Abstract

Crime of decency cannot be measured by age or characteristics because anyone can do it, including children. Actions that can be categorized as violating decency include intercourse. The crime of sexual intercourse is regulated in the Criminal Code articles 286-288 and regulated in the Child Protection Law Article 81. Sexual intercourse with children at the Batu Police is still some cases. This study aims to determine a series of investigators' actions to find and collect evidence of cases of sexual intercourse with children as perpetrators by the Batu City Police. The research method used is juridical sociology by looking at the law as human behavior in life. Batu City Police research location. From the results of this study, it can be concluded that a series of investigators' actions in investigating cases of sexual intercourse with children as perpetrators at the Batu City Police in general can be said to have not been maximized, there are still obstacles in practice such as (1) the time period from the report to the investigation stage cannot be ascertained, (2) there are obstacles in the examination of victims, some victims are reluctant to provide information, (3) the examination of witnesses becomes an obstacle because the crime of sexual intercourse is carried out in places that are rarely or known to witnesses, (4) examination of child suspects in practice the police have not used the familial method, (5) the arrests made by the investigators of the Batu City Resort Police were judged not to be in accordance with the provisions of the SPPA Law Article 30 paragraph (4) and strengthened by Perkap No. 8 of 2009 Article 21 letter d, (6) in the Bapas examination there was an error in the case file provided by the police and in the collection there were still obstacles, (7) lack of knowledge about the importance of the post-mortem this could have an impact on the results of the investigation.

Abstract

The principle of the presumption of innocence is one of the principles regulated in the Criminal Procedure Code (KUHAP). The application of the principle of the presumption of innocence is closely related to the application of rights to individuals, for example to suspects in the crime of theft who are in the process of being investigated. The regulation of these rights is regulated concretely in the Criminal Procedure Code. However, despite this, the application of the principle of the presumption of innocence in this case the application of the rights of the suspect during the arrest and detention process is still not given much attention by police investigators. Therefore, the researcher raised two problem formulations. First, how is the application of every person arrested for committing the crime of theft to be considered innocent until there is an Inkracht Decision at the Pamekasan Police Resort. Second, how is the application of every person who is detained for the crime of theft must be considered innocent until the Inckracht Decision is made by the Pamekasan Resort Police. The research method used is a sociological juridical approach. It can be concluded that in the application of rights in the arrest process, two rights have not been implemented by the Pamekasan Police investigators, namely the suspect's right to ask the investigator to show an arrest warrant (Article 18 paragraph (1) KUHAP) and regarding the right for the family of the arrested suspect to receive a copy of the letter. an immediate arrest order (article 18 paragraph (3) KUHAP). While in the detention process, two rights have not been implemented, namely those related to the suspect's right to give information freely (article 52 KUHAP) and the suspect's right to obtain legal assistance and law enforcers are required to appoint legal counsel (article 54 KUHAP)

Abstract

This research was to determine the form of providing protection for children's rights as victims of the crime of sexual intercourse during the investigation stage. This study uses a sociological juridical method with an empirical legal approach that describes the actual conditions that live in society. Data was collected by direct observation at the Criminal Investigation Unit of the PPA Police of the Batu City Resort Police, interviews with investigators and other related parties. The data analysis technique is the investigation of children's rights as victims of criminal acts of sexual intercourse based on Law no. 11 of 2012 concerning the Juvenile Criminal Justice System. The results of this study are that in the investigation process there are still obligations for children's rights that are not given or fulfilled, such as children being free from treatment that demeans their dignity and getting social advocacy assistance from child social workers during examinations at the police to determine physical, psychological and psychosocial conditions. The child is a victim of a crime of sexual intercourse.

Abstract

Keanekaragaman harus menjadi kekayaan dan bukan hanya sekedar beda yang satu. Tulisan ini mencoba menjelaskan problem doktrin hukum formal Negara (Konstitusi) yang mengatur tentang hubungan antara Ras (Keturunan atau Etnik) yang ada di Indonesia. Hukum tentang pengaturan Ras (Keturunan atau Etnik) di Indonesia, tidak bisa dilihat dari perspektif  baik dan buruk saja, tetapi hukum pengaturan Ras (Keturunan atau Etnik) di Indonesia harus dilihat dalam perspektif benar dan salah. Antara ketentuan satu dengan yang lainnya masih saling bertentangan yang menjadi penyebab problem konstitusional ketidakteraturan hukum yang mengatur jaminan hak dan kewajiban bagi WNI ras dan etnis China secara sejajar dengan WNI asli. Pembedaan WNI asli dan tidak asli menjadi bukti problem ketidakteraturan hukum yang menjustifikasi Rasisme di Indonesia. Hal ini mengakibatkan perbedaan perlakuan dari penyelenggara Negara terhadap WNI tidak asli dari ras dan etnis China dalam bidang sosial, budaya, agama, kependudukan dan keimigrasian.

Abstract

Working is not only for the sake of earning money, nor is it for the sake of fitting professional rationality. It goes beyond what it appears to be; it represents observances of God. That is, occupations should be seen from a wider perspective implying that it also considers spiritual, immaterial, and material dimensions. The spiritual scope represents the responsibility of humans to their God; the material scope is understood as working for a family, society, the state, and the nation. An occupation carries the spiritual value that represents the social behavior of bearing the responsibility for a job. Mental and social aspects in an occupation carry another meaning of social justice for all Indonesian laborers. Government Regulation in Lieu of Law Number 2 of 2022 concerning Job Creation, apart from pushing and urging attitude calling for its formulation and pragmatic needs that remain problematic in the eye of society in general, needs testing and reviewing fundamentally from the perspective of social justice principle for all Indonesian laborers. This study is focused on the analysis of the substance of Government Regulation in Lieu of law concerning Job Creation seen from the perspective of social justice for all the workers concerned. This study employs philosophical, conceptual, and statutory approaches to delve into the typical principle of justice in Government Regulation in Lieu of Law concerning Job Creation.

Abstract

This article discusses the integration between the ratio of justice and a sense of justice in strengthening bioethical values ​​and Islamic law. The ratio of justice is based on applicable legal norms, while the sense of justice is based on human feelings or intuition. Justice, one of the values ​​of bioethics, shows no conflict with the Islamic religion, and it is needed because bioethics emphasizes thinking development to determine the good and bad sides or ethical dimensions of biological aspects, including medical matters related to life. By approaching cases through concrete examples such as the spread of HIV/AIDS, which mainly occurs due to infidelity, positive criminal law and Islamic law have different ratios of justice and sense of justice. Sanctions in Islamic law tend to be more severe, with the application of stoning to perpetrators of adultery. However, the balance between the ratio of justice and the sense of justice here must consider the medical and beneficial impacts on society.

Abstract

Perlindungan preventif menjadi salah satu hal penting yang harus diperhatikan dalam rangka memberikan perlindungan yang lebih baik bagi konsumen dalam penggunaan layanan jasa keuangan. Otoritas Jasa Keuangan (OJK) sebagai lembaga yang bertanggung jawab dalam mengatur dan mengawasi sektor jasa keuangan di Indonesia, telah mengeluarkan berbagai peraturan dan kebijakan untuk memberikan perlindungan preventif bagi konsumen. Penelitian ini bertujuan untuk mengkaji pentingnya perlindungan preventif yang diberikan oleh OJK dalam rangka melindungi konsumen jasa keuangan. Metode yang digunakan dalam penelitian ini adalah penelitian kepustakaan dengan mengumpulkan data dan informasi dari sumber-sumber yang relevan. Hasil penelitian menunjukkan bahwa perlindungan preventif oleh OJK sangat penting dalam melindungi hak-hak konsumen jasa keuangan. OJK memiliki peran penting dalam mengatur dan mengawasi pelaku usaha jasa keuangan, termasuk dalam hal penyediaan layanan pinjaman online. OJK mengeluarkan peraturan-peraturan yang mengatur mengenai persyaratan dan kewajiban bagi pelaku usaha jasa keuangan dalam menjalankan bisnisnya. Hal ini bertujuan untuk mencegah terjadinya penyalahgunaan data pribadi konsumen dan melindungi kepentingan konsumen dalam penggunaan layanan jasa keuangan.

Abstract

A healthy life is a sense of well-being due to fulfilling all needs within reasonable limits so that physical and mental health can be realized from various life stages. People still interpret healthy life according to their thoughts and understanding, which cannot be separated from beliefs, family values, and culture; they still choose to use alternative medicine instead of modern medicine. This research aims to understand the community's actions in interpreting a healthy life that prefers alternative medical practices compared to modern medical practices. The research method used is a qualitative approach with a phenomenological research type. This study used a purposive technique with four people as subjects who used alternative medicine facilities. Data collection techniques using observation, interviews, and documents. The data analysis method used is proprietary data analysis to analyze field data, while the data validation method uses triangulation. The results of this study are based on the dimensions of awareness, experience, suggestions, believed; the meaning of a healthy life with alternative medicine is not only physical (physical) health but non-physical (spiritual) health as well. Alternative medicine is a unique and holistic treatment. The process of creating a healthy life begins with the human element itself, which starts with the seeds, weight, and calves in the process of the human life cycle from birth to death in behaviour and science.

Abstract

This article explores the critical relationship between justice, feminist jurisprudence, and legal pluralism in the context of Indonesia's multilayered legal system. While classical legal philosophy particularly Aristotelian thought has long conceptualized justice in terms of distributive and corrective fairness, such frameworks often fall short in addressing systemic gender inequality. In societies marked by legal pluralism, including Indonesia, women remain structurally marginalized within state law, customary law, and religious law. This study examines how feminist jurisprudence provides an alternative lens for reinterpreting justice by centering the lived experiences of women and exposing patriarchal power structures embedded in legal institutions. Feminist jurisprudence challenges the presumed neutrality of law, revealing its complications in reinforcing male dominance and silencing women's voices. In the plural legal landscape of Indonesia, patriarchal norms are often preserved through the state's accommodation of discriminatory practices under the guidance of respecting cultural traditions or religious autonomy. Customary inheritance laws, the positioning of women in marriage, and religious family law disproportionately disadvantage women. Despite formal legal reforms such as the enactment of the Domestic Violence Law and the Sexual Violence Law, implementation remains hindered by institutional gender bias and cultural resistance. By integrating feminist legal theory into the discourse on justice, this paper advocates a shift from formal equality to substantive, transformative justice. Legal pluralism, rather than being a neutral space of cultural expression, must be critically interrogated to prevent the legitimization of systemic gender oppression. Ultimately, the article argues that feminist jurisprudence offers both a theoretical and practical pathway for reconstructing inclusive legal systems that uphold the rights and dignity of women in pluralistic societies.

Abstract

Keadilan merupakan salah satu nilai fundamental dalam Pancasila yang seharusnya menjadi dasar dalam pembentukan dan implementasi sistem hukum nasional. Namun, dalam praktiknya, sistem hukum di Indonesia belum sepenuhnya merefleksikan nilai-nilai keadilan Pancasila secara konsisten dan menyeluruh. Penelitian ini bertujuan untuk mengkaji secara mendalam konsep keadilan dalam perspektif nilai-nilai Pancasila dan menganalisis relevansi serta implementasinya dalam sistem hukum Indonesia kontemporer. Metode yang digunakan adalah pendekatan yuridis-filosofis dalam kerangka penelitian hukum normatif, dengan analisis terhadap konsep keadilan tidak hanya sebagai prinsip formal, tetapi juga sebagai ekspresi nilai etis, budaya, dan moral bangsa Indonesia. Hasil penelitian menunjukkan bahwa keadilan dalam Pancasila memiliki sifat holistik dan kontekstual, menekankan keseimbangan antara hak dan kewajiban, antara individu dan masyarakat, serta mengedepankan kemanusiaan dan musyawarah. Implikasinya, diperlukan penguatan internalisasi nilai-nilai Pancasila dalam proses legislasi, penegakan hukum, serta reformasi hukum nasional agar tercipta sistem hukum yang adil, humanis, dan mencerminkan kepribadian bangsa Indonesia
