Abstract

The narcotics crime shows the development of increasingly rapid. It is just not the very poor condition of wearer but also the industry as a dark against narcotic drugs and psychotropic substances is thus the largest in the world is done in Indonesia. The government of Indonesia has also issued the law containing the criminal threat is dead against the narcotics crime, that is Act. No.35 of 2009 on Narcotics. When linked with the death penalty, the row inmates are entitled to propose a efforts law. The efforts of law include an appeal, cassation and judicial review. In addition, the convicted person can apply for clemency to the President.The purpose of this study to know the procedure for granting clemency death convicted of narcotics based on Act Number 5 of 2010 concerning Amendment to Law Number 22Year 2002 on clemency and to know the basic consideration of the President in granting Pardons to convicted of drug cases.The research was done by using a normative approach, namely the principles of law, the type of data in this research his to use primary legal materials of the Constitution ofthe Republic of Indonesia Year 1945, and the Act, secondary legal materials (books relating to results research that is granting pardons to convicted narcotics and the data from the internet) and tertiary legal materials (Dictionary of Indonesian Language), data collection techniques in this study with the study of Librarianship and data analysis using the deductive method is a way of drawing conclusions from the proposition that general to the specific.From the research problem, there are two main things that can be inferred. First, against a court ruling which has acquired permanent legal force, the convicted person can apply for clemency to the President. A court ruling may be filed a petition for clemency was the verdict of the criminal to death, life imprisonment at most 2 years low. A period of filing of pardons is one years since the court ruling abtained legal power anyway. Second, the President may grant clemency to provide basic reason juridical considerations clearly, firmly and accountable as well as taking into consideration the relevant agencies.Keywords: Granting-Death Convicted-Narcotics

Abstract

The issuance of the order to investigate more than once in the criminal procedural law in Indonesia is the background of the study. The Criminal Procedure Code as the basis for proceedings in the criminal justice system in Indonesia does not explain the issuance of investigation orders more than once. The Criminal Procedure Code only allows one to submit a pretrial to the status of the determination of him so that the law enforcement process is protracted and legal certainty is not carried out.As for the purpose of this study, first to find out the implementation on the issuance of a warrant for investigation more than once in criminal procedural law in Indonesian. Second to find out the ideal concept of issuing of a warrant for investigation more than once in criminal procedural law in Indonesian. This type of research is normative law, which examines legal principles against a legal event. This research is descriptive, that is research that seeks to provide systematic and careful facts with the characteristics of a particular population.From the results of the research, there are two things that can be concluded, first, how the implementation of the issuance of a warrant for investigation is more than once in criminal procedural law in Indonesia. Abstract

In Indonesian law has been very clearly regulated about the behavior of traffic,but in fact today what happens in the field is not in accordance with the aspirations ofthe legislation. Based on this fact, then there are three formulation problems inwriting this thesis, ie: First How is the application of Article 106 of Law Number 22Year 2009 on Road Traffic and Transportation to Motorcycle Users in Merbau Subdistrict?,secondly how is the role of the Police in the application of Article 106 ofLaw Number 22 Year 2009 on Road Traffic and Transportation to Motorcycle Usersin Merbau District?,third, what are the obstacles in the application of Article 106 ofLaw Number 22 Year 2009 on Traffic and Road Transport in Merbau Sub-district?.The research method in this research is qualitative research method withempirical juridical approach or sociological law research. Data sources aresupported by primary and secondary data sources. Data collection techniques usedwere interviews, questionnaires and literature review. After the data collected thenanalyzed qualitatively, and draw conclusions with the deductive thinking method ofanalyzing the problem from the general shape to the special form.From the results of research and discussion it can be concluded that, with noUnitlantas in Merbau Sector Police, the Implementation of Article 106 of the Law onTraffic and Road Transport will not be in accordance with what is aspired by law,which is an important role in carrying out the task of securing traffic is the task ofUnitlantas. So far, traffic security in Merbau sub-district is handled directly by theMeranti Islands Resort Police Traffic Unit, but since access to every sub-district mustpass through the sea and the means of transportation is only speedboat, theperformance of Satlantas itself is not effective. The obstacles of law enforcement arethe lack of professional elements of the apparatus, the lack of public understandingabout the law and the lack of public awareness to comply with applicable law. Someefforts are made to overcome these obstacles by providing legal counselingconducted in first to senior high school and socializing to the general public, andimproving the police ability in the application of legislation.Keywords: Law Enforcement-Traffic-offenses

Abstract

Health has a very important meaning for everyone. Health becomes something coveted by everyone. Many ways are then performed in order to stay healthy, ranging from the adoption of healthy lifestyles (as preventive measures), to go to the doctor when the disease (as a repressive). When a person's health is compromised, they will do a variety of ways to be healthy again as soon as possible. Treatment to the doctor is an option when a person (patient) suffering from a disease. The hope is that they experienced disease can be cured by the doctor. From the research results can be concluded that the position of medical records in malpractice is proving as documentary evidence as stipulated in Government Regulation No. 26 of 1960 on Oath pronunciation Doctor, Article 187 of the Criminal Procedure Code as well as evidence statements of the experts as defined in Article 186 Criminal Procedure Code. Medical records serve as one form of health care in accordance with the applicable standards in the field of health. Not made of medical records by physicians will lead to doctors could be dragged to court to account for his actions (negligence) and will get imprisonment or a fine as stipulated in Article 79 clause (b) of Law Number 29 Year 2004 regarding Medical Practice and administrative measures in the form of verbal warning, written reprimand to revoking licenses as provided for in Article 17 Regulation of the Minister of Health No. 269 of 2008.

Abstract

Minor criminal acts (Tipiring) are minor or non-hazardous criminal offenses that cover minor crimes written in the second book of the Criminal Code which consist of, light animal abuse, light abuse, minor abuse, minor theft, minor embezzlement, minor fraud, light damage and light storage. The Supreme Court has issued a Supreme Court Regulation Number 2 of 2012 concerning the Limitation of Light Crimes (Tipiring) and the Amount of Fines in the Criminal Code. Penal Mediation is an alternative solution to minor crimes.This type of research can be classified in the type of sociological legal research (empirical), because in this study the author immediately conducts research on the location or place under study to provide a complete and clear picture of the problem under study. This research was conducted at the Head of Payakumbuh City Police Investigator section, Payakumbuh City Police Investigator Section and Light Burglary Actors. The data sources used are primary data, and secondary data. Data collection techniques in this study were interviews, questionnaires, and literature review.The conclusion that can be obtained from the results of the research is that the Implementation of Penal Mediation as an alternative solution to the theft of light in the Payakumbuh City Police has been implemented but has not been fully implemented as an alternative solution to minor theft cases. Many considerations from investigators, one of which is a crime that disturbs the public. Although the value of the loss of a crime is very small. The implementation of Penal Mediation has also not been supported by the basis of regulations governing reason mediation so that investigators are still hesitant to implement it. The obstacles faced by Payakumbuh City Police in the implementation of penal mediation consist of constraints of law enforcement officials, legal factors and community factors. Legal factors, namely the provisions concerning the mechanism of investigation, have actually been regulated but there is no regulatory basis governing criminal mediation, especially in light of theft so that investigators are still hesitant to submit all cases of minor theft cases handled and citizens have not fully known and understand the applicable law related to the existence of reasoning mediation as an alternative solution to minor criminal cases.Keywords: Penal Mediation, Alternative Case Settlement, Mild Theft

Abstract

The abundance of marine biological resources and the position that borders directly with other countries with the North Natuna Sea has resulted in many foreign fishing vessels violating the provisions by utilizing biological resources without the permission of the Indonesian state. This study regarding the provisions regarding the utilization of Indonesia's fishery biological resources in the waters of the Exclusive Economic Zone in the North Natuna Sea aims to find out the provisions that are violated and the efforts made in overcoming and reducing the number of fisheries violations.This type of research can be classified in the type of sociological research, because in this study the authors directly conduct research at the location or place of study in order to provide a complete and clear picture of the problem under study. This research was conducted in the West Maritime Zone Bakamla, Lantamal IV Tanjung Pinang, PSDKP Batam, the Marine and Fisheries Service of the Riau Islands Province and the POLDA Dipolairud Riau Islands, while the population and sample are all parties related to the problems examined in this study, the source of the data used, primary data, secondary data, and tertiary data, data collection techniques in this study with observation and interviews.From the results of the study as follows: the provisions violated 182 foreign fishing vessels in the North Natuna Sea in the 2016-2018 period were fishing without permits, the use of prohibited fishing gear, containing protected fish. Whereas the efforts to impose strict sanctions in the form of confiscation, fines or destruction of evidence, establish cooperation with fishermen, monitoring through MSC (Monitoring, Control and Surveillance), officers conduct routine patrol and the government adopts or international regulations. Abstract

Provisions regarding the acceleration of settlement of forest encroachment cases have been regulated in the Law of the Republic of Indonesia Number 18 of 2013 concerning Prevention and Eradication of Forest Destruction Article 39, while investigators of PPNS, POLRI and Public Prosecutors in Riau province find it difficult to obtain evidence to resolve cases of criminal acts of forest encroachment. The dossier handed over to the Public Prosecutor is not yet complete with P-18, so there are still many criminal cases of forest encroachment that have not been resolved.This research is a sociological legal research, this research was conducted at the Center for Security and Enforcement of Environmental and Forestry Laws in Sumatra Region. While the population and sample are all parties who have a relationship with the problem in this study. Sources of data used include primary, secondary, and tertiary materials. Data collection techniques in this study were carried out by questionnaires, interviews, and literature studies.The results of this study indicate, First, the application of the provisions for the acceleration of settlement of forest encroachment cases in the Riau province area has not been maximized, there are still many cases that have not been completed because the P-21 file is not complete. Second, the Implications of the Law of the Republic of Indonesia Number 18 of 2013 concerning Prevention and Eradication of Forest Destruction has provided a legal umbrella for PPNS, POLRI and Public Prosecutors to coordinate in eradicating forest encroachment actors carried out by individuals and groups who destroy forests, especially in Riau province. Third, efforts to overcome legal problems in the application of Article 39 of the Law of the Republic of Indonesia Number 18 of 2013 concerning Prevention and Eradication of Forest Destruction in Riau Province, The Public Prosecutor has the authority to conduct a pre-prosecution if there are deficiencies in the investigation by taking into account the provisions of Article 110 Paragraph (3) and (4).Keywords: Forest-Encroachment-Investigation

Implementation of Development of Education inmates children the Correctional Institution Grade II B Pekanbaru, aiming for as a effort and planned to create an atmosphere of learning and the learning process so that learners are actively developing the potential for him to have the spiritual power of religion, self-control, personality, intelligence, character noble and necessary skills themselves, society, nation and country. The purpose writing of this research, namely: first, the implementation of the Development of Education of children inmates at the Correctional Institution Grade II B Pekanbaru. Second, barriers to Development of Education of children inmates at the Correctional Institution Grade II B Pekanbaru. Third, efforts to overcome obstacles in the process of educational development of children inmates at the Correctional Institution Grade II B Pekanbaru.From the results of research can be concluded, first, the implementation of the Development of Education of children inmates at the Correctional Institution Grade II B Pekanbaru, aiming for as a effort and planned to create an atmosphere of learning and the learning process so that learners are actively developing her potential. Abstract

Social conflict can be caused by many things , namely the establishment of adifference, cultural background differences, different interests and groups, rapidchanges in social values in society, socio-economic disparities that exist. Socialconflicts in society can lead to a loss in one or all parties involved in the conflict,where this can be a material and moral damage. For example casualties in theconflict between the village and the village Kabun Aliantan, both injuries andeven fatalities can be contained.
