Abstract

Pemindahan Ibu Kota ke Nusantara di wilayah sekitar Penajam Paser Utara dan Kutai Kartanegara di Kalimantan Timur menuai pro dan kontra. Dari sisi kontra mengatakan bahwa pembangunan tersebut dapat merubah lanskap dan ekosistem lingkungan sekitar yang termasuk sebagai paru-paru dunia dan wilayah konservasi fauna endemik. Selain lingkungan, pemindahan tersebut akan berdampak pada kehidupan sosial dan ekonomi masyarakat sekitar IKN yang masih tergolong rendah. Dari sisi lain pembangunan Ibukota Negara (IKN) akan membawa dampak positif baik dari segi ekonomi , sosial dan pembangunannya akan dilakukan tanpa merusak lingkungan.Pembangunan IKN akan tetap dilaksanakan, untuk itu dalam pembangunanya harus dijaga agar tidak merusak lingkungan salah satunya dengan menerapkan Pembangunan berkelanjutan. Pembangunan bukan hanya untuk memenuhi kebutuhan generasi saat ini, tetapi juga memperhatikan pemenuhan kebutuhan generasi masa depan atau generasi yang akan datang yakni dengan menjamin alam tetap terjaga. Berbagai peraturan nasional tentang perlindungan lingkungan telah dibuat oleh Indonesia, selain itu juga terdapat berbagai prinsip hukum internasional antara lain prinsip atau konsep pembangunan berkelanjutan atau sustainable development. Metode yang digunakan adalah deskriptif yaitu menggambarkan apa yang terjadi lalu mengkajinya berdasarkan aturan, prinsip yang ada. Untuk kelengkapan data juga dilakukan wawancara.Kajian tentang aturan dan prinsip yang ada menunjukan bahwa bila pembangunan IKN dilakukan dengan menerapkan prinsip pembangunan berkelanjutan seperti adanya pemerataan, prinsip ekologis, pemanfaatan sumber daya alam dengan bijaksana, maka pembangunan tersebut tidak merusak lingkungan dan dampak terhadap masyarakat sekitar dapat diminimalisir.

Abstract

Every states have the rights or jurisdiction over their territory in the land and sea, and to protect their specific environment, they also have the right to purpose part of their territory as a Protected Area. Chagos archipelago is rich in the marine biodiversity which have to protect This island which place in the Indian Ocean used to be a British Colony, and in 1968 after Mauritius independence, British still exist in Chagos island based on their agreement with Mauritius to use this island for a few year, because British also have the agreement with US to use one of the island (Diego Garcia) as US Millitary Camp. In 2010 British purpose the Chagos archipelago as a protected area, which against by Mauritius, because the Cahgos Island is not British territory, its Mauritius’s territory. Based on UNCLOS 1982 only the coastal state have the rights of their marine biodiversity in their ZEE. The Convention on Biodiversity 1992, also mentioned about the rights of states to protect their biodiversity by using as protected area. IUCN as an international organization has the guidance about protected area that can be use to discuss the Chagos marine protected areas.

Abstract

The development of new city, as well as the development of the new capital city of the Indonesia, will certainly have both positive and negative impacts. Some experts and NGOs assess that the development of the State Capital (IKN) will have a negative impact on the local community and the environment, but the government has made various efforts to reduce this adverse impact. This paper will discuss the pro and contra of IKN development, and what efforts have been made by the government and the existing regulations. The research method is a normative juridical method, which is a method that uses analysis from secondary data in the form of regulations and also expert opinions from books and journals. The government has made various efforts to protect the environment in the development of IKN, including making Law number 3 of 2022 concerning IKN. In addition, several other rules related to environmental protection will also be applied. The local government of East Kalimantan also has several regional regulations that can be applied to protect the environment in the development of IKN. It is hoped that with the application of appropriate rules and the efforts made by the government to protect the environment in the development of IKN.Keywords : Environmental protection, New Indonesian Capital

Abstract

Water is one of the important needs of society for everyday life, especially the need for clean water. To meet these needs, the community can get water from rivers, rainwater, and groundwater sources. Kulon Progo is one of the areas that are part of the Yogyakarta Province, where in Kulon Progo there are many water sources. However, based on research conducted, the water in Kulon Progo cannot be used as drinking water because it has been contaminated. For this reason, it is necessary to conduct a study, especially in terms of existing regulations, both national and regional regulations, whether these regulations can protect water sources so that they can protect the environment, including water sources. Indonesia already has rules regarding environmental protection and management, namely Law Number 32 of 2009, and regulations regarding Water Resources, namely Law Number 17 of 2019. From these regulations, it can be said that they have been able to protect water sources so that they are not polluted, but awareness and the need for community participation are not carried out activities that can cause water pollution.

Abstract

State have the duty to protect their citizen including people with disabilities. Persons with disabilities have their rights to live, dignity, education as well as job. The Indonesian Government has their regulation regarding people with disabilities such as Act number 39 year 1999 on Human Rights, Act number 13 year 2003 on Manpower which is stated that manpower protection aims at guaranteeing the basic rights of workers/labor and equal opportunity as well as non-discriminatory treatment on whatever basis. The Act number 8 year 2016 on Person with Disabilities, is the new law which contain some articles on the rights to work of people with disabilities. This article will explain about the regulation in Indonesia as well internationally about the access to work for people with disabilities.

Abstract

Insurance is a coverage where a party act as the Insurer while the other party act as the Insured and proven by the agreement which is called by the Policy. Since 2011, insurance industry was being supervised by the Indonesia Financial Services Authority (OJK). Therefore, in carrying out its business activities should comply with the OJK regulations, including to determine the dispute clause in the Policy. The Alternative Dispute Resolutions for the Financial Services Sector has been established by OJK at the end of 2020 which provide an opportunity to the disputing party to solve their dispute outside the court. Indonesia has BANI Arbitration Center (BANI) which could be used as an alternative forum to settle the general insurance disputes in Indonesia, however it is contrary with regulation which has been issued by the OJK.

Abstract

Salah satu penyebab terjadinya banjir adalah akibat meluapnya sungai baik itu karena banyaknya sampah, atau terjadinya pendangkalan sungai. Jakarta merupakan salah satu kota di Jawa yang mempunyai masalah terjadinya banjir pada musim hujan. Banjir yang terjadi di Jakarta antara lain akibat meluapnya Sungai Ciliwung yang mengalir dari Bogor. Perlindungan daerah aliran Sungai atau DAS, dilakukan antara lain dengan melarang pendirian bangunan di sepanjang Sungai agar tidak terjadi longsor atau abrasi serta mengatur kegiatan di sekitar Sungai. Selain itu  larangan pembuangan sampah ke sungai merupakan beberapa cara yang dapat dilakukan untuk melindungi sungai agar tidak terjadi pendangkalan dan mengakibatkan air yang meluap. Terkait dengan hal tersebut, maka dilakukan penelitian dengan masalah bagaimana pengaturan perlindungan sungai khususnya di Bogor untuk melindungi Sungai Ciliwung agar tidak terjadi banjir. Metode penelitian dilakukan secara normatif yaitu mengkaji berbagai aturan tentang perlindungan lingkungan Sungai baik aturan tingkat nasional, maupun tingkat daerah Kotamadya Bogor. Dari kajian terhadap aturan yang ada, disimpulkan bahwa aturan tersebut antara lain UU No. 38 tahun 2011 tentang Sungai, UU No. 17 tahun 2019 tentang Sumber Daya Air dan PP No. 81 tahun 2012 tentang Pengelolaan Sampah Rumah Tangga Dan Sampah Sejenis Sampah Rumah Tangga sudah dapat melindungi Sungai, dan dapat dilaksanakan agar tidak terjadi luapan Sungai yang mengakibatkan banjir.

Abstract

Salah satu hak yang dimiliki manusia adalah hak untuk hidup, di mana hal ini terkait juga dengan Upaya penghapusan kemiskinan agar manusia dapat memenuhi kebutuhan hidupnya. Manusia harus dilindungi dari berbagai ancaman  termasuk ancaman dari kemiskinan yang merupakan bagian dari Sustainable Development Goals (SDG’s) di mana setiap manusia atau individu harus dijamin oleh negara agar tidak menderita kemiskinan. Tujuan yang pertama dari SDG’s adalah Menghapuskan Kemiskinan, namun di sebagai belahan bumi, masih terdapat kemiskinan sehingga mengancam kehidupan mereka, di mana mereka tidak dapat memenuhi kebutuhan hidupnya termasuk akses kesehatan, nutrisi buruk bagi anak-anak dan pendidikan yang baik. Salah satu penyebab kemiskinan adalah menurunnya kualitas lingkungan, terutama untuk mereka yang mengandalkan alam untuk kehidupan sehari-hari seperti nelayan dan petani, di mana bila lingkungan rusak, maka hasil tangkapan berkurang dan hasil panen pun menurun. Permasalahan yang akan dibahas dalam tulisan ini adalah bagaimana pengaturan tentang perlindungan lingkungan  khususnya yang terkait dengan lingkungan laut dan lahan serta peran negara agar tidak dapat mengurangi kemiskinan. Metode penelitian yang digunakan adalah Yuridis-Normatif yaitu kajian Pustaka baik dari buku, jurnal,  dan aturan di Indonesia. Salah satu cara untuk menanggulangi kemiskinan adalah dengan menjaga atau melindungi lingkungan agar tidak tercemar atau tidak terjadi penurunan kualitasnya. Pengaturan tentang perlindungan lingkungan dan juga peran atau tanggung jawab negara diperlukan sebagai upaya untuk menanggulangi kemiskinan. Aturan di Indonesia sudah cukup untuk melindungi lingkungan.  Indonesia juga telah ikut serta dalam pembahasan mengenai tujuan Pembangunan berkelanjutan ini yang menghasilkan suatu Deklarasi SDG’s pada tahun 2015. Komitmen internasional ini menjadi tanggung jawab masing-masing negara agar dapat dilaksanakan di negaranya. Diharapkan agar aturan yang  ada tentang perlindungan lingkungan dapat diterapkan termasuk pula adanya peran serta negara atau pemerintah, sehingga lingkungan tetap terlindungi dan kemiskinan dapat ditanggulangi.

Abstract

One of the environmental damages currently quite disturbing is the ecological damage caused by plastic waste. Plastic waste is difficult to decompose so that it can disrupt the ecosystem of the land and the sea. One of the impacts of plastic waste is on the health of marine animals, where some of these animals, such as turtles, eat debris or plastic fragments. As a country with a large sea area, Indonesia must ensure its marine environment is not polluted by plastic waste. One way to prevent environmental damage is through regulation, where in addition to prevention, we must also look at what sanctions can be applied to those who violate the law by dumping rubbish in the sea. These can be criminal sanctions, such as fines and imprisonment, and sanctions to pay compensation, especially if victims are harmed. This research uses a normative legal method to answer the problem of how the rules in Indonesia regulate compensation in the event of pollution due to plastic waste. The current regulations are sufficient, but implementing compensation payments for plastic waste victims is still challenging.

Abstract

Labuan Bajo is one of the super priority tourism destinations that has been planned by the Indonesian Government because of the presence of rare Komodo animals and also its natural beauty. To support this goal, various efforts have been made to increase the number of tourist visits, including by providing adequate hotel facilities and restaurants and other tourist facilities. In reality, tourism activities in Labuan Bajo cause environmental damage that threatens the Komodo habitat and damages the coastal and marine environment. How are the regulations regarding the environment, especially from tourism activities, including criminal sanctions that can be applied to perpetrators of violations? This study was conducted descriptively, namely collecting existing regulations, both regulations regarding the environment and tourism, and also observing tourism activities in Labuan Bajo directly for analysis. The results of the study show that existing regulations are quite adequate, but there are still violations committed by tourism business actors
