Abstract

This article aims to examine the correlation between the concept of proper enforcement of the law as stipulated in Article 5 (2) of the 1945 Constitution of Indonesia and the establishment and implementation of government regulation on environment and forestry. This article is a normative legal research with statute, historical, and conceptual approaches. The result shows that proper legal enforcement means two things, namely, establishment and enactment of government regulation by the President and the content of the regulation that does not contradict the law. Failure to comply with the law means the President does not establish or enforce a government regulation as mandated or the content of the regulation is not in line with the law.  If the President does form or enforce the implementation of government regulation, this means that the President violates his oath and promise to uphold the Constitution and to serve the nation. If the content of the regulation contradicts with the law, it can be canceled. In this situation, the government needs to realign the content of existing regulations. The ministry involved in legal drafting is called to oversee the content and follow through with revisions. All party involves in the making of law and regulation, such as the People Representatives, the President, or the Minister, is reminded to carefully formulate a government regulation.

Abstract

Adanya perbedaan penafsiran atas norma PTDH PNS yang melakukan kejahatan jabatan berdasarkan putusan pengadilan incraht sebelum berlakunya UU ASN, menyebabkan terjadinya perbedaan penerapan penegakan hukum dalam praktik (ada yang diberhentikan tidak dengan hormat, diberhentikan dengan hormat, atau tidak diberhentikan). Perbedaan juga tercermin dalam9 putusan pengadilan di lingkungan PERATUN atas gugatan PTDH PNS, baik di tingkat judex facti maupun judex juris. Ada gugatan yang dikabulkan, ditolak, atau dinyatakan tidak diterima. Persoalan-persoalan hukum yang muncul dalam putusan hakim di lingkungan PERATUN, bersifat mendasar dan strategis dalam menentukan maju mundurnya pembangunan hukum administrasi Indonesia yang pondasinya telah diatur dalam UU No. 30/2014 tentang Administrasi Pemerintahan.

Abstract

The debate on the absolute competency of the State Administrative Court in Indonesia to set the dispute over the State Financial Losses Report (LHPKKN) is proved to have caused dissenting opinion. The judgments between one administrative court to other court in Indonesia cause main problem of achieving justice and legal certainty. This research examines the issue of absolute competence of the Administrative Court in adjudicating disputes on the State Financial Losses Report published by the Financial and Development Monitoring Agency (BPKP). This article uses normative legal research and implement the statute approach, conceptual approach, and case approach. These approaches are used to discern and analyze several related legal materials or documents scientifically. The aims and objectives of this research are to find a legal solution on how this classic issue has to be approached and solved. As a result, it is found through this article that the Administrative Court has absolute competence in deciding disputes on the Report on the Calculation of State Financial Losses issued by the Financial and Development Monitoring Agency, which is supported by several fundamental reasons.

Abstract

This paper examines the synchronization of legal regulations in forestry, green farming, and mining sectors along with their implementation regulations. The certainties of the existence of customary law community in Legal Acts No. 41 year 1999 concerning Forestry does not give certainties for customary law community in managing forest in Indonesia. Meanwhile, Legal Acts No. 6 year 2014 about Village stresses out that there is a specific acknowledgement about local customary village as a part of Customary Law Community. In the Legal Acts about Village, the establishment of Customary Law Community is strongly stated in provincial government regulations. This paradox has brought a bad consequence to customary forest that is managed by customary law communities in Jambi province.

Abstract

This article discusses juridical implications about the regulation of state-owned enterprises (BUMD) after the enactment of the Law Number 23 Year 2014 about Regional Government (Regional Government Law 2014) and the application on regulation of BUMD in Jambi Province. Research methode in this study is normative juridical with law approach. Based on the results of the study are known, the enactment of Regional Government Law 2014 has implications for the existence and regulations of existing and future of BUMD, namely in terms of form and naming of BUMD; organ of BUMD; tenure of directors and councils; and intervention of DRPD (Regional People’s Representative Assembly) on BUMD operations. The result of the study also shows that not one regional government in Jambi Province that followed up on the mandate of the article 402 paragraph (1) Regional Government Law 2014 to adjust the regulation of BUMD, and that’s why it is potentially contradicting with Regional Government Law 2014 and central government policy. Abstrak Artikel ini membahas implikasi yuridis pengaturan Badan Usaha Milik Daerah (BUMD) pasca berlakunya Undang-Undang Nomor 23 Tahun 2014 tentang Pemerintahan Daerah (UU Pemda 2014) dan penerapannya pada regulasi BUMD di lingkungan Provinsi Jambi. Metode penelitian yang digunakan adalah yuridis normatif dengan pendekatan perundang-undangan. Berdasarkan hasil kajian diketahui, berlakunya UU Pemda 2014 berimplikasi terhadap eksistensi dan regulasi BUMD baik yang telah ada maupun yang akan dibentuk, yaitu dalam hal bentuk hukum dan penamaan BUMD; persyaratan pendirian dan kelayakan usaha BUMD; penyertaan modal daerah dan kepemilikan modal dalam BUMD; organ BUMD; masa jabatan Direksi dan Dewas/Deris; dan campur tangan DPRD dalam operasional BUMD. Hasil penelitian juga menunjukkan belum ada satu pun Pemda di lingkungan Provinsi Jambi yang menindaklanjuti amanat Pasal 402 ayat (1) UU Pemda 2014 untuk menyesuaikan regulasi BUMD, dan dengan demikian potensial bertentangan dengan UU Pemda 2014 dan kebijakan pemerintah pusat.

However, the UUPT and POJK only regulates tbk companies, and does not regulate non-tbk companies, and does not explain the mechanism of the GMS. electronically. The aims of this research are: (1) To find out the arrangement for the implementation of the General Meeting of Shareholders of a Non Public Company through Telekonferensi in the perspective of legislation. Abstract

There is no regulation limiting the number of deeds made by a Notary in the perspective of the notary position regulation. What is the authority of the Central Honorary Council in imposing sanctions on a notary who issues a deed that exceeds the normal limit. This study uses a normative juridical method. The results of this study are that the making of a Notary deed is regulated in the provisions of Article 38 of the UUJN, and the provisions of making 20 (twenty) deeds per day according to the Regulation of the Honorary Council of the Indonesian Notary Association Number 1 of 2017 in ensuring the certainty of the date and time determined by the provisions The Law on Notary Positions is in compliance. If the notary violates this DKP regulation No. 1 of 2017 concerning the reasonable limit for making a notary deed per day, besides being subject to ethical sanctions for violating KEN regulations, notaries can also be subject to administrative sanctions for not complying with UUJN orders. Notaries who commit such violations can be the object of summons and examination from the Regional Honorary Council according to their level of authority, DKD has the right to summon and examine notaries who are indicated to have committed violations either based on reports or direct findings, DKD is also authorized to give direct sanctions or provide results of examinations to be carried out further examination to the Regional Honorary Council.

Dalam hal ini telah diatur dalam Undang-Undang Nomor 40 Tahun 2007 tentang Perseroan Terbatas dan Peraturan OJK Nomor 16 Tahun 2020. Namun dalam UUPT maupun POJK tersebut hanya mengatur mengenai perusahaan tbk, dan tidak mengatur mengenai perusahaan non-tbk, serta tidak menjelaskan mekanisme RUPS secara elektronik perusahaan non-tbk. Tujuan dari penelitian ini adalah: (1) Untuk mengetahui Pengaturan Pelaksanaan Rapat Umum Pemegang Saham Perusahaan Non Terbuka melalui Telekonferensi dalam persepektif perundang-undangan. Abstract

There have been differing views on the administrative court’s absolute competence in reviewing abuse of authority cases under Law No. 30/2014 on Government Administration (Government Administration Law). This article seeks to uncover the legal politics and principles underlying the grant of absolute competence to the administrative court in reviewing abuse of authority cases. The uncovered legal politics and principles will then be used to analyze the regulation of objects, subjects, and the limits of the administrative court’s authority under Supreme Court Regulation No. 4/2015. The study’s findings concluded that the underlying idea behind the grant of authority to the administrative court in reviewing abuse of authority cases is to ensure legal certainty and protection for government officials in the exercise of their duties and authorities as stated under Art. 17 to Art. 21 of the Government Administration Law. The legislators shifted their anti-corruption law approach from a criminal-based approach to an administrative-based approach that prioritizes the recovery of state funds and enforcing administrative sanctions. Conceptually, this new model of anti-corruption law enforcement is founded on three principles: the presumption of legality, the presumption of administrative violation, and the ultimum remedium principle. Finally, Supreme Court Regulation No. 4/2015’s regulation of objects, subjects, and limits on administrative court authority contradicts the legal-philosophical idea underlying Art. 17 to Art. 21 of the Government Administration Law. Abtrak Sampai saat ini, masih beragam pandangan mengenai eksistensi kompetensi absolut peradilan tata usaha negara (peratun) dalam pengujian penyalahgunaan wewenang dalam UU No. 30/2014 tentang Administrasi Pemerintahan (UU AP). Artikel ini bertujuan untuk menemukan gagasan filosofis politik hukum dan prinsip-prinsip dalam pemberian kompetensi absolut kepada peratun dalam pengujian penyalahgunaan wewenang dalam UU AP sekaligus sebagai pisau untuk menganalisis pengaturan objek, subjek, dan pembatasan kewenangan PTUN dalam Perma No. 4/2015. Hasil kajian menyimpulkan, pertama, gagasan filosofis politik hukum pemberian kompetensi absolut kepada PTUN dalam pengujian penyalahgunaan wewenang bertujuan untuk memberikan kepastian hukum dan perlindungan hukum kepada pejabat pemerintahan dalam melaksanakan tugas dan wewenangnya sebagaimana diatur dalam Pasal 17 s.d. Pasal 21 UU AP. Pembentuk UU mengubah cara pandang hukum pemberantasan korupsi yang sebelumnya mengutamakan ‘pendekatan penindakan pidana’ menjadi ‘pendekatan administratif’; dari pendekatan yang ‘mengutamakan penghukuman pidana penjara’ menjadi ‘mengutamakan pengembalian uang negara’ dan ‘penegakan sanksi administratif’. Secara konseptual, model baru penegakan hukum tersebut memiliki basis teoretis yaitu asas praduga rechtmatige, asas praduga pelanggaran administratif, dan asas ultimum remedium. Kedua, pengaturan objek, subjek, dan pembatasan kewenangan PTUN dalam Perma No. 4/2015 tidak sesuai dengan gagasan filosofis politik hukum dan bertentangan dengan prinsip-prinsip dalam Pasal 17 s.d. Pasal 21 UU AP.
