Abstract

UU No. 32 Tahun 2009 tentang Perlindungan dan Pengelolaan Lingkungan Hidup mengehandaki sistem pengawasan terhadap pengelolaan lingkungan hidup secara terpadu. Kenyataan, sistem pengawasan perizinan bidang lingkungan hidup berjalan sendiri-sendiri secara sektoral. Kondisi umum sistem pengawasan perIzinan bidang lingkungan hidup ini mengakibatkan sulitnya keterpaduan pengelolaan lingkungan hidup yang sebenarnya merupakan asas penting dalam hukum lingkungan yang terdapat pada UU-PPLH. Dengan kata lain, cita-cita keterpaduan dalam UU PPLH, tidak dapat dilaksanakan terhadap sistem pengawasan perizinan bidang kehutanan dan pertambangan. UU-PPLH sebagai tidak sepenuhnya bisa diterapkan pada sistem pengawasan perIzinan yang diatur oleh UU Kehutanan dan Pertambangan. Selain substansinya banyak tidak sesuai juga norma hukum pengawasan perizinan pada UU-PPLH tidak lebih tinggi dibandingkan dengan UU Kehutanan dan UU Pertambangan. Dalam rangka pembentukan sistem pengawasan perizinan lingkungan hidup secara terpadu, maka pengaturan Pengelolaan Lingkungan Hidup Nasional dalam satu UU sangat diperlukan dalam rangka mewujudkan pembangunan berkelanjutan di Indonesia.

Abstract

Law of job creation (UU-CK)  already change, remove, and shift the new norm of law of environmental protection (UU-PPLH) in today  potentially to create a matter and second legal conflict for this law in the action and law enforcement in the future. Among the urgency of economic affair through the acceleration  of investment will face off the urgency of the protection  and environmental management. Both matters come as the focus on this article analysis here are these,  first the legislation as a system and implication  of job creation's law legality against UU-PPLH as environmental clustering in Indonesia. Second, the implication of the change of UU-PPLH due to UU-CK. Here is the conclusion, first the change of UU-PPLH's primary norm due to UU-CK will impact on another norm which the legality directly related on the protection and environmental management overall. Second, the implication identified from the content material, both law potentially to create a norm conflict on the action and law enforcement. Meanwhile, if this case related to the principle of legal conflict settlement, then no principle can be used either the principle of lex specialis derogat legi generalis, the principles of Lex superior derogat legi inferior, and the principles of lex posterior derogat legi priori. To encounter the norm conflict matter, the better one in reformating regulation in the way of Omnibus law method, despite it is limited on the system of clustering and organization, but also not repeal and state the illegality of the impacted regulation.

Abstract

The Notaries are charged with great responsibility for every action taken, in this case making an authentic deed. The world of auctions is known for the acte de command. The temporary purchase plan by the bank must begin with the creation of an authentic deed known as the Deed of Purchase for Others or also known as the Acte de command which essentially contains a statement that the creditor bank will participate in the auction to purchase its credit collateral assets. Acte de command has an important role for banks that have auctioned off their auctioned collateral. The auction is carried out in the context of paying off bad loans by debtors. In practice, there are banks that use Acte de command in situations where there are several other bidders who are interested in buying the bank's collateral. takeover of collateral through an auction by signing an agreement to take over the collateral between the bank and the debtor or making a notarial report of credit settlement, then proceed with making an Acte de Command, which is a statement between the buyer appointed by the bank (usually a bank employee) and the debtor which states that the buyer is acting buying collateral is done for the benefit of another party whose name will be determined at a later date who is appointed to replace the buyer. The legal issue in this thesis is the obscurity of norms, because not all banks in Indonesia use de command deed for the auction process. Collateral goods purchased must be sold no later than 1 (one) year. If the parties to the deed are in default, then proceed with the court process and the goods guaranteed will be auctioned, and if the maximum time limit for the de command expires, the deed will be canceled or forfeited

Abstract

There have been differing views on the administrative court’s absolute competence in reviewing abuse of authority cases under Law No. 30/2014 on Government Administration (Government Administration Law). This article seeks to uncover the legal politics and principles underlying the grant of absolute competence to the administrative court in reviewing abuse of authority cases. The uncovered legal politics and principles will then be used to analyze the regulation of objects, subjects, and the limits of the administrative court’s authority under Supreme Court Regulation No. 4/2015. The study’s findings concluded that the underlying idea behind the grant of authority to the administrative court in reviewing abuse of authority cases is to ensure legal certainty and protection for government officials in the exercise of their duties and authorities as stated under Art. 17 to Art. 21 of the Government Administration Law. The legislators shifted their anti-corruption law approach from a criminal-based approach to an administrative-based approach that prioritizes the recovery of state funds and enforcing administrative sanctions. Conceptually, this new model of anti-corruption law enforcement is founded on three principles: the presumption of legality, the presumption of administrative violation, and the ultimum remedium principle. Finally, Supreme Court Regulation No. 4/2015’s regulation of objects, subjects, and limits on administrative court authority contradicts the legal-philosophical idea underlying Art. 17 to Art. 21 of the Government Administration Law. Abtrak Sampai saat ini, masih beragam pandangan mengenai eksistensi kompetensi absolut peradilan tata usaha negara (peratun) dalam pengujian penyalahgunaan wewenang dalam UU No. 30/2014 tentang Administrasi Pemerintahan (UU AP). Artikel ini bertujuan untuk menemukan gagasan filosofis politik hukum dan prinsip-prinsip dalam pemberian kompetensi absolut kepada peratun dalam pengujian penyalahgunaan wewenang dalam UU AP sekaligus sebagai pisau untuk menganalisis pengaturan objek, subjek, dan pembatasan kewenangan PTUN dalam Perma No. 4/2015. Hasil kajian menyimpulkan, pertama, gagasan filosofis politik hukum pemberian kompetensi absolut kepada PTUN dalam pengujian penyalahgunaan wewenang bertujuan untuk memberikan kepastian hukum dan perlindungan hukum kepada pejabat pemerintahan dalam melaksanakan tugas dan wewenangnya sebagaimana diatur dalam Pasal 17 s.d. Pasal 21 UU AP. Pembentuk UU mengubah cara pandang hukum pemberantasan korupsi yang sebelumnya mengutamakan ‘pendekatan penindakan pidana’ menjadi ‘pendekatan administratif’; dari pendekatan yang ‘mengutamakan penghukuman pidana penjara’ menjadi ‘mengutamakan pengembalian uang negara’ dan ‘penegakan sanksi administratif’. Secara konseptual, model baru penegakan hukum tersebut memiliki basis teoretis yaitu asas praduga rechtmatige, asas praduga pelanggaran administratif, dan asas ultimum remedium. Kedua, pengaturan objek, subjek, dan pembatasan kewenangan PTUN dalam Perma No. 4/2015 tidak sesuai dengan gagasan filosofis politik hukum dan bertentangan dengan prinsip-prinsip dalam Pasal 17 s.d. Pasal 21 UU AP.

Abstract

The aim of this service is to prevent bullying from occurring. Bullying is common among teenagers. Bullying is any form of oppression or violent acts carried out intentionally by one person or a group of people with the aim of hurting and carried out continuously. Sometimes the perpetrator of bullying is not aware that his actions constitute bullying. There are several types of bullying, physical bullying and verbal bullying, physical bullying can be recognized by the presence of wounds or bruises, but verbal bullying is difficult to identify, verbal bullying such as mocking, insulting, giving negative nicknames, making fun of etc. . From data obtained from the Child Protection Commission, bullying is increasing every year. The impact of this act of bullying is very dangerous. Victims of bullying can become insecure, feel inferior, get emotional easily and can even have the intention to commit suicide. For this reason, through the implementation of this service, it is hoped that bullying can be prevented among students at SMP Negeri 21, East Tanjung Jabung Regency.

Abstract

The overcapacity of correctional institutions in Indonesia has led to various complex humanitarian, legal and social problems. One of the solutions pursued by the government is the assimilation policy, which aims to reduce the capacity burden while encouraging the social reintegration of prisoners. However, the implementation of this policy is often trapped in a legalistic-formal approach that ignores aspects of substantive justice. This article examines the implementation of the assimilation policy in the perspective of progressive law, which places law as a means of social transformation, not merely a normative rule. Through normative legal research methods with statutory, conceptual, and philosophical approaches, this article finds that the progressive legal approach plays an important role in encouraging assimilation policies that are more humanist, inclusive, and just. Progressive law emphasizes the importance of rehabilitation, community participation, and protection of prisoners' rights as part of the development process. In addition, concrete support is needed in the form of job training programs, psychosocial assistance, and fair and transparent supervision. By emphasizing the principles of justice, humanity and social benefit, the implementation of progressive law-based assimilation can reduce stigma against prisoners and create a more dignified correctional system. The results show that the success of the assimilation policy is greatly influenced by the synergy between an adaptive legal approach and strong social participation. In conclusion, progressive law can be an effective foundation for reforming correctional policies to be more oriented towards recovery, not just punishment
