Abstract

The high rate of deforestation and many forest disputes in Indonesia show that forest management in Indonesia is not based on the principles of good forest governance. It also shows that there is still a lack of attention to the aspect of sustainable forest development which focuses on a balanced sustainability condition between the three forest functions (production, ecology, and socio-economic functions). Geospatial Information is expected to be the solution to help provide an accurate data and information which mapping forest development in accordance with the conditions of each forest area, so that the three functions can operate coherently. Furthermore, with the presence of integrated geospatial data, it can be used as a tool in policy formulation, decision making, and/or dispute resolution in the forestry sector. This paper applies empirical juridical research consisting participatory methods through discussions and interviews with related parties.  In practice, the legal materials are firstly collected by using inventory and documentation. Then, it’s completed by interviews and Focus Group Discussion data. Moreover, it also applies statutory, conceptual, and case approaches. This paper highlights the use of geospatial information data in the forestry legislation making in Indonesia.  Hence, this paper will present new information about the model of forestry dispute resolution based on geospatial information.

Abstract

The enactment of The Job Creation Law (JCL) affects various national regulations in Indonesia, one of which is forestry regulation. The Social Forestry Program, which was previously governed under a Ministerial Regulation, is now incorporated in the JCL. The JCL amends Indonesian National Forestry Law in its Articles 29 (a) and (b). The integration of the Social Forestry Program is asserted to have provided legal certainty and improvement towards the economy of the Forest Village Community, acknowledging their direct participation in managing the forest. Meanwhile, the alignment of the Social Forestry Program and the materialization of sustainable forest development is diminished. Thus, this paper aims to analyze which law models fit to strengthen the Social Forestry Program and Sustainable Forest Management (SFM) enforcement. This paper is an empirical research juridical research that is participatory. It includes discussions and interviews conducted with several related parties. In the collection of the legal materials, the authors use the method of inventory and documentation which are complemented by interviews and Focus Group Discussion (FGD). This study uses the statutory, conceptual as well as case approaches. This research finds that the ease of conducting investment encouraged by the JCL conflicted of various Indonesian environmental protection goals. For instance, the risk-based approach used in the environmental permit generates another loophole for both the SFM and the Sustainable Development Management (SDM) goals at any level. The discussion in this research is restricted by the national concept of the Social Forestry Program, which is merely regulated at the ministerial level, thus affecting the development of this study. Moreover, the authors pursue discussions with the affected community and relevant regional boards to redress the limited and less-updated supporting data available.

Abstract

AbstractSocial forestry has been an instrument of government to escalate community welfare. Forest village in Indonesia is one of the schemes recognized in the national social forestry program since 2007. The economic potential of forest village management is now realized in the Government Regulation in Lieu of Law No.2/2022 regarding Job Creation, specifically designed to accelerate the national economy. The ease offered by the JCL changes nothing to the community perspective in benefiting Village forests through a collaborative scheme between Village-owned enterprises and other groups. Thus, it is essential to portray this collaboration’s potency to provide village community welfare further. This study uses the socio-legal method by applying statutory and conceptual approaches supported by interview’s respond from the governments. This study’s result shows that the village-owned enterprises shall collaborate in benefiting the village forest to escalate the village IDM level which also represents the achievement of Village SDGs. AbstrakPerhutanan sosial telah menjadi instrumen Pemerintah untuk meningkatkan kesejahteraan masyarakat. Hutan desa di Indonesia merupakan salah satu skema yang diakui dalam program perhutanan sosial nasional sejak tahun 2007. Potensi ekonomi pengelolaan desa hutan kini diakui dalam Perpu No.2/2022 tentang Cipta Kerja (Perpu Cipta Kerja) yang dirancang khusus untuk mengakselerasi perekonomian nasional. Kemudahan yang ditawarkan dalam peraaturan tersebut tidak mengubah cara pandang masyarakat dalam memanfaatkan hutan Desa melalui skema kerjasama antara Badan Usaha Milik Desa dengan kelompok lain. Oleh karena itu, penting untuk menggambarkan potensi kerjasama ini yang bertujuan untuk lebih memberikan kesejahteraan masyarakat desa. Penelitian ini menggunakan metode yuridis sosiologis yang didukung oleh hasil wawancara pemerintah terkait. Hasil penelitian menunjukkan bahwa BUMDes dapat berkolaborasi dalam memanfaatkan hutan desa untuk meningkatkan level IDM desa yang juga merupakan pencapaian Tujuan Pembangunan Nasional Desa (TPB Desa). Pada akhirnya, ini berkontribusi pada pencapaian Tujuan Pembangunan Berkelanjutan Nasional (TPB Nasional).Kata Kunci: BUMDes; Indeks Desa Membangun; Tujuan Pembangunan Berkelanjutan; Perhutanan Sosial; Hutan Desa.

Abstract

The imperative to expedite the reduction of stunting rates has emerged as a paramount policy goal, garnering unanimous support from local governments across Indonesia. Banyuwangi Regency, in its commitment to this cause, has introduced the Banyuwangi Tanggap Stunting (BTS) Program, an innovative initiative aimed at diminishing stunting prevalence. The success of this program hinges on the endorsement and proactive involvement of all village governments within Banyuwangi Regency. Crucially, the efficacy of such policies necessitates a foundation rooted in the Political Will of village governments to facilitate implementation. This study delves into the case of Kedunggebang Village, situated in the Tegaldlimo District, which has embarked on the BTS program through a collaborative, cross-sectoral approach and extensive community counseling efforts. The primary objective of this research is to elucidate the Political Will exhibited by the Kedunggebang village government in supporting the BTS initiative, while also examining the impediments encountered during its implementation. Employing qualitative descriptive methods and in-depth interviews, this research employs the Brinkerhoff Theory as an analytical framework. Notably, the study stands out as a multidisciplinary exploration, scrutinizing public health concerns through the lenses of public policy and government bureaucracy. The findings reveal a nuanced scenario where the Kedunggebang Village Government demonstrates a lower level of Political Will, yet exhibits the capacity to effectively implement the BTS program. Consequently, the study advocates for essential bureaucratic reforms, including the enactment of village regulations, the formulation of comprehensive village development plans, and the establishment of a dedicated task force to accelerate the reduction of stunting rates.

Abstract

The Legislation of Indonesian New Energy and Renewable Energy Law (RUU EBET) received a negative response from various circles of society and academia. Main concept of the EBET Bill as green legislation is expected could encourage the energy transition and low-carbon development by reducing fossil energy and increasing the role of renewable energy. However, the internalization of new energy sources in the formulation of the EBET Bill, which is a product of fossil energy derivatives, is considered to hinder the energy transition process, so it is encouraged to be abolished. Nevertheless, the academic paper of the EBET Bill actually reveals that there is a national interest that is also urgent to be regulated in the EBET Bill, which is state control of new energy sources whose governance is still unclear. Therefore, this paper aims to explain the juridical conflict in the position of the EBET Bill as green legislation and at the same time as an instrument of state control over natural resources. The method used is normative juridical with statutory and conceptual approaches. The results of the research show that the EBET Bill should have two complementary goals, namely mitigating climate change through accelerating the energy transition and managing new energy sources that are still not organized in an orderly manner. The two goals are not to contradict one another, but serve as mutually reinforcing roadmaps. Keywords EBET Bill, Green Legislation, New Energy Source, New Energy, State Control.

Abstract

Perubahan iklim membawa dampak pada hampir setiap bidang kehidupan. Pemerintah RI berkomitmen untuk meminimalisir dampak perubahan iklim ditunjukkan dengan diterbitkannya Perpres No. 98/2021 tentang Penyelenggaraan Nilai Ekonomi Karbon. Dalam Perpres tersebut, Pemerintah mengatur adanya skema perdagangan karbon melalui mekanisme carbon off set, pembayaran berbasis kinerja, dan pungutan atas karbon, serta kombinasi dari skema yang ada. Adanya Perpres ini di satu sisi merupakan wujud komitmen Pemerintah dalam mendukung upaya mengatasi perubahan iklim melalui sektor kehutanan, namun disisi lain Pemerintah seakan tidak tegas untuk menghentikan adanya pelanggaran-pelanggaran di bidang kehutanan, yang kemudian berimplikasi pada keadilan bagi masyarakat dan lingkungan sekitar. Ada dua isu yang dibahas dalam tulisan ini. Pertama, mengenai dinamika pengaturan carbon trading dalam konteks global dan nasional. kedua, mengenai perspektif keadilan dalam kebijakan carbon trading sebagai upaya mengatasi perubahan iklim.

Abstract

Pengabdian masyarakat di Kecamatan Dongko berangkat dari fenomena besarnya potensi desa-desa di Kecamatan Dongko, namun belum dapat berjalan secara optimal. Hal ini dilandasi oleh hambatan berupa belum kuatnya BUMDES dalam pengelolaan potensi wisata, tidak adanya regulasi yang mendasari kerjasama desa, serta minimnya kesadaran masyarakat akan potensi desa. Dalam rangka menghadapi permasalahan tersebut, maka digagas sebuah solusi yakni desa wisata tematik integratif. Pengabdian ini dilakukan melalui 4 tahap berupa persiapan, penyuluhan, pendampingan, hingga monitoring dan evaluasi. Tahapan-tahapan ini dilakukan secara sistematis agar mampu membedah masalah secara tepat dan sesuai kebutuhan untuk kemudian diberikan solusi yang konkret dan ideal. Konsep desa wisata tematik integratif ini diwujudkan melalui penguatan BUMDES, pembentukan regulasi terkait kerja sama desa, dan peningkatan kesadaran masyarakat terhadap karakteristik dan potensi desa. Langkah-langkah inilah yang dapat berimplikasi pada terciptanya kesejahteraan masyarakat di Kecamatan Dongko, yang berjalan searah dengan ketercapaian 8 tipologi desa dan 18 Tujuan Pembangunan Berkelanjutan Desa.

Abstract

Mitra sasaran dalam pengabdian masyarakat ini adalah masyarakat Desa Dongko, Kecamatan Dongko, Kabupaten Trenggalek, Jawa Timur. Permasalahan mitra yaitu (1) Belum optimalnya pengelolaan potensi alam yang ada di Desa Dongko; (2) Rendahnya pengetahuan masyarakat tentang peran BUMDesa sebagai penyangga perekonomian desa; (3) Belum optimalnya pengelolaan BUMDesa. Tujuan dari program ini adalah meningkatkan pengetahuan dan skill kelompok mitra dalam mengelola potensi yang dimiliki desa sehingga dapat bernilai ekonomis, serta mengoptimalkan fungsi BUMDesa sehingga dapat meningkatkan pendapatan asli desa dan perekonomian masyarakat desa. Metode pelaksanaan kegiatan terdiri dari n3 tahap. Pertama yakni persiapan, kedua yakni pelaksanaan pengabdian kepada masyarakat berupa penyuluhan, dan ketiga yakni tahap evaluasi. Adapun hasil dari pengabdian ini yakni adanya publikasi media online, video kegiatan (youtube) dan reels IG sebagai sarana promosi, meningkatnya pemahaman pentingnya BUMDes sebagai instrumen pendukung pengembangan desa wisata, serta draft paket wisata di Desa Dongko.

Abstract

Sektor Forest and Other Land Use (FOLU) menjadi andalan mitigasi perubahan iklim melalui Perpres 98/2021 dengan target net sink 140 juta ton CO2e pada 2030. Namun, UU Cipta Kerja berpotensi meningkatkan alih fungsi hutan untuk industri, yang dapat menambah produksi karbon dan melemahkan penyerapan karbon oleh hutan. Hal ini menempatkan Indonesia pada risiko gagal mencapai target FOLU Net Sink 2030. Penelitian ini menganalisis tanggung gugat pemerintah dalam mencapai target kebijakan FOLU Net Sink 2030, melalui kajian normatif terhadap konsep dan peraturan perundang-undangan, serta data pendukung. Analisis menunjukkan bahwa pemerintah memiliki tanggung jawab untuk memenuhi hak atas lingkungan hidup yang baik dan sehat, serta mitigasi krisis iklim. Berdasarkan tanggung jawab ini, dimungkinkan adanya mekanisme penuntutan tanggung gugat pemerintah atas kegagalan mencapai target FOLU Net Sink 2030 melalui proses litigasi iklim.
