Abstract

Marrying women from the people of the Book (ahlul kitāb) is a matter of dispute amongMuslim scholars, some allow it and some forbid it. Sayyid Sabiq is among the scholars who allows Muslim men to marry women of the People of the Book under strict requirements to avoid harm and negative impacts that will occur if the marriage is carried out. This paper discusses the law of Muslim men marrying women of ahlul kitāb (the People of the Book)and analyzes it from the perspective of Sayyid Sabiq. Based on the results of the study conducted, the authors found the fact that SayyidSabiq allowed Muslim men to marry ahlul kitābwomen based on the following considerations: (i) To eliminate barriers between ahlul kitāband Muslims. (ii) As a means to establish social relations and closeness between others so that they can provide space for non-Muslims to learn and know the truth of Islamic teachings. (iii) As a means to invite them to follow Islam

Abstract

Child marriage remains a persistent social problem in Indonesia, despite significant legal reforms, notably the enactment of Law No. 16 of 2019 which raised the minimum legal age of marriage to nineteen years. However, empirical realities indicate that the practice continues to be widespread, largely reinforced by literalist religious interpretations that neglect the ethical spirit and broader objectives of Islamic jurisprudence. In response to this challenge, this study aims to critically re-examine Qur’anic verses that are frequently invoked to justify the marriage of minors through a contextual thematic interpretation (tafsīr mawd}ū’ī). This research employs a qualitative methodological framework by systematically identifying and thematically categorizing Qur’anic verses related to marriage, maturity (bulūgh), and intellectual discernment (rusyd), and parental responsibility. These verses are analyzed within their socio-historical context of revelation (asbāb al-nuzūl), followed by a contextual reinterpretation that engages contemporary legal norms and social realities in Indonesia. The findings demonstrate that although the Qur’an does not stipulate a specific chronological age for marriage, it consistently emphasizes comprehensive maturity, including physical, psychological, emotional, and financial readiness as a fundamental prerequisite. Furthermore, child marriage in the Indonesian context is shown to produce significant harm, particularly in relation to educational attainment, reproductive health, and long-term socio-economic justice. Such consequences contradict the ethical objectives of Islamic law (Maqās}id al-Sharī’ah), especially the protection of life, intellect, lineage, and human dignity. Accordingly, this study argues that a contextual thematic interpretation of the Qur’an provides a robust ethical and normative foundation to challenge literalist readings that legitimize child marriage. It further contributes to strengthening religiously grounded support for child protection policies and fostering a more humanistic and socially responsive Islamic discourse in contemporary Indonesia.

Abstract

This article examines conflict resolution patterns between Islamic law and customary law in the formation of Compilation of Islamic Law (KHI) in Indonesia. KHI constitutes a legal entity and a genuinely reformative bridge within legal pluralism, not mere an object of harmonization, and affirms that such conflicts are not anomalous. Employing a juridical-normative approach and conceptual analysis, the study traces how KHI represents the state’s ijtihad in responding to tensions among sharia norms, customary practices, and Indonesian Muslim society. The findings demonstrate three principal patterns of conflict resolution: (1) normative compromise between classical fiqh and customary practices, giving rise to the distinctly Indonesian concept of wasiat wajibah (mandatory bequest); (2) the adoption of customary institutions aligned with the principles of Islamic law, as the marital joint property showed; (3) adjusting customary norms within a sharia framework, exemplified by the concept of substitute heirs. These patterns underscore methodological and reflective nature of conflict resolution within KHI. KHI emerges as a model of active and productive normative conflict resolution within Indonesia’s legal pluralism. This constitutes a theoretical contribution to contemporary Islamic legal scholarship while proposing a policy-oriented direction for a more inclusive, contextual, and maqāṣid al- sharīʿah-oriented reform of the KHI.
