanahan.

Abstract

Based on Law Number 5 of 1960 concerning Basic Agrarian Principles (UUPA), foreigners are prohibited from having ownership rights to land in Indonesia. However, with the Golden Visa, foreigners who meet the investment requirements can obtain convenience in terms of long-term residence permits. This opens up the possibility that Golden Visa holders can have greater access to property in Indonesia, although limited to use rights and building use rights. This research uses normative juridical methods to analyze legal issues regarding the implications of land and property rights for foreigners holding Golden Visas in Indonesia. Based on the research results, it is concluded that the implications of the policy of granting land and property rights to foreigners holding Golden Visas in Indonesia show that, although this policy aims to attract foreign investment, there is a risk of rapid economic fluctuations due to dependence on foreign investment which is vulnerable to external factors. Apart from that, there is the potential for misuse of residence permits and citizenship. This policy can also create social injustice, thereby widening the gap between Indonesian citizens and foreigners.
