Abstract

Abstract: Adolescents' lack of knowledge about reproductive health, as well as lack of access to adolescent-friendly health services, are an important background in this study. This study aims to analyze the implementation of reproductive health services for adolescents in East Aceh from a legal and ethical perspective, and assess the extent to which the principle of protection of adolescent health rights is carried out in accordance with local regulations and religious norms. This study uses a qualitative method with a juridical-sociological approach. Data was obtained through interviews with health workers, adolescents, religious leaders, and regional policy makers, as well as documentation of health service regulations and ethical guidelines. Data analysis was carried out in an analytical descriptive manner by considering positive legal norms and medical ethical principles. The results of the study show that although there is a national regulation guaranteeing the right to reproductive health of adolescents, its implementation in East Aceh faces various obstacles, such as cultural resistance, limited trained medical personnel, and lack of public understanding of the urgency of reproductive health education. From a legal perspective, there is a gap between national policy and local qanun, while ethically, health services still often clash with the conservative values of local communities. In conclusion, adolescent reproductive health services in East Aceh still need to be improved through an interdisciplinary approach that harmonizes aspects of national law, local values, and principles of medical ethics. Keywords: Reproductive Health, Adolescents, Legal Ethics. Abstrak: Adolescents' lack of knowledge about reproductive health, as well as lack of access to adolescent-friendly health services, are an important background in this study. Abstract

Abstract: Legal protection is very important to ensure a sense of security, work comfort, and legal certainty for health workers in carrying out their duties optimally and in accordance with professional ethical standards. This study was conducted to examine the urgency of legal protection for medical personnel and health workers in health service practices in Indonesia. The research method used is a qualitative approach with a normative-juridical method. Data was obtained through literature studies, analysis of relevant laws and regulations. This approach is used to identify the forms of legal protection that are already available and the extent to which they are being applied in the field. The main problem found in this study is the weak implementation of legal protection for health workers. Many cases show that medical personnel are the most vulnerable parties when a medical dispute occurs, although it is not necessarily legal negligence. The lack of legal assistance, the lack of understanding of medical personnel of their legal rights, and weak protection regulations at the institutional level exacerbate this situation. The results of the study show that legal protection must be preventive and curative. Preventively, there needs to be regular legal education and professional ethics training for health workers. The conclusion of this study emphasizes that the importance of legal protection for medical personnel and health workers is not only to protect the interests of individuals, but also to maintain the quality of health services as a whole.  Keywords: Legal Protection, Medical Personnel, Health Services. Abstrak: Perlindungan hukum menjadi sangat penting untuk menjamin rasa aman, kenyamanan kerja, serta kepastian hukum bagi para tenaga kesehatan dalam menjalankan tugasnya secara maksimal dan sesuai dengan standar etika profesi. Penelitian ini dilakukan untuk mengkaji urgensi perlindungan hukum terhadap tenaga medis dan tenaga kesehatan dalam praktik pelayanan kesehatan di Indonesia. Metode penelitian yang digunakan adalah pendekatan kualitatif dengan metode normatif-yuridis. Data diperoleh melalui studi pustaka, analisis peraturan perundang-undangan yang relevan. Pendekatan ini digunakan untuk mengidentifikasi bentuk perlindungan hukum yang telah tersedia dan sejauh mana penerapannya di lapangan. Permasalahan utama yang ditemukan dalam penelitian ini adalah masih lemahnya implementasi perlindungan hukum terhadap tenaga kesehatan. Banyak kasus menunjukkan bahwa tenaga medis menjadi pihak yang paling rentan ketika terjadi sengketa medis, meskipun belum tentu terjadi kelalaian secara hukum. Minimnya pendampingan hukum, kurangnya pemahaman tenaga medis terhadap hak-hak hukumnya, serta lemahnya regulasi perlindungan di tingkat institusi memperburuk situasi ini. Hasil penelitian menunjukkan bahwa perlindungan hukum harus bersifat preventif dan kuratif. Secara preventif, perlu ada edukasi hukum dan pelatihan etika profesi secara rutin kepada tenaga kesehatan. Kesimpulan dari penelitian ini menekankan bahwa pentingnya perlindungan hukum bagi tenaga medis dan tenaga kesehatan bukan hanya untuk menjaga kepentingan individu, tetapi juga untuk menjaga kualitas pelayanan kesehatan secara keseluruhan. Kata kunci: Perlindungan Hukum, Tenaga Medis, Pelayanan Kesehatan

Abstract

Perawat memiliki tanggung jawab hukum dalam memberikan asuhan keperawatan yang aman, bermutu, dan sesuai dengan standar pelayanan yang berlaku. Penelitian ini bertujuan untuk menganalisis tanggung jawab hukum perawat dalam pelaksanaan asuhan keperawatan bagi pasien di ruang vip rumah sakit kharitas bhakti pontianak. Metode penelitian yang digunakan adalah pendekatan kualitatif dengan teknik pengumpulan data melalui wawancara mendalam, observasi, dan studi dokumentasi. Hasil penelitian menunjukkan bahwa perawat di ruang vip memiliki tanggung jawab hukum untuk mematuhi standar prosedur operasional, mendokumentasikan asuhan keperawatan secara lengkap dan akurat, memperoleh persetujuan tindakan dari pasien atau keluarga, menjaga kerahasiaan informasi pasien, berkoordinasi dengan tenaga kesehatan lain, serta meningkatkan kompetensi secara berkelanjutan. Kendala yang dihadapi dalam pemenuhan tanggung jawab hukum antara lain kurangnya pemahaman tentang peraturan perundang-undangan dan standar praktik keperawatan, serta beban kerja yang tinggi. Penelitian ini memberikan rekomendasi untuk peningkatan pemahaman perawat melalui pelatihan dan sosialisasi, perbaikan sistem manajemen sumber daya manusia, serta penyediaan sarana dan prasarana pendukung yang memadai di rumah sakit.

Abstract

This research aims to analyze the legal protection against Termination of Employment (PHK) by companies towards breastfeeding mothers providing exclusive breastfeeding, based on Presidential Regulation No. 2 of 2022 Concerning Job Creation. The research employs a normative legal research method, examining legal regulations, doctrines, and principles relevant to the legal protection of breastfeeding mothers providing exclusive breastfeeding. In order to support the implementation of Presidential Regulation No. 2 of 2022 concerning Job Creation, there is a need for collaboration and coordination among the government, businesses, cooperatives, MSMEs, and labor force. The government must ensure that this policy is implemented fairly, taking into account workers' rights and sustainable economic empowerment. Cooperation from all relevant parties is key to achieving the goals of this structural reform in the context of the complex global economic conditions. Although Presidential Regulation No. 2 of 2022 concerning Job Creation does not specifically regulate the rights of breastfeeding workers, women workers breastfeeding at the workplace are still protected by the Labor Law. This includes the right to leave, time and facilities for breastfeeding, as well as a prohibition on termination of employment on the grounds of breastfeeding. Despite the impact of this regulation on the labor sector, it is crucial to monitor and evaluate its implementation periodically to ensure that the goals of worker protection and economic empowerment are achieved as expected.

Abstract

This research aims to analyze and compare the perspectives of Islamic law and health law regarding the use of halal capsule shells. This study is a comparative research that explores legal, ethical, and health aspects in the use of capsule shells that meet halal criteria. Using a qualitative approach, this research collected data from various relevant sources, including Islamic legal texts, health regulations, and related scientific literature. The results show that there are both similarities and significant differences in the standards and interpretations of halal between Islamic law and health law. From the perspective of Islamic law, the halal status of capsule shells is determined by the source of materials and the manufacturing process, while health law focuses more on the safety and effectiveness of the product. The study also identifies opportunities, such as a large market potential for halal products, and challenges, including the need for standardized and integrated halal certification. This research provides new insights into the importance of harmonizing the principles of halal in Islam with health standards, which are crucial not only for Muslim producers and consumers but also for broader social and economic integration. Recommendations for further research and related policies are presented to support the sustainable development of the halal capsule industry.

Abstract

Informed consent, as a statement of agreement by the patient in this therapeutic agreement, is considered valid if the patient expresses his or her will freely. Therefore, when a patient expresses his or her consent in the form of informed consent, the patient must express his or her will without any coercion, error, or deception. What we want to discuss here is that sometimes patients are not honest when asked for information regarding their actual condition by the doctor. This results in the doctor in performing medical procedures having to violate the informed consent agreement because the patient's condition makes it impossible to fulfill the informed consent agreement. Informed consent in medical procedures is one of the elements that must be fulfilled and serves as the basis for justification for medical procedures, especially for invasive medical procedures. Invasive medical procedures can basically be classified as acts of abuse as regulated in Article 351 of the Criminal Code. However, this categorization is removed if the medical procedure meets three justification elements: if the medical procedure is carried out in accordance with scientific knowledge and experience in the medical field; there is a concrete medical purpose; and there is informed consent. Informed consent becomes risky when the patient is in an emergency condition. Therefore, legal protection is needed for medical personnel. Legal protection for doctors in the context of health communication is also an important consideration. When a conflict arises between a doctor's obligation to provide accurate information and the obligation to maintain the confidentiality of patient medical data, doctors are often vulnerable to potential lawsuits. Law No. 17 of 2023 and other regulations provide legal protection for doctors by establishing limits on their obligations and rights in communicating with patients. This legal protection includes protection from unfounded lawsuits, dispute resolution mechanisms through mediation, and support for doctors in more complex medical consultations. Patient dishonesty can seriously impact the quality of medical care. If patients do not provide complete or accurate information, the risk of misdiagnosis or treatment errors increases significantly. The impact of these errors not only endangers the patient's health but also places doctors at risk of lawsuits or malpractice claims.
