Abstract

The uncertainty of the status of affiliated bankruptcy debtors as evidence of criminal offenses is a classic problem that until now has not found an alternative legal solution. When a bankruptcy debtor is proven to have committed a criminal offense, resulting in the debtor's assets becoming evidence seized by the criminal, the curator will experience difficulties in the process of liquidating the debtor's assets. On the one hand, the prosecutor's office has the authority to confiscate the assets of the debtor (defendant), as well as the curator who has the authority to liquidate. The emergence of these two types of seizure is certainly intended to provide legal certainty and legal protection for the community. However, in its implementation, when the two types of seizure clash, the aspects of certainty and justice for the community will not be achieved. Therefore, it is necessary to establish regulations that can bridge or unravel the problem of attraction of seizure objects between the curator and the prosecutor's office. The research method used in this research is juridical-normative by using several research approaches, namely statute approach and conceptual approach. The use of statute approach in the research is intended to provide an overview of the construction of bankruptcy and criminal law so as to hamper the process of liquidation of bankruptcy assets. While the use of conceptual approach is intended as a basis for thinking to reconstruct the legal construction so as to create harmonious and synchronous bankruptcy and criminal regulations and can provide certainty and justice for the legal protection of creditors.

Abstract

Labuan Bajo is one of the super priority tourism destinations that has been planned by the Indonesian Government because of the presence of rare Komodo animals and also its natural beauty. To support this goal, various efforts have been made to increase the number of tourist visits, including by providing adequate hotel facilities and restaurants and other tourist facilities. In reality, tourism activities in Labuan Bajo cause environmental damage that threatens the Komodo habitat and damages the coastal and marine environment. How are the regulations regarding the environment, especially from tourism activities, including criminal sanctions that can be applied to perpetrators of violations? This study was conducted descriptively, namely collecting existing regulations, both regulations regarding the environment and tourism, and also observing tourism activities in Labuan Bajo directly for analysis. The results of the study show that existing regulations are quite adequate, but there are still violations committed by tourism business actors

Abstract

Abstract

Pasal 35 United Nations Convention Against Corruption mengatur dapat diberikannya kompensasi, dan Resolusi Majelis Umum PBB Nomor 40/34, 29 November 1985, yang mengadopsi Declaration of Basic Principles of Justice for Victims of Crime and Abuse of Power mengatur dapat diberikannya restitusi bagi korban tindak pidana.

Abstract

Forests are the lungs of the world, benefiting both the environment and the communities surrounding them. Forest destruction, including through deforestation, will have detrimental impacts on society. Some of the detrimental impacts that can occur with deforestation are: landslides and floods have damaged both medicinal and community-owned crops. This means local communities cannot utilize the forest. The problem that will be discussed in this article is how to regulate forest protection, and if deforestation occurs, can the community receive compensation? The method used in this research is normative juridical, which studies more about the existing regulations in Indonesia regarding environmental protection, especially forests. From the research results it can be seen that the existing regulations are sufficient to protect forests, however, compensation for the community has not yet been regulated.             Things that can be done regarding the losses experienced by communities due to deforestation include restoring the environment and helping communities to meet their needs. Environmental restoration and assistance to the community can be carried out by companies that manage forests, or the government, especially if the forest is a customary forest or state forest.

Abstract

Indonesia's National Health Insurance (Jaminan Kesehatan Nasional, JKN) has integrated healthcare financing and administration into a single national system, yet the institutions responsible for resolving healthcare disputes remain divided across multiple jurisdictions. This institutional divergence has become increasingly significant as healthcare disputes now extend beyond medical negligence and insurance reimbursement to encompass administrative decision-making, contractual relationships, professional accountability, and the constitutional right to health. This article examines whether Indonesia's existing judicial framework remains capable of adjudicating disputes generated by an integrated healthcare system. It first analyses the legal characteristics of disputes arising under JKN and the fragmentation of their resolution across existing institutions. It then evaluates the institutional limitations of the current framework through doctrinal and comparative legal analysis. The article argues that the principal challenge lies not in the absence of legal remedies but in the allocation of adjudicatory jurisdiction. Although existing institutions perform legitimate statutory functions, no single forum possesses the institutional capacity to resolve the interconnected legal and technical issues presented by contemporary healthcare disputes. It concludes that a specialized health court represents a constitutionally compatible institutional response to the evolving demands of Indonesia's healthcare governance and access to justice.
