Abstract

Assimilation and conditional leave programs are two important instruments in the Indonesian correctional system, serving as a form of punishment outside of correctional institutions. This article evaluates the validity and effectiveness of these two programs from the perspective of modern sentencing objectives: retribution, deterrence, rehabilitation, and social reintegration. Using a normative juridical approach and policy analysis, this paper examines how assimilation and conditional leave are implemented and the extent to which they reflect the principles of justice and the effectiveness of criminal law. The study reveals that although normatively these programs support the goals of progressive sentencing, in practice, legal and administrative obstacles still exist that hinder the achievement of effectiveness and substantive justice.

Abstract

The Pasir Intan Village is one of the transmigration villages in Bangun Purba District, Rokan Hulu Regency, Riau. Until now, most residents do not have certificates for their yard land and business land. The gap between physical control of the land and the name listed on the land rights certificate is still a crucial problem in the area. Thus causing a lack of legal certainty over land control. This community service activity aims to provide legal counseling to residents who control transmigration land but are not yet listed as rights holders on the certificate. The methods used include lectures, discussions, questions and answers, and simulations of preparing land legality documents. The results of the activity showed that most participants faced administrative obstacles in the certificate name change process, and had limited understanding of land law procedures. Desa Pasir Intan merupakan salah satu desa transmigrasi yang berada di Kecamatan Bangun Purba, Kabupaten Rokan Hulu, Provinsi Riau. Hingga saat ini, sebagian besar warga belum memiliki sertifikat atas tanah pekarangan dan tanah usaha mereka. Kesenjangan antara penguasaan fisik atas tanah dengan nama yang tercantum dalam sertifikat hak atas tanah masih menjadi permasalahan krusial di daerah ini. Hal ini menyebabkan ketidakpastian hukum dalam penguasaan tanah. Kegiatan pengabdian kepada masyarakat ini bertujuan untuk memberikan penyuluhan hukum kepada warga yang menguasai tanah transmigrasi namun belum tercantum sebagai pemegang hak dalam sertifikat. Metode yang digunakan meliputi ceramah, diskusi, tanya jawab, dan simulasi penyusunan dokumen legalitas tanah. Hasil kegiatan menunjukkan bahwa sebagian besar peserta mengalami kendala administratif dalam proses perubahan nama sertifikat, serta memiliki pemahaman yang terbatas terhadap prosedur hukum pertanahan.

Abstract

Konflik hukum yang terjadi di tengah masyarakat sering kali diselesaikan melalui pendekatan represif dan formalistik yang berujung pada proses peradilan pidana, sehingga belum sepenuhnya mencerminkan makna keadilan substantif dan pemulihan hubungan sosial. Kondisi tersebut juga masih dijumpai di Kabupaten Rokan Hulu, di mana pemahaman masyarakat terhadap konsep penyelesaian konflik hukum secara restoratif masih relatif terbatas. Kegiatan pengabdian kepada masyarakat ini bertujuan untuk memperkuat pemahaman masyarakat mengenai restorative justice sebagai alternatif penyelesaian konflik hukum yang berorientasi pada pemulihan, musyawarah, dan keseimbangan kepentingan para pihak. Metode yang digunakan meliputi penyuluhan hukum, diskusi interaktif, dan pendampingan partisipatif kepada masyarakat dan aparat desa, dengan menekankan nilai keadilan, tanggung jawab, dan perdamaian sosial. Hasil kegiatan menunjukkan adanya peningkatan pemahaman masyarakat mengenai prinsip, tujuan, dan mekanisme restorative justice, serta tumbuhnya kesadaran bahwa penyelesaian konflik hukum tidak selalu harus berakhir pada pemidanaan. Masyarakat juga mulai memahami peran aktif korban, pelaku, dan komunitas dalam proses penyelesaian konflik secara adil dan bermartabat. Kesimpulan dari kegiatan ini menunjukkan bahwa penguatan pemahaman restorative justice mampu mendorong perubahan paradigma masyarakat menuju penyelesaian konflik hukum yang lebih humanis, efektif, dan berkelanjutan, serta berpotensi memperkuat harmoni sosial di tingkat lokal.

Abstract

This study examines the reconstruction of the sentencing framework for minor offenses through a restorative justice approach to advance substantive justice. The Indonesian criminal justice system remains predominantly retributive, prioritizing punitive sanctions while insufficiently addressing victim restoration, social reconciliation, and community-based justice values. This orientation creates a persistent gap between formal legal certainty and the realization of substantive justice, particularly in minor criminal cases where proportionality and social harm are limited. This research aims to develop an integrative sentencing framework that systematically embeds restorative justice as a central paradigm. A normative juridical method is employed, incorporating statutory, conceptual, and comparative approaches to critically analyze existing legal frameworks and institutional practices. The findings reveal that the implementation of restorative justice in minor offenses remains fragmented, sectoral, and lacks systemic coherence within the national criminal law system. To address this limitation, this study proposes a reconstructed sentencing framework grounded in four key dimensions: regulatory reform, institutional harmonization among law enforcement agencies, transformation of legal actors’ paradigms, and recognition of living law as a legitimate normative foundation. This study offers a structured model that repositions restorative justice from a complementary mechanism to a core component of the sentencing system. This study contributes to the advancement of criminal law theory and practice by bridging retributive and restorative approaches within a unified framework. The proposed model is expected to enhance victim recovery, strengthen offender accountability, and promote community participation, thereby advancing the realization of substantive justice.
