Abstract

Abstract.Restoring the face of Indonesian Democracy is complicated. Long phases in any case are needed until the real of Indonesian democracy is obtained. Constitutional amendments were also carried out to restore the meaning of democracy to achieve the benefits of democracy itself. As a result of the constitution being considered sacred and cannot be touched by the idea of change during the New Order, amendments became the only unavoidable alternative. The amendments were undergone in an effort to touch on the elements that are considered as the joint foundation of the establishment of democracy in this country. The things done in the amendments also relate to strengthening the contents of the institution which is the mandate of the constitution. Legislative construction is considered as the base of the joint which is the estuary of the concept of pure democracy. The addition of the DPD organs as a new institution in the Indonesian constitutional legislative structure is part of an effort to restore democracy in Indonesia. Therefore this construction effort has an impact on the opening of access to democracy so that it is no longer distant from the people, guaranteed individual and group freedom, upholding human rights, and opening the space for freedom for the press.Keywords: Construction, Legislative Institution, Indonesian Democracy AbstrakTema yang disandingkan dalam demokrasi yang pernah dilaksananakan di negara Indonesia adalah bentuk upaya para pemimpin untuk menemukan jati diri demokrasi yang sesuai dengan karakter bangsa serta dikehendaki oleh rakyat Indonesia. Berbagai langkah pun ditempuh untuk menemukan makna demokrasi sesungguhnya. Bahkan Amandemen pun dilakukan untuk mengembalikan makna demokrasi guna mencapai manfaat dari demokrasi itu sendiri sebagimana yang dikatakan dalam para ahli hukum. Akibat konstitusi tidak dapat disentuh oleh ide perubahan, maka amandemen pun tidak dapat dihindari. Amandemen dilakukan dalam upaya menyentuh unsur-unsur yang dianggap sebagai pangkal sendi dari tegaknya demokrasi di Negara ini. Tidak hanya mengisi muatan kosong dalam konstitusi, hal lain yang dilakukan amandemen yakni juga terkait penguatan isi lembaga yang merupakan amanat konstitusi. Konstruksi legislatif dianggap sebagai pangkal sendi yang menjadi muara konsep demokrasi murni.  Penambahan organ DPD dalam struktur legislatif ketatanegaraan Indonesia, salah satu usaha merestorasi demokrasi di Indonesia. Membuka akses demokrasi agar tidak berjarak dengan rakyat, menjamin kebebasan individu juga kelompok, menegakkan azasi manusia, memberi ruang untuk pers adalah beberapa materi yang dititipkan dalam mengfungsikan lembaga legislatif sebagai lembaga yang independen representasi rakyat. Lembaga lain dalam struktur legislatif yakni DPD yang lahir bersamaan amandemen ketiga UUD 1945 pada November tahun 2001, juga dibentuk dalam rangka pemenuhan demokrasi rasa keadilan bagi masyarakat di daerah yang tidak terjangkau secara geografis, juga keterbatasan akses terhadap perwakilannya. Kata Kunci: Kontruksi, Lembaga Legislatif, Demokrasi Indonesia Аннотация.В любом случае необходимы длинные фазы, пока не будет достигнута подлинная демократия Индонезии. Были также внесены конституционные поправки, чтобы восстановить значение демократии для достижения преимуществ самой демократии. В результате того, что конституция считается священной и не может быть затронута идеей изменений во время Нового порядка, поправки стали единственной неизбежной альтернативой. Поправки были внесены в попытке затронуть элементы, которые рассматриваются как совместный фундамент установления демократии в этой стране. То, что сделано в поправках, также касается укрепления содержания института, который является мандатом конституции. Законодательное строительство рассматривается как основа объединения, которое является устоявшимся понятием чистой демократии. Добавление органов DPD (региональное представительство) в качестве нового института в конституционную законодательную структуру Индонезии является частью усилий по восстановлению демократии в Индонезии. Поэтому эти усилия по строительству оказывают влияние на открытие доступа к демократии, так что она больше не находится на расстоянии от людей, гарантируется индивидуальная и групповая свобода, отстаиваются права человека и открываются возможности для прессы.Ключевые Слова: строительство, законодательное учреждение, индонезийская демократия

Abstract

In Indonesia, the polemic on interfaith marriages has not yet ended, even though over time and the times. Even though the issue of interreligious Marriage has been handled and regulated in the Marriage Law, there are still many people who practice it. In Indonesia, interfaith marriages cause not only legal problems but also administrative ones. There are still exceptions to the Marriage Act that allow couples to marry across religions. Because according to positive Indonesian Law, Marriage is not equated with a simple genetic relationship. However, the administration must prove a legal relationship with the state, including the registration of marriages. The research method used is a qualitative research method with a literature approach. The results of the study state that there are still gaps and opportunities for maladministration in interfaith marriages. The behavior occurs in the form of apostasy or changing religions before Marriage, then changing beliefs after Marriage. This was done to get the legality of Marriage in the form of a marriage book. These maladministration opportunities must be closed and eliminated by making government regulations or giving strict sanctions to the perpetrators of maladministration. The sanctions are criminal or fines for people who carry out legal smuggling like this.

Abstract

The main problem in this study is the many nominee agreement practices in Indonesia, especially in Bali, as in the case of Decision Number 137/Pdt.G/2021/PN. Gin. The purpose of this study is to examine the legal consequences of ownership of land title certificates for parties based on nominee agreements and then the researcher explains the Responsibility of Beneficial Owners who own land and buildings in Indonesia based on nominee agreements against taxes due to the transfer of land and building rights. This research uses a type of qualitative research that is descriptive analysis using a normative-juridical approach. This research was conducted using library research, by examining the approach of theories, concepts, reviewing the statute approach related to this law research and the case approach, namely the implementation of law in handling nominee agreement cases. The results showed that there were differences of opinion between judges in deciding cases related to nominee agreements, this was because there was no legal certainty regarding the rules governing nominee agreements. Furthermore, the legal consequences of ownership of title certificates over land do not only result in the parties, namely the land falls to the state and the agreement made is null and void. However, it also has repercussions for notaries and state losses, which are mainly related to taxes.   Permasalahan utama dalam penelitian ini adalah banyaknya praktik perjanjian nominee di Indonesia terutama di Bali seperti dalam kasus pada Putusan Nomor 137/Pdt.G/2021/PN.Gin. Adapun tujuan dari penelitian ini untuk mengkaji akibat hukum kepemilikan sertifikat hak milik atas tanah bagi para pihak berdasarkan perjanjian nominee dan selanjutnya peneliti menjelaskan Tanggung Jawab Beneficial Owner yang mempunyai tanah dan bangunan di Indonesia berdasarkan perjanjian nominee terhadap pajak akibat adanya pengalihan hak atas tanah dan bangunan. Penelitian ini menggunakan jenis penelitian kualitatif yang bersifat deskriptif analisis dengan menggunakan pendeketan normatif-yuridis. Penelitian ini dilakukan dengan menggunakan penelitian kepustakaan (library research), dengan menelaah pendekatan teori-teori, konsep-konsep, mengkaji peraturan perundang-undangan (statute approach) yang bersangkutan dengan penelitian ini hukum ini dan pendekatan kasus (case approach), yakni implementasi hukum dalam menangani kasus perjanjian nominee. Hasil penelitian menunjukan bahwa terdapat perbedaan pendapat antara hakim dalam memutuskan perkara terkait perjanjian nominee, hal ini disebabkan belum ada kepastian hukum mengenai aturan yang mengatur mengenai perjanjian nominee. Selanjutnya, akibat hukum dari kepemilikan sertifikat hak milik atas tanah tidak hanya berakibat bagi para pihak saja yakni tanahnya jatuh kepada negara dan perjanjian yang dibuat batal demi hukum. Tetapi, juga berakibat bagi Notaris dan kerugian negara terutama terkait dengan pajak.

Abstract

Damage will hit the people of a country when corruption has become a culture. However, religion as a way of life for the people is able to contribute to dampening this culture of corruption, so that it can save people from the destruction of their culture of life. The method used in this study is a qualitative method with a literate approach. The results of the study stated that religion greatly contributed to reducing the culture of corruption. However, there are still challenges for religion to be able to contribute to reducing the culture of corruption, including the limited involvement of religious leaders in political issues, religious differences, lack of coordination between religious institutions and the government, cultural and social environmental factors, lack of supervision and strict law enforcement. In addition, there are limitations of religious leaders in their mastery of general science and technology.Keywords: Corruption Culture; Religion; Contribution

Abstract

Pasal 13 ayat 1 Undang-Undang Nomor 48 Tahun 2009 tentang Kekuasaan Kehakiman menyebutkan semua sidang pemeriksaan pengadilan terbuka untuk umum, kecuali Undang-Undang berkata lain. Oleh karena itu, judicial review persidangan harus dilakukan terbuka untuk umum. Apabila proses persidangan judicial review ini dilakukan secara tertutup, maka dapat dinilai cacat hukum karena bertentangan dengan Pasal 13 ayat (3) Undang-Undang tersebut. Undang-Undang Mahkamah Agung pun tidak diatur bahwa persidangan judicial review bersifat tertutup, karena dalam judicial review perlu adanya keterbukaan atau asas audi alteram et partem atau pihak-pihak yang berperkara harus diberi kesempatan untuk memberikan keterangan dan menyampaikan pendapatnya termasuk pihak termohon sebagai pembuat Peraturan Perundang-Undangan di bawah Undang-Undangsehingga akan terkena dampak putusan perlu dilibatkan.

Abstract

Resolving disputes is a crucial aspect of the justice system that requires efficacy, accessibility, and superiority. In an increasingly technologically advanced era, religious courts must also embrace technology as an effective dispute-resolution tool. This article discusses the urgency and significance of employing technology in religious court dispute resolution. Numerous significant advantages can be derived from using technology in religious courts. For instance, technology can improve productivity by streamlining administrative and case management procedures. Electronic delivery of trial notices and related informationmakes it simpler for interested parties to access the latest news and follow the legal process. Technology can also enhance society's accessibility. Additionally, applying technology in religious tribunals can improve the quality of dispute resolution. The method used in this research is a qualitative research method with a literature and statutory approach. The results of the study state that some challenges and obstacles need to be overcome in the application of technology in dispute resolution in Religious Courts. Attention must be paid to the limitations of technological infrastructure, data security, and privacy, as well as adoption andadaptation by related parties. Therefore, it is recommended that associated parties provide judges and court personnel with adequate technical training and education and devise regulations that support the Use of technology in dispute resolution.
