Abstract

Indonesia telah melakukan upaya-upaya mempersiapkan kebijakan serta mewujudkan regulasi khususnya tentang Tenaga Kerja Asing (TKA).Tujuan utama dari upaya-upaya ini selain turut serta dalam arus bebas tenaga kerja terampil, juga menjamin hak-hak warga Negara agar tetap mendapatkan pekerjaan dan kelayakan kehidupan. Indonesia juga berkewajiban memfasilitasi pergerakan tenaga kerja terampil. Terkait hal tersebut, pemberlakuan Perpres Nomor 20 Tahun 2018 tentang Penggunaan Tenaga Kerja Asing perlu ditelaah sejauh mana efisiensi pemberlakuan dan ketepatan substansi pengaturannya? Metode penelitian yang digunakan ialah Economic Analysis of Law sebagai analisis hukum dengan menggunakan bantuan ilmu ekonomi, dalam hal ini konsep efisiensi. Hasil penelitian menunjukkan masih terdapat banyak pengaturan yang inefisien dalam Peraturan Presiden ini seperti belum menekankan kepada daya saing, pencegahan kegagalan alih teknologi dan keahlian, belum mempromosikan kepentingan publik serta belum mampu mewajibkan informasi asimetris karena tidak melibatkan Tenaga Kerja Indonesia untuk memastikan kebutuhan riil penggunaan Tenaga Kerja Asing. Namun Peraturan Presiden ini sudah cukup efisien dalam hal pemangkasan birokrasi. Ke depannya, perlu dikembalikan lagi hakikat efisiensi baik dalam aspek birokrasi maupun ketepatan sasaran penggunaan TKA berdasarkan perbedaan keterampilan dan keahlian.

Abstract

Article 7 of the Freedom of Opinion Law states that: “In the implementation of public expression of opinion by citizens, the apparatus is obliged and responsible for: (a). protect human rights; (b). respect the principle of legality; (c). respect the principle of the presumption of innocence; and D). organize. Furthermore, Article 8 of the Freedom of Opinion Law states that: "The community has the right to participate and be responsible for making efforts so that public opinion can take place in a safe, orderly and peaceful manner". the right to be free without any censorship or not, but in this case it is not included in the case of spreading hatred. Freedom of expression aims to liberate responsible freedom as one of the implementations of human rights in accordance with Pancasila and the 1945 Constitution of the Republic of Indonesia, to realize consistent legal protection and guarantee freedom to provide freedom, create a conducive climate, develop it, and creativity of every citizen as the embodiment of rights and freedoms. responsibility in democratic life

Abstract

Minister of Law and Human Rights Regulation No. 2 of 2019 concerning Disharmony Settlement Laws and Regulations Through Mediation regulates the mediation process for disharmony of several regulations such as Ministerial Regulation; Regulation of Non-Ministerial Government Institutions; Regulations from Non-Structural Institutions; and Regional Regulations. Whereas if a regulation is in conflict with other regulations, then a judicial review can be conducted to the Supreme Court and this has been stipulated in the 1945 Constitution where the 1945 Constitution is the highest statutory regulation and there is no lower statutory regulation that can override the provisions The 1945 Constitution. This type of research can be classified as a type of normative research. In this study, the focus is to examine the level of synchronization of law and the principle of law, namely the principle of lex superior derogate legi inferior. Source of data used secondary data consisting of primary legal materials, secondary legal materials, and tertiary legal materials, data collection techniques in this study with the literature review method, after the data collected and then analyzed to draw conclusions. From the results of research and discussion, it can be concluded that, First, the authority of the Ministry of law and human rights in completing the disharmony of laws and regulations based on Minister of Law and Human Rights Regulation No. 2 of 2019 is something that violates higher legal norms or norms. Because the 1945 Constitution which gives the authority to examine the legislation under the law against the law is to the Supreme Court and not to other institutions. Second, the Supreme Court should conduct a judicial review in which the ideal concept of authority is regulated in the 1945 Constitution and not the Ministry of Law and Human Rights. If you want to test the statutory regulations, then the laws and regulations must be made in the form of laws

Abstract

Penelitian ini bertujuan untuk mengetahui resentralisasi kewenangan pasca berlakunya Undang-Undang Cipta Kerja serta implikasi hukum resentralisasi kewenangan terhadap keberlakuan produk hukum daerah. Menggunakan metode penelitian hukum dengan pendekatan perundang-undangan dan konseptual. Resentralisasi kewenangan tersebut secara filosofis bertentangan dengan prinsip otonomi, hubungan kewenangan yang adil dan serasi, dan pembagian urusan pemerintahan konkuren. Karenanya, resentralisasi kewenangan dalam Undang-Undang Cipta Kerja berimplikasi kepada ketidakberlakuan produk hukum daerah berdasarkan argumentasi hukum (1) asas lex superiori derogat legi inferiori, peraturan daerah dikesampingkan oleh keberlakuan Undang-Undang Cipta Kerja; (2) Secara normatif, Pasal 250 Undang-Undang Pemerintahan Daerah menentukan peraturan daerah dilarang bertentangan dengan peraturan perundang-undangan yang lebih tinggi.
