Abstract

This study aims to analyze and compare the implementation of diversion as a mechanism for resolving juvenile criminal cases within the juvenile justice systems of Indonesia and Singapore. The research employs a doctrinal method using a statutory approach combined with a comparative approach. The analysis focuses on differences in regulatory frameworks, implementation mechanisms, and the roles of law enforcement authorities in applying diversion in both countries. The findings reveal that although Indonesia and Singapore both recognize diversion as an alternative to formal criminal proceedings for children, significant differences exist in terms of normative regulation, procedural implementation, and institutional support. Singapore demonstrates a more integrated diversion model, supported by strong institutional infrastructure, while Indonesia continues to face challenges related to coordination, consistency in application, and the effective realization of child protection objectives. This study concludes that Singapore’s diversion practices offer valuable insights for strengthening and reforming diversion policies in Indonesia, particularly to enhance their effectiveness, align them with the best interests of the child, and reinforce the principles of restorative justice.Keywords: Diversion; Juvenile Justice System; Juvenile Criminal Cases; Comparative Study; Restorative Justice

Abstract

The crime of human trafficking involving children as commercial sex workers in Samarinda remains a serious legal and social issue. This practice is influenced by various factors, such as poverty, low levels of education, weak family supervision, and the development of digital technology, which perpetrators exploit to sexually exploit children. This study aims to analyze legal protections for child victims of TPPO as commercial sex workers in Samarinda City, as well as law enforcement against the perpetrators. The research method used is socio-legal research with a qualitative approach. Data was obtained through field research and interviews with law enforcement officials and relevant agencies, and was then analyzed qualitatively. Research findings indicate that legal protection for child victims of human trafficking has been implemented through preventive and repressive measures by the Samarinda City Police’s Women and Children Protection Unit (PPA), the Samarinda District Attorney’s Office, and the Samarinda City Women and Children Protection Agency (DP2PA) in the form of legal assistance, psychological rehabilitation, shelter provision, medical assistance, and legal education for the public. Law enforcement against perpetrators has also implemented Law No. 21 of 2007 on the Eradication of Human Trafficking through the processes of investigation, prosecution, and sentencing of perpetrators. However, its implementation still faces various obstacles, such as victims’ reluctance to report, victims’ emotional dependence on perpetrators, and the suboptimal fulfillment of restitution rights in criminal justice practice. Tindak pidana perdagangan orang (TPPO) terhadap anak sebagai pekerja seks komersial di Kota Samarinda masih menjadi persoalan hukum dan sosial yang serius. Praktik tersebut dipengaruhi oleh berbagai faktor, seperti kemiskinan, rendahnya tingkat pendidikan, lemahnya pengawasan keluarga, serta perkembangan teknologi digital yang dimanfaatkan pelaku untuk melakukan eksploitasi seksual terhadap anak. Penelitian ini bertujuan untuk menganalisis perlindungan hukum terhadap anak korban TPPO sebagai pekerja seks komersial di Kota Samarinda serta penegakan hukum terhadap pelakunya. Metode penelitian yang digunakan adalah penelitian sosio-legal dengan pendekatan kualitatif. Data diperoleh melalui penelitian lapangan dan wawancara dengan aparat penegak hukum serta instansi terkait, kemudian dianalisis secara kualitatif. Hasil penelitian menunjukkan bahwa perlindungan hukum terhadap anak korban TPPO telah dilaksanakan melalui upaya preventif dan represif oleh Unit PPA Polresta Samarinda, Kejaksaan Negeri Samarinda, dan DP2PA Kota Samarinda dalam bentuk pendampingan hukum, rehabilitasi psikologis, penyediaan shelter, bantuan medis, serta edukasi hukum kepada masyarakat. Penegakan hukum terhadap pelaku juga telah menerapkan Undang-Undang Nomor 21 Tahun 2007 tentang Pemberantasan Tindak Pidana Perdagangan Orang melalui proses penyidikan, penuntutan, dan pemidanaan terhadap pelaku. Namun demikian, implementasinya masih menghadapi berbagai kendala, seperti rendahnya keberanian korban untuk melapor, ketergantungan emosional korban terhadap pelaku, serta belum optimalnya pemenuhan hak restitusi dalam praktik peradilan pidana.
