Abstract

Kepemimpinan perempuan adalah bagian dari prinsip-prinsip kesetaraan gender. Kesetaraan gender merupakan kesempatan bagi pria dan wanita untuk memiliki status yang setara terkait pemenuhan hak asasi dan potensi dalam segala bidang. Kesetaraan gender seringkali menjadi suatu pembicaraan di masyarakat dimana kaum laki-laki lebih unggul untuk menjadi seorang pemimpin. Di Bali adat istiadatnya masih menganut sistem patriarki atau garis keturunan laki-laki dimana sistem ini masih sangat kental di masyarakat. Pola kepemimpinan di desa adat di Bali memiliki sistem purusa dalam kepemimpinan di Bali masih eksis/populer digunakan terus-menerus hingga sekarang. Salah satu intansi di Bali yaitu Paiketan Krama Istri (Pakis) memberikan sebuah wadah/tempat bagi kaum perempuan untuk ikut berpartisipasi dalam berbagai kegiatan yang ada. Dilihat dari perkembangan era, saat ini kepemimpinan belum sama rata dimana kaum laki-laki lebih banyak mengambil posisis sebagai pemimpin dibandingkan kaum perempuan, kebanyakan perempuan berparartisipasi mendapingi kaum laki-laki. Penelitian ini menggunkan metode penelitian Hukum Empiris dimana data yang diperoleh melalui wawancara dan menggunakan teori hukum.

Abstract

LPD is a financial institution owned by indigenous villages that runs a savings and loan business. Credit, of course, needs a guarantee. One of the collaterals used in granting credit is land. The use of land as collateral must be tied to APHT. In LPD Kepaon, not all loans guaranteed by land certificates are tied to APHT. The purpose of this study is to determine the function of guarantees in providing credit by LPD Desa Adat Kepaon and to determine the position of land guarantees in credit agreements without APHT at LPD Desa Adat Kepaon. The research method used by the author is empirical legal research. The results of this study show that the function The guarantee in providing credit by LPD Desa Adat Kepaon is to guarantee the repayment of debtors if the debtor defaults, with the guarantee will reduce the risk of loss for LPD, related to the position of land as collateral in a credit agreement without APHT by LPD Desa Adat Kepaon is that the object of guarantee for the land cannot be registered as an object of guarantee of dependent rights, by not being registered, the right of liability for the land never existed so that the land used as collateral in the provision of credit by the LPD of Kepaon Traditional Village was only positioned as ordinary material security which if in the future a default occurred would result in the LPD of Kepaon Traditional Village not having the right to carry out direct execution of the guarantee.

Abstract

This study uses a normative legal research method. The main issues discussed focus on the Regulations Concerning Credit Card Misuse for bank customers, credit card misuse often has a significant impact on the victim, a customer experiences loss or theft of a credit card, usually they must immediately report to the bank to block the credit card and prevent further transactions, but the procedure does not always run smoothly, customers are faced with complicated bureaucracy and poor response from the bank. Sometimes customers have to come to the police station to make a report, although in many situations the report does not provide a direct solution to the losses they experience. In Law No. 10 of 1998 concerning amendments to Law No. 07 of 1992 concerning banking, Article 8 of the Law regulates the bank's obligation to provide clear information to customers but is explained in detail. The results of the study on legal protection against credit card misuse for bank customers, explicitly explained that the Banking Law does not directly explain about credit card users but is detailed in the circular letter of Article 28 of the Financial Services Authority Law which regulates credit cards to protect customers and the public by implementing prevention such as providing information and education to the public about the characteristics of the financial services sector, its services and products.
