Abstract

The sovereignty of a country is the highest power state of that country how to govern and enforce the law in the territory. As one of the largest country in the world, Indonesia was not sovereign over the territory, in particular airspace. The airspace of Riau Islands and Natuna until 1946 is controlled by Flight Information Region (FIR) Singapore. It means that every flight in that airspace must received permission from Singapore, including Indonesia itself. Indonesia is supposed to be ruling all of Indonesia territory without delegating to any party.According to above description, The author is interested to doing research with the title Implication of the International law in Flight Information Region Upper the Airspace of Indonesia Againts Sovereignty of the Republic of Indonesia. This thesis aims to determine how the navigation settings in Indonesia. Furthermore, to determine the implications of the delegation the airspace of Riau Islands and Natuna to Singapore FIR against Indonesian sovereignty.In the thesis, the author uses the method of normative legal research. Data sources supported by the data source of primary, secondary and tertiary. While data collection techniques is the study of literature and study data using deductive method is to analyze the problems of a general nature and then drawn to a conclusion in particular based on existing theory.The results of the discussions in this thesis is, first, Flight navigation settings in Indonesian airspace divided into three, namely, Jakarta FIR which covers the western part of the Borneo island to the western part of Indonesia began western part of Central Java and Christmas Island belongs to Australia. Ujung Pandang FIR covers the eastern part of Indonesia, ranging from the eastern part of the island of Borneo, and East Java up to Papua, plus one FIR Singapore covering airspace Riau and Natuna Islands, which is divided into three sectors, namely A, B and C. Second, the implications of the delegation of airspace and Natuna the Riau Islands to Singapore FIR against Indonesia is divided into three, namely, the first in the fields of politics will affect the position of Indonesia in the civil aviation of world that have an impact on the public's view of the ability of Indonesia, especially in the flight will be low-cost. In economics, income from fee of airspace across Riau Islands and Natuna is not achieved by Indonesia as full as must be, because Singapore collects the fee does not provide the transparency of the number of flights across the region. Finally, in the field of defense and security, Indonesia must be vigilant because the area is also used by Singapore to conduct military exercises. Abstract

Self-defense is a form of human nature in protecting themselves from the various threats that could threaten the life safety, morals, and property belonging to themselves. But sometimes the defense is done in case of emergency could have provide disadvantage to other people so that their excessively limits on defenses (noodweer excess). The regulation of self-defense in urgent situations regulated in Pasal 49 the KUHP. In the article it is said that a person who has committed to the defense of life, morals or property belongin to either for themselves or another person can not be convicted.Decision of Pengadilan Tinggi Palembang No. 170 / Pid / 2011 / PT.PLG, Decision of Pengadilan Negeri Lubuk Linggau No. 794 / Pid.B / 2014 / PN LLG and Decision of Pengadilan Negeri Semarang No. : 1002 / Pid.B / 2008 / PN. SMG, has implemented Pasal 49 KUHP within the judge's ruling, which the judge gave the accused acquitted because the judge found the element of justification of the actions undertaken so that the perpetrators can not be held accountable.But in contrast to Decision of Pengadilan Tinggi Pekanbaru No. 09 / Pid.B / 2013 / PTR because the judge did not apply Pasal 49 paragraph (2) KUHP. Ratna (the murder in self-defense) was sentenced to imprisonment for 2 years and 6 months. Abstract

Criminal action is prohibited by a rule of law that is accompanied by threats (sanctions) in the form of spesific criminal against those who violate.a ban was intended to act where a situation or incident caused by the behavior itself. Whereas criminal threats addressed to the people who bring it.of the above cases has taken law enforcement.a precess that has been done is the investigation by the police resort Rokan Hulu. But, unfortunately the process of invistigations conducted by the police did not run smoothly because there are many problems and issues found in field.This research is a sociological law.whereas seen from the desciptive nature of this study, the research provides a clear and detailed picture of the problems studied by authors, namely the role of the police investigations criminal resort Rokan Hulu towards the investigations of criminal trial (poging). Everyone who suffered, saw, witnessed and or become victims of the events that constitute a criminal offense has the right to file a police report or complaint to both oral and written. As well as for people who know a conspiracy to commit a crime, immediately the order to report to the police. Then civil servants in order to carry out their duties knowing about the events that constitute a criminal offense shall immediately report it to the police.When conducting the investigations of criminal cases experiments conducted by the police of conducting enforment investigations, prosection, arrest, detenion, searches, seizure, examination of suspects and witnesses. Barriers that occur when performing investigations poging criminal casses such as: personnel where the lack of part of the investigation, where the quality of human resources in order to have high quality in the task as law enforcement officers, minimal infrastructure and aquipment during processing the scene is not as complete as that owned by police. Efforts made to overcome obstacles in the investigation is to conduct socialization, being open, coaching members of an adequate education and supporting infrastructure that supports.Key words: investigation, police, crime, arrest, poging.

Abstract

The criminal act of corruption is considered an extraordinary crime, evencorruption in Indonesia is now considered to be no longer a domestic issue, but hasbecome a cross border or transnational crime. The attempt to escape abroad is a modecomitted by corruption actor to avoid legal process. Generally the targeted countriesare countries that do not yet have an extradition treaty with Indonesia. As internationalcrime grows, the police in many parts of the world can not work alone, therefore thecooperation between the police and Interpol has an important role to capture andrepatriate fugitives who fled abroad. The purpose of this research are; first, to know theauthority that ICPO-Interpol has in cooperating with the Police State of The Republicof Indonesia to conduct searches and arrests of corrupt criminals who escaped abroad.Secondly, to find out if ICPO-Interpol can help catch fugitives who escaped to a countrythat does not have an extradition treaty with Indonesia. The type of research conductedis the normative legal research or literature, because the library material as the mainfocus in conducting research. This research is descriptive, that is a research describingclearly and detail about a problem.From the results of research problems there are two main things that can beconcluded. First, the authority of ICPO-Interpol in cooperation with the Police is toissue Notices sent by the Police through NCB-Interpol Indonesia and forward it to eachmember country. Secondly, Interpol can assist in returning fugitives escaped to othercountries that have no extradition treaty with Indonesia with Disguised Extradition orHanding Over, Mutual Legal Assistance (MLA) or through the police to police. Myadvice, first, Interpol cooperation in overcoming international crime more developed byadding member countries, for cooperation in handling international crime andtransnational crime become more effective. Secondly, Indonesia needs to improve andstrengthen the diplomatic network with other countries in the world to assist insupporting the performance of NCB-Interpol Indonesia.

Abstract

Issues of recognition of Indigenous People (which by the international world is translated by the term Indigenous Peoples (Ips) is a problem that has developed since Ke century - XIV. Indigenous Peoples (Ips) naturally have a genuine autonomy (original autonomous powers) and rights to land (entitlesmens to land). ILO Convention 107 of 1957 concerning Indigenous and Tribal Nations that assumes that the Indigenous People is the poorest people (Uncivilized Society) to be developed into a modern society. Protection of Land Rights of Indigenous People in the United Nations Declaration on Rights of indigenous peoples are reflected in Article 26, while the Protection of Land Rights of Indigenous People in Indonesia has been poured into the form of legislation relating to the recognition of Indigenous People in Indonesia. Terms of recognition of customary law communities along with their traditional rights is a form of acceptance tertinggi.Sampai state as an organization of power today, customary rights arrangements still sporadically scattered in various laws - laws in Indonesia, all of which are aimed at providing legal protection ofJOM Fakultas Hukum Volume 2 Nomor 2 Oktober 2015 2customary rights. But it becomes unclear and cause various interpretations which are not adequate with the aim, often negating the detriment of the rights of Indigenous People. Abstract

Online trading activity or what is called E-commerce is a transaction activity that uses electronic media as a means of connecting between business people and consumers, so that agreements or agreements that are created are through online. One example of items that are widely traded online is cosmetics. Cosmetic circulation is an activity or series of activities aimed at transferring hands, spreading cosmetics. So the right to circulate cosmetics is only certain people who already have a permit and criminal for those who distribute illegal cosmetics online without any permission based on Article 197 of Law No. 36 of 2009 concerning Health.Violations of illegal cosmetics sales sold online occurred in the 2017-2019 time span in Riau Province as many as 39 cases, this proves that there is urgency about the circulation of illegal cosmetics that circulate online in Riau Provision. Information on the illegal distribution of illegal cosmetics without online marketing authorization is obtained from public reports and / or BPOM Pekanbaru conducts surveys directly by monitoring both online through cyber patrols with takedown links and offline (Stores / sellers' houses operate). In this case BPOM Pekanbaru has the authority to conduct a search, seizure, crime scene, summons, examination, arrest and detention. BPOM Pekanbaru conducts law enforcement in the enforcement of online cosmetic product distribution practices in Riau Province, by coordinating with the PPNS / Police Korwas, Attorney's Office, District Court, Health Office, Satpol PP.The obstacle for the Pekanbaru Center for Drug and Food Control (BPOM) in enforcing criminal law against illegal cosmetics sellers without an online marketing permit is the lack of public awareness of the cosmetics content and the dangers to health, inadequate budgetary funds and inadequate human resources. . Abstract

The discourse on relocating the State Capital by the President of the Republic of Indonesiafrom Jakarta to East Kalimantan raises many pros and cons. Those who are pro thinkit is necessary to move the national capital to East Kalimantan considering that Jakarta bearstoo heavy a burden as the center of government, business center, financial center, trade centerand service center. Meanwhile, the contenders stated that it was not enough to relocatethe State Capital with the policy of the President as the highest authority in the country. Aclear regulation in the form of a Law must be issued immediately so that the President's discoursehas a clear legal basis. The President's policy without the support of regulations in theform of a Law on this project to relocate the State Capital is not the manifestation of a rule oflaw. On the other hand, in the concept of limiting power, the policy of relocating the StateCapital is deemed necessary to involve elements of other state institutions, especially in termsof legislation and regulationsThis research is a normative juridical research, which is based on legal and statutorymaterials. The approach taken includes a literature approach, namely by studying books andlaws and regulations. The type of data used is the type of premier data, secondary datasources, namely data sources that come from books and other regulations. The theory used inthis research is the theory of political law and the theory of separation of powers.From the results of the research, there are two main points that can be concludedwhere the political law desired by the constitution begins with the goal of the state, namelythe welfare of the public at large, which is contained in the preamble to the 1945 Constitution,especially regarding public participation. So the transfer of the nation's capital is not inaccordance with the goals of the nation and state as stated in the 1945 Constitution. whereMontesquieu divides executive, legislative and judicial powers. Although in principle the authorityis divided, in the formation of a law (uu the capital of the country) it must be based onmutual agreement between the president and the DPR. Meanwhile, the president's unilateralpolicies do not reflect proregative rights as stipulated in the 1945 Constitution and precludethe possibility of public participation. So if the old law has not been revoked / repealed, thelaw is still in effect and the president's policy is null and void because there is no binding legalbasis.Keywords: Law Politics, Rule of Law, Policy, UUD 1945.

Abstract

Saat ini pemenuhan hak kesehatan narapidana sulit dilaksanakan dikarenakan fasilitas yang kurang memadai dan juga masalah-masalah seperti kelebihan kapasitas. Hal tersebutb terjadi di hampir semua LAPAS seperti contohnya di Lembaga Pemasyarakatan Klas II A Pekanbaru. Di dalam Lembaga Pemasyarakatan Klas II A Pekanbaru hak kesehatan narapidana cukup sering tidak terlaksana seperti yang diamanatkan oleh Undang-Undang Nomor 12 Tahun 1995 Tentang Pemasyarakatan. Seperti tidak adanya pemeriksaan kesehatan 1 (satu) kali dalam 1 (satu) bulan yang diakibatkan oleh jumlah narapidana yang tidak sebanding dengan jumlah petugas yang ada. Kemudian hak untuk mendapatkan perawatan khusus juga tidak tercapai dikarenakan fasilitas yang kurang memadai sehingga sulit bagi petugas untuk melayani dengan maksimal. Dari hasil penelitian diperoleh kesimpulan bahwa kegiatan yang dilakukan di dalam Lembaga Pemasyarakatan Klas IIA Pekanbaru dilakukan beberapa upaya yaitu upaya pencegahan dan penanggulangan untuk mengatasi masalah pemenuhan hak kesehatan ini. Upaya pencegahan berupa memberikan penyuluhan kesehatan dan mengadakan aktivitas olahraga, sementara upaya penanggulangan adalah berupa pemberian obat pada narapidana yang sakit.Kata Kunci : Penerapan -Lembaga Pemasyarakatan Terbuka-Hak Narapidana

Abstract

Lately, the destruction of forests has become more widespread and complex. The destruction occurs not only in production forests but has also penetrated into protected forests or conservation forests. Forests encroachment is a forest clearing activity for the purpose of owning, controlling, and utilizing forest product regardless of the basic function carried by a forest area. Illegal occupation of forest land, forest use deviating from its function, and irresponsible forest exploitation are severely damaged. The losses incurred by forest encroachment are enormous, the country losing billion and even trillions of rupiah. In addition to economic losses of forest products taken by encroachers uncontrollably and ignoring sustainable principles, the enormous environmental damage is very large and has extraordinary impact on forests ecosystem imbalances.This study uses a kind of sociological juridical research that sees the correlation between law and society. This research was conducted at Sub Directorate IV of Directorate of Special Criminal Investigation of Riau Regional Police, while population and sample are all related parties in problem to be studied. Sources of data used, primary data, secondary data, and tertiary data, data collection techniques in this study by interviews, and literature review.From the research there are three main points that can be concluded. The first, criminal investigation of forest encroachment based on Law Number 18 of 2013 on Prevention and Eradication of Forest Destruction by Directorate of Special Criminal Investigation of Riau Regional Police, is still not running properly that has been regulated in legislation. Secondly, obstacles in the criminal investigation of forest encroachment based on Law Number 18 of 2013 on Prevention and Eradication of Forest Destruction by Directorate of Special Criminal Investigation of Riau Regional Police, are financial obstacles, obstacles of facilities and infrastructure, obstacles to bring in forestry experts, lack of public legal awareness, and geographical factor. Third, efforts to overcome obstacles in the criminal investigation of forest encroachment based on Law Number 18 of 2013 on Prevention and Eradication of Forest Destruction by Directorate of Special Criminal Investigation of Riau Regional Police, are propose additional operational costs, adding facilities and infrastructure, coordinate or communicate with experts, and raising public awareness of forest legislation.Key Words: Investigation – forestry crime – forest encroachment

Abstract

Criminal acts constitute a criminal act that can be sentenced, any act that is threatened as a crime, a violation of either the Criminal Code or any other legislation. The defamation law or defamation through social media is a special criminal act whose legal sanction is regulated outside the Criminal Code, namely Law number 19 of 2016 regarding the amendment to Law Number 11 Year 2008 concerning Information and Electronic Transactions, as mentioned in Article 27 paragraph (3) stating: "Every person intentionally and without right to distribute and / or transmit and / or make accessible Electronic Information and / or Electronic Documents with defamatory and / or defamatory content. A person who is proven intentionally disseminating defamatory electronic information as meant in Article 27 paragraph (3) of Law Number 19 of 2016 concerning the amendment to Law Number 11 Year 2008 concerning Information and Electronic Transaction shall be charged with Article 45 Paragraph (1) of the ITE Law which states: Any Person who fulfills the elements as referred to in Article 27 paragraph (1), paragraph (2), paragraph (3), or paragraph (4) shall be punished with imprisonment for a maximum of 4 (six) years and / Or a fine of not more than Rp 650,000,000.00 (one billion rupiah). Problems and objectives to be discussed in this thesis is to know how the investigation of criminal defamation through online media conducted by the Directorate of Special Criminal Investigation Polda Riau.This type of research is sociological, because in this study the authors directly conduct research on the location or place studied in order to provide a complete and clear picture of the problem under study. This research was conducted at the Directorate of Special Criminal Investigation of Riau Police, while the population and sample were all parties related to the problem studied in this study, data source used, primary data, secondary data and tertiary data, data collection techniques in this study with Interviews, questionnaires and literature studies.From the results of the study can be concluded that the investigation by the Directorate of Special Criminal Investigation Polda Riau as not yet carry out the task Maximum. Personnel, expert staff and special facilities devoted to the investigation and investigation process are inadequate. With the lack of personnel and facilities is causing it difficult to overcome cases of defamation through this online media.
