Abstract

Krisis kesehatan global akibat pandemi COVID-19 menjadi momentum penting dalam meninjau kembali relasi antara hukum konstitusi, kebijakan publik, dan hak asasi manusia di Indonesia. Penelitian ini bertujuan untuk menganalisis dinamika penerapan prinsip konstitusionalisme dalam situasi darurat kesehatan serta implikasinya terhadap perlindungan hak-hak konstitusional warga negara. Metode yang digunakan adalah penelitian hukum normatif dengan pendekatan perundang-undangan, konseptual, dan komparatif, menggunakan data sekunder dari literatur resmi, buku, serta jurnal hukum nasional. Hasil penelitian menunjukkan bahwa penerapan kebijakan publik selama krisis kesehatan sering kali menimbulkan dilema antara perlindungan hak individu dan kepentingan umum. Negara memiliki kewenangan untuk melakukan pembatasan hak, namun harus tetap mengacu pada prinsip proporsionalitas, legalitas, dan akuntabilitas sebagaimana diatur dalam konstitusi. Dalam konteks ini, prinsip konstitusionalisme berperan sebagai instrumen pengendali agar kebijakan darurat tidak berubah menjadi bentuk penyalahgunaan kekuasaan. Penelitian ini menyimpulkan bahwa perlu adanya reformulasi mekanisme hukum darurat yang lebih adaptif dan berbasis hak asasi manusia untuk menghadapi potensi krisis di masa mendatang

Abstract

Intensi dari penelitian ini adalah untuk Mempelajari ketentuan dalam Undang-Undang Nomor 22 Tahun 2001 tentang Minyak dan Gas Bumi. Tindakan pengoplosan BBM merupakan kejahatan Pelaksanaan hukuman pidana bagi pelaku penyalahgunaan BBM yang memberikan dampak negatif baik bagi konsumen maupun negara, karena dilakukan untuk keuntungan pribadi. Hasil pembahasan menunjukkan bahwa penggunaan BBM bersubsidi di IndonesiaMendapat subsidi, Peraturan perundang-undangan terkait Migas Tahun 2001, Diatur dalam sejumlah dasar hukum, termasuk Undang-Undang Nomor 22 Pada tahun 2021 yang merupakan perubahan dari Perpres No. 117 Tahun 2021, Peralihan, Peraturan Presiden Nomor 191 Tahun 2014 mengenai Penyediaan, Pendistribusian, dan Penetapan Harga Eceran BBM, serta sejumlah peraturan lainnya. Di antaranya yaitu Peraturan Menteri Ketentuan ESDM Nomor 12 Tahun 2013 mengena pengaturan pemakaian, serta beberapa regulasi dariPengaturan pemakaian, Lembaga Pengawas Hilir Migas, Di tahun 2012, seperti Peraturan Nomor 3, 4, dan 5 Tahun 2012 yang Menetapkan aturan terkait pengawasan jenis BBM tertentu, alokasi volume BBM bersubsidi, dan pedoman penerbitan surat rekomendasi.Adapun sanksi pidana Pengaturan mengenai penyalahgunaan BBM bersubsidi tercantum pada Pasal 5 Undang-Undang Nomor 22 Tahun 2001 tentang Migas, yang menjadi landasan, untuk pemberian hukuman pidana kepada pelaku pelanggaran.

Abstract

This research discusses the role of the Constitutional Court (MK) in maintaining the balance of power through an analysis of Constitutional Court Decision No. 90/PUU-XXI/2023 regarding the minimum age requirement for presidential and vice-presidential candidates. The study employs a qualitative approach using the library research method, drawing from legal documents, scholarly literature, and relevant constitutional sources. The findings indicate that the Constitutional Court holds a strategic position as the guardian of the constitution, ensuring the implementation of the checks and balances principle within Indonesia’s constitutional system. However, in the context of this decision, the Court is viewed as having extended its authority beyond the legislative domain. The ruling sparked debates over judicial independence and its implications for democracy. Therefore, the Court must uphold integrity, transparency, and accountability to remain a neutral, authoritative institution devoted to constitutional justice.

Abstract

Constitutionalism plays a fundamental role in limiting state power and ensuring that government authority operates within ethical, legal, and democratic boundaries. Indonesia and Thailand offer two contrasting examples of constitutional development in Southeast Asia. Following the 1998 Reform era, Indonesia successfully strengthened mechanisms of checks and balances through the establishment of the Constitutional Court, decentralization reforms, and the empowerment of independent oversight bodies. In contrast, Thailand has experienced repeated cycles of military intervention, where post-coup constitutions have served not as tools to restrict state power, but rather as instruments legitimizing centralized authority and military dominance.This article synthesizes existing scholarly literature and identifies critical research gaps related to constitutionalism studies in both countries. First, there remains a scarcity of long-term empirical and quantitative studies assessing the effectiveness of constitutional limitations on executive, legislative, and judicial power. Second, current research has insufficiently examined informal political practices, including patronage networks, oligarchic influence, and military entrenchment within state institutions. Third, comparative constitutional studies covering the 2014–2025 period remain limited, particularly in assessing post-authoritarian and post-coup constitutional dynamics.The findings of this review highlight the need for deeper interdisciplinary research, integrating political science, legal studies, and institutional analysis to better understand the evolving nature of constitutionalism in Southeast Asia.

Abstract

The term “comparison” in the context of Public Administration Science refers to an activity of aligning, analyzing, and identifying similarities and differences between various phenomena or objects under study. Meanwhile, administration is understood as a social phenomenon in which groups of people or citizens work together in an organized and purposeful manner to achieve certain collective goals.This research, entitled “A Comparative Study of Public Administration in Indonesia and South Korea in Achieving Effective and Accountable Governance,” aims to analyze both the similarities and differences between the two countries in terms of bureaucratic structure, public administration systems, and the effectiveness and accountability of governance. Indonesia and South Korea, as Asian nations with distinct historical backgrounds, governmental systems, and development trajectories, share a common vision of establishing a clean, transparent, and responsive system of governance.The study employs a qualitative descriptive approach using the literature review method, by examining various relevant academic and official sources. The main focus of the comparison lies in the bureaucratic and administrative systems of Indonesia and South Korea. The analysis also takes into account cultural characteristics and governmental structures, including the presidential system, legal framework, financial administration, and local government mechanisms.The findings of this research are expected to provide a comprehensive understanding of how differences in administrative structures and bureaucratic performance in both countries influence the effectiveness and accountability of their governments. Furthermore, the study aims to offer valuable insights for Indonesia in strengthening good governance and improving the quality of public service delivery.

Abstract

This study analyzes the role of constitutional courts in maintaining the rule of law through a comparative study between the Constitutional Court of Indonesia and the Federal Constitutional Court of Germany (Bundesverfassungsgericht). Using a juridical-normative approach with comparative methods, the research examines legal documents, court decisions, and academic literature related to the rule of law and constitutionalism. Secondary data were sourced from scientific journals, laws, and key court decisions, including the Lüth Case (1958), Brokdorf Case (1985), and Lisbon Treaty Case (2009) in Germany, as well as Indonesia's Constitutional Court Decision No. 91/PUU-XVIII/2020 on the Job Creation Law. The study shows that both countries consider the constitution as the highest norm and position their constitutional courts as guardians of the rule of law. However, Germany’s court enjoys high compliance, whereas Indonesia faces challenges due to weak legal culture, political intervention, and low integrity in law enforcement. The German court has developed the living constitution doctrine, while Indonesia remains more formalistic and reactive. This study concludes that the success of constitutional courts depends on institutional independence, compliance by state institutions, and a societal legal culture that respects the constitution.

Abstract

The rapid development of information and communication technology has driven the transformation of human activities into the digital realm, making cyber law regulation an essential need to govern activities in the virtual world. This research discusses the comparison of cyber law regulations in Indonesia and Singapore, specifically the Electronic Information and Transactions Law (UU ITE) and the Cybersecurity Act as well as the Protection from Online Falsehoods and Manipulation Act (POFMA), focusing on legal philosophy, enforcement mechanisms, and the protection of freedom of expression. A normative legal research method with a comparative approach is used to analyze the normative context, law enforcement implementation, and the social impacts of both regulations. The research findings indicate that Indonesia adopts a repressive legal approach with fragmented enforcement and challenges related to digital literacy, which leads to potential restrictions on freedom of expression. In contrast, Singapore applies a risk-based regulatory framework with centralized coordination and a more adaptive mitigation approach, aiming to balance content control with the protection of human rights. This research recommends reforms and strengthening of cyber law regulations in Indonesia to improve law enforcement effectiveness and ensure proportional freedom of expression in the digital era.
