Abstract

Penelitian ini bertujuan untuk dan menemukan pengaruh kepemimpinan, budaya organisasi, komitmen organisasi terhadap kinerja dosen Universitas Serambi Mekkah Aceh yamg berjumlah 270 orang. Teknik pengumpulan sampel menggunakan proporsional random sampling sehingga diperoleh sampel sebanyak 152 orang. Data dikumpulkan dengan menggunakan angket yang diisi oleh responden yang berasal dari dosen Universitas Serambi Mekkah Aceh. Teknik analisis data dilakukan dalam dua tahap yakni secara deskriptif dan inferensial. Tujuan analisis deskriptif adalah untuk menggambarkan karakteristik data berupa rata-rata, median, modus dan varians. Analisis inferensial digunakan untuk menguji persyaratan dan hipotesis penelitian. Uji Persyaratan analisis mencakup: uji normalitas data dan uji linieritas regresi. Uji normalitas data setiap variabel menggunakan Uji Lilliefors. Uji kelinieran regresi antar variabel dilakukan menggunakan statistik F test. Untuk menguji hipotesis digunakan analisis jalur (path analysis) dan untuk menguji kecocokan model teoretik digunakan uji goodness of fit dengan menggunakan Chi Kuadrat. Hasil penelitian menunjukkan bahwa: 1) kepemimpinan (X1) berpengaruh langsung dan positif terhadap komitmen organisasi (X3); 2) budaya organisasi (X2) berpengaruh langsung dan positif terhadap komitmen organisasi (X3); 3) kepemimpinan (X1) berpengaruh langsung dan positif terhadap kinerja dosen (X5); 4) budaya organisasi (X2) berpengaruh langsung dan positif terhadap kinerja dosen (X5); 5) komitmen organisasi (X3) berpengaruh langsung dan positif terhadap kinerja dosen (X5). Dalam penelitian ini komitmen organisasi berpengaruh langsung positif terhadap kinerja dosen Universitas Serambi Mekkah Banda Aceh, dengan perkataan lain, semakin baik komitmen organisasi, semakin tinggi kinerja dosen Universitas Serambi Mekkah Banda Aceh

Abstract

Abstract: The influence of Dutch colonial legal politics on the development of Islamic economic law had a significant impact in the historical context of Indonesia. During the Dutch colonial period, the dominant legal system implemented was Western law, which was not in line with the principles of Sharia law. Dutch colonial legal politics had three aspects that influenced the development of Islamic economic law. First, the comprehensive adoption of Western law, including in the field of economic law. Second, unequal treatment towards local customary law and legal systems, including the existing Sharia economic system prior to the arrival of the Dutch. Third, restrictions on local legal autonomy and the use of colonial law that favored Dutch interests. However, Sharia economic law was not completely eradicated during the Dutch colonial era, and some Sharia financial practices and institutions managed to survive, albeit on a limited scale. The influence of Dutch colonialism also could not eliminate the awareness and need for Islamic economic law among the Muslim community in Indonesia. Abstrak: Pengaruh politik hukum kolonial Belanda terhadap pengembangan hukum ekonomi Syariah memiliki dampak yang signifikan dalam konteks sejarah Indonesia. Pada masa kolonial Belanda, sistem hukum yang diterapkan secara dominan adalah hukum barat yang tidak sejalan dengan prinsip-prinsip hukum Syariah. Politik hukum kolonial Belanda memiliki tiga aspek yang mempengaruhi pengembangan hukum ekonomi Syariah. Pertama diadopsi hukum barat secara menyeluruh, termasuk dalam bidang hukum ekonomi. Kedua perlakuan tidak setara terhadap hukum dan sistem hukum adat lokal, termasuk sistem ekonomi Syariah yang sudah ada sebelum kedatangan Belanda. Ketiga pembatasan terhadap otonomi hukum lokal dan penggunaan hukum kolonial yang lebih menguntungkan kepentingan Belanda Akan tetapi tidak sepenuhnya terhapusnya hukum ekonomi Syariah di masa kolonial Belanda dan beberapa praktik dan lembaga keuangan Syariah masih bertahan meskipun dalam skala yang terbatas. Pengaruh kolonial Belanda juga tidak dapat menghilangkan kesadaran dan kebutuhan akan hukum ekonomi Syariah di kalangan masyarakat Muslim Indonesia.

Abstract

The development of national law in Indonesia is a complex process involving various issues, interests, and expectations. Islamic law plays a crucial role in shaping the national legal system as one of the acknowledged sources of law. However, challenges in integrating Islamic law with national law encompass the diversity of interpretations, harmonization with constitutional principles, and practical obstacles in implementation. This study employs a literature review method with a normative approach. The literature review method is utilized to explore and analyze various documents and literature concerning the integration of Islamic law into the national legal system, enabling a more profound understanding of Islamic law and national law. The study's conclusion underscores the significant role of Islamic law in the development and formation of national law in Indonesia. Islamic law strongly influences the shaping of legal norms and values within the national legal system. Nevertheless, the integration of Islamic Law with National Law faces challenges and obstacles that must be overcome, including diverse interpretations, consensus among various parties, and a deep understanding of Islamic law within Indonesia's social context.

Abstract

This article seeks to examine the legal culture of the Samin community in relation to their preferences in family law, the persistence of the customary law in the community, and the transformations that have taken place in Samin family law. The data of this article is derived from an ethnographic study conducted at various Samin villages in Central Java between 2022 and 2023. Information was gathered via in-depth interviews, observation, and document analysis. The study's findings suggest that the government does not officially recognize marriage within the Samin community. However, the Samin family law has undergone a significant transformation. It underwent a substantial change which involved the government officially acknowledging the Samin beliefs. The research findings reveal symptoms of the Samin family law which underwent a transformation from customary law to local fiqh characterized by a mystical style. Efforts are being made to establish formal legal frameworks that accept the belief in God Almighty and incorporate legal practices. The legal negotiations led to the emergence of natural law plurality which in practice, is influenced by politics, social, and culture.

Abstract

Buah sukun memiliki kandungan pati 60% dan pemanfaatannya masih belum optimal serta jumlahnya melimpah hampir disetiap daerah di Indonesia. Pati merupakan salah satu hidrokoloid yang biasa digunakan sebagai bahan pembuatan edible film. Edible film data diartikan sebagai lapisan tipis yang dapat dimakan yang digunakan untuk melapisi dan mengemas makanan. Tujuan dari penelitian ini adalah untuk mempelajari kondisi yang diperlukan untuk membuat film yang dapat dimakan dari pati sukun dengan berbagi tingkat penambahan keragenan serta asam sitrat sebagai pengikat.  Penelitian ini melibatkan dua proses, yaitu pembuatan film makanan dengan berbagai tingkat penambahan karagenan seperti: 0,5 gram, 1 gram, 1,5 gram, dan 2 gram, serta tingkat penambahan asam sitrat 1 % seperti: 5 ml, 10 ml, 15 ml, dan 20 ml. Analisis hasil pada penelitian ini terdiri dari uji kadar air pada pati, kuat tarik, ketahanan air (swelling), serta pengemasan. Hasil uji kadar air pada pati yaitu 7,33 %. Uji dengan variasi penambahan keragenan dan asam sitrat menunjukkan bahwa edible film memiliki kuat tarik tertinggi sebesar 4,10 MPa, nilai persen kemuluran tertinggi sebesar 108,0 %, dan nilai ketahanan air tertinggi sebesar 15,09 %. Uji pengemasan edible film pada buah tomat bertahan selama 9 hari dari kerusakan mikroba. Run ke-14 memiliki hasil terbaik.

Abstract

The principle of a fast, simple, and low-cost judiciary constitutes a fundamental principle in the administration of judicial power, as stipulated in Article 2 paragraph (4) of Law Number 48 of 2009 on Judicial Power. This principle aims to ensure access to justice for justice seekers, including in the enforcement of court judgments through execution mechanisms. However, in practice, execution proceedings often encounter various obstacles that cause the process to be slow, complicated, and costly. This study aims to analyze the effectiveness of the implementation of the principle of a fast, simple, and low-cost judiciary in execution cases at the Banjarbaru Religious Court and to identify the factors influencing its implementation. The research method employed is empirical legal research using a sociological-juridical approach. The results of the study indicate that the implementation of the principle of a fast, simple, and low-cost judiciary in execution cases at the Banjarbaru Religious Court has not yet been fully effective. This is due to juridical factors, non-juridical factors, as well as the level of legal awareness of the parties involved. Therefore, improvements are necessary in terms of regulatory frameworks, judicial administration, and the enhancement of public legal awareness in order to achieve effective and equitable execution of court judgments.

Abstract

Previous criminal justice practices in Indonesia were hindered by the confusion of the colonial-inherited Criminal Code (WvS), which erroneously merged the State of Emergency (Noodtoestand) into the construction of Force Majeure/Duress (Overmacht). Recognizing this systematic flaw, Law Number 1 of 2023 concerning the National Criminal Code deconstructs this rule by independently separating Overmacht, Noodtoestand, and Self-Defense (Noodweer). This study is a normative legal research utilizing statutory, conceptual, and historical approaches. The results show two main findings. First, the ratio legis for this separation is rooted in the recognition of the legal subject's rationality. Overmacht is positioned purely as an excuse (schulduitsluitingsgrond) due to the paralysis of the perpetrator's free will under severe pressure, while Noodtoestand is recognized as a justification (rechtvaardigingsgrond) as it involves rational balancing (belangenafweging) strictly bound by the principles of subsidiarity and proportionality. Second, the differentiation of these three criminal defense grounds is based on four strict juridical parameters, including: the source of the threat, the condition of the perpetrator's free will, the target of the act (the injured party), and their dogmatic qualifications. Through this reconstruction, the New Criminal Code presents rigid legal certainty to minimize disparities in judicial decisions and guarantee substantive justice.
