Abstract

Penelitian ini bertujuan untuk menjawab permasalahan tentang: 1) Bagaimanakah implikasi UU Administrasi Pemerintahan terhadap fungsi PTUN, apakah keberadaan UU Administrasi Pemerintahan memperlemah atau memperkuat fungsi PTUN sebagai lembaga pengawasan? 2) Apakah perlu dilakukan upaya penguatan fungsi PTUN seiring dengan meluasnya kompetensi absolut PTUN setelah berlakunya UU Administrasi Pemerintahan? Penelitian ini merupakan penelitian hukum normatif, yaitu menganalisis bahan-bahan hukum primer, sekunder, dan tersier. Bahan hukum dianalisis secara yuridis kualitatif. Hasil penelitian menyimpulkan bahwa: 1) Perluasan kompetensi absolut PTUN dapat menimbulkan implikasi memperlemah atau menguatkan fungsi PTUN bergantung pada integritas SDM termasuk hakim; dan 2) Perlu penguatan fungsi PTUN seiring dengan meluasnya komptensi PTUN berdasarkan UU Administrasi Pemerintahan yaitu dengan: a) segera dilakukan perubahan UU PTUN menyesuaikan dengan UU Administrasi Pemerintahan dan meningkatkan daya paksa pelaksanaan putusan dengan membentuk lembaga eksekusi untuk melaksanakan putusan PTUN;  b) meningkatkan independensi hakim PTUN dalam memeriksa, memutus dan menyelesaikan sengketa atau permohonan.

Abstract

This study aims to analyze the comparison of environmental dispute resolution in the State Administrative Court (PTUN) of Indonesia and its Thailand equivalent. This is a normative legal research, using statutory and comparative approaches. The results of the study are presented in an analytical descriptive form. The results of the study conclude that first, the equatlisation for the settlement of environmental disputes in the Indonesian PTUN and the ones in Thailand is based on the General Administrative Court Procedure Law as regulated in the laws governing the PTUN of each country, but technical guidelines for resolving environmental disputes in the PTUN are issued by the respective Supreme Courts of each country. Second, the first difference is that the Thai Administrative Court provides special arrangements related to compensation issues which include costs for health problems, costs for damage to natural resources, loss of identity and community arts and culture. Meanwhile, the PTUN Indonesia provides very limited compensation and prioritizes the claim for the validity of the object of dispute. The second difference is that the handling of environmental problems in the Thai Administrative Court examines the substance and facts related to the environment more deeply, so that a real picture of environmental problems is obtained in the field. An in-depth study of the substance, facts, environmental problems in the field is taken into consideration by the judge in making a decision, even though administratively there are no problems. Meanwhile, the dispute resolution in the Indonesian PTUN is administrative and procedural in nature. Key Words: Environmental dispute; state administrative court; environment Abstrak Penelitian ini bertujuan untuk menganalisis perbandingan penyelesaian sengketa lingkungan di Pengadilan Tata Usaha Negara (PTUN) Indonesia dan Thailand. Penelitian ini merupakan penelitian hukum normatif, dengan menggunakan pendekatan perundang-undangan dan komparasi. Hasil penelitian disajikan dalam bentuk deskriptif analitis. Hasil Penelitian menyimpulkan, pertama, persamaan penyelesaian sengketa lingkungan di PTUN Indonesia maupun Thailand berdasarkan Hukum Acara PTUN pada umumnya seperti yang diatur dalam Undang-Undang yang mengatur mengenai PTUN masing-masing negara, namun pedoman teknis penyelesaian sengketa lingkungan di PTUN diterbitkan oleh Mahkamah Agung masing-masing. Kedua, perbedaan pertama adalah bahwa di PTUN Thailand memberikan pengaturan khusus terkait dengan masalah ganti rugi yang mencakup biaya gangguan kesehatan, biaya kerusakan sumber daya alam, hilang identitas dan seni budaya masyarakat. Sedangkan PTUN Indonesia memberikan ganti rugi yang sangat terbatas dan lebih mengutamakan mengenai tuntutan keabsahan obyek sengketa. Perbedaan kedua adalah penanganan masalah lingkungan di Pengadilan Administrasi Thailand memeriksa substansi dan fakta-fakta yang berkaitan dengan lingkungan lebih mendalam, sehingga diperoleh gambaran permasalahan lingkungan secara nyata di lapangan. Kajian yang mendalam tentang substansi, fakta-fakta, permasalahan lingkungan di lapangan dijadikan pertimbangan hakim dalam memutus, meskipun secara administrasi tidak ada masalah. Sedangkan penyelesaian sengketa di PTUN Indonesia bersifat administratif dan formal prosedural. Kata Kunci: Sengketa lingkungan; peradilan tata usaha negara; lingkungan hidup

Abstract

The research concludes that the type of land rights given to transmigrant is not accordance with the provisions in the Act no. 15 of 1997 on Transmigration. According to this Act, the type of land for transmigration is an ownership right. Meanwhile, the type of lands on Ring I Transmigration is right to utilize the land. This is because the land is owned by Paku Alam (Paku Alam Grond/Paku AlamGround). The Staffs at Pakualaman will issue a licensing letter to the tranmigrants for using the lands. The lands in original place of transmigrants is still owned by them. Apart from difficulties faced by transmigrants, most respondents are satisfied with the Ring I Transmigration . However, they hope the local government can provide them a stronger type of land right, the owner right. They also hope that the government can establish more facilities in the transmigration areas , such as road, electricity and agriculture equipments.

Abstract

AbstractBased on the Law on Administrative Court, the Administrative Court has the competence to examine and decide upon a dispute whose object is a fictive- negative decision (KTUN). After the enactment of the Law No. 30 of 2014 on Government Administration, the Administrative Court has the competence to examine and decide a dispute whose object is a fictive positive KTUN. The provision of the positive decision in the Law No. 30 of 2014 provides fairer legal protection to both procedural justice and substantive justice. However, the force power of the court to execute decision remains low. Consequently, a fair legal protection to the dispute of positive KTUN per the Law No. 30 of 2014 is not optimal.IntisariBerdasarkan UU PTUN, PTUN mempunyai kewenangan untuk memeriksa dan memutus sengketa yang obyeknya KTUN fiktif negatif. Setelah berlakunya UU No. 30 Tahun 2014 tentang Administrasi Pemerintahan, PTUN mempunyai kewenangan memeriksa dan memutus sengketa yang obyeknya KTUN fiktif positif. Ketentuan KTUN fiktif positif dalam UU No. 30 Tahun 2014 lebih memberikan perlindungan hukum yang adil baik keadilan prosedural maupun keadilan substansial, namun dalam hal daya paksa pelaksanaan masih rendah maka perlindungan hukum yang adil dalam sengketa KTUN fiktif positif berdasarkan UU No. 30 Tahun 2014 menjadi tidak optimal.

Abstract

AbstractThere is a tendency that the PTUN verdicts on environmental disputes are less accommodating the community rights for a good and healthy environment. This study aims to determine the verdict of PTUN Makassar in providing environmental justice and juridical obstacles in realizing environmental justice through the State Administrative Court. The results of the study showed that: 1) PTUN Makassar Verdict Number: 30/G/LH/2017/PTUN.Mks. had not accommodated environmental justice because the considerations used in the verdict are formalistic in nature; 2) Juridical constraints: the differences in the meaning of the plaintiff's interests according to the PTUN Law and UUPPLH.IntisariPutusan PTUN dalam sengketa lingkungan ada kecenderungan kurang mengakomodir hak masyarakat atas lingkungan hidup yang baik dan sehat, termasuk dalam hal ini Putusan PTUN Makassar Nomor: 30/G/LH/2017/PTUN.Mks. Tulisan ini bertujuan untuk mengetahui putusan PTUN Makassar dalam memberikan keadilan lingkungan dan kendala yuridis dalam mewujudkan keadilan lingkungan melalui Peradilan Tata Usaha Negara. Abstract

This research has objectives: 1) To know the application of absolute competence in resolving fictive-positive  dispute based on Government Administration Act; 2) To know the obstacles and solutions in applying the absolute competence of the  Administrative Court in solving the fictive-postive e dispute based on the Government Administration Act. The results showed that; 1). The application of absolute competence of Administrative Court (PTUN) is regulated in Supreme Court Regulation (PERMA) Number 5 Year 2015 (hereinafter referred to as Supreme Court Regulation of Fictive-Positive  Procedural Law). The regulation still has many shortcomings and limitations, so the implementation of the settlement of fictive-positive dispute  has not been regulated.  It causes legal uncertainty because there are still multiple interpretations of judges in response to the regulation. 2). The most complex obstacles are the lack of specific, clear and conclusive implementation guidelines. Suggestion: it is necessary to harmonize the Acts  between the Government Administration Act  and the  Administrative Court Act

Abstract

This thesis is the result of research on children who commit criminal acts, also known as children in conflict with the law, who are placed in the Youth Social Protection and Rehabilitation Center to serve their criminal period during the legal process. The legal process that must be followed takes a long time, ranging from four months to one year. The length of the legal process does not guarantee that the criminal sentence served by the child at the Youth Social Protection and Rehabilitation Center after the judge's verdict will be reduced or not. The context of this study is children who have run afoul of the law and have been placed in the Youth Social and Rehabilitation Center after receiving a judge's judgment; some have received a cut, while others have not, during their criminal sentence at the Social Protection and Rehabilitation Center. Adolescents and the factors that judges evaluate when making decisions about who gets a reduction and who doesn't in their criminal period at the Youth Social Protection and Rehabilitation Center. The goal of this research is to determine and assess the consequences of placing children in legal trouble at the Youth Social Protection and Rehabilitation Center in opposition to a judge's decision.The results of the study revealed that the implication of placing children in conflict with the law at the Youth Social Protection and Rehabilitation Center against the judge's decision is that in the judge's decision, there are children who receive a reduction and those who do not receive a reduction in the criminal period that has been served by the child judge at the Youth Social Protection and Rehabilitation Center, The judge considers the law, indictments/legal facts, results of the Litmas Penitentiary (BAPAS), prosecutors' demands, pleas, and public figures' opinions when deciding related cases, namely reducing or not reducing the criminal period that has been served by children at the Youth Social Protection and Rehabilitation Center said. When it comes to deciding whether to reduce or not reduce the criminal time, children who are placed in the Juvenile Social Protection and Rehabilitation Center must have a clear status; if they are prisoners, they must be deducted formally under the Criminal Procedure Code. If the child is neither a prisoner or a law enforcement officer, the judge considers whether the child's care or placement restricts his or her freedom. The judge may consider lowering the time of care/placement if it restricts the child's independence. In terms of lowering the child's criminal period while at the Balai, this can be factored into the decision, specifically in the legal reasons for imposing sanctions and in mitigating circumstances.

Abstract

Penelitian ini bertujuan mengetahui proses hukum yang dilalui oleh anak ketika berhadapan dengan hukum akibat perbedaan pandangan politik pada pemilu 2019 di Kota Yogyakarta, sehingga dari proses hukum yang dijalani oleh anak dapat mewujudkan keadilan restoratif, serta mengetahui upaya yang dilakukan para penegak hukum dalam memenuhi hak-hak anak ketika menghadapi proses hukum. Pendekatan yang digunakan oleh penulis adalah pendekatan yuridis normatif. Penelitian normatif yaitu penelitian hukum yang dilakukan dengan cara meneliti bahan pustaka atau sekunder. Hasil Penelitian menunjukan penanganan terhadap anak yang berhadapan dengan hukum akibat perbedaan pandangan politik dilaksanakan sesuai dengan aturan yang berlaku yaitu dalam proses persidangannya tetap berpedoman dengan Undang-Undang No. 11 Tahun 2012 tentang Sistem Peradilan Anak, namun terkait dengan upaya-upaya non ajudikasi tidak dilakukan sesuai dengan prosedur dikarenakan  akibat tindak pidana yang dilakukan oleh anak mengaibatkan luka berat hal ini diperkuat dengan Visum Et Repertum Nomor: 015 II 2019 RSDS tanggal 8 Februari 2019.

Abstract

The aim of this research are to find out how to implementation of government politicies for management of marine environment. Related activities of fishermen to use the type of trawling nets: and also to know the effectiveness of supervision on the damage of marine environment due to taking of the fish use of trawling nets  by fishermen: This research are using by the normative met head and this research also has supported by empirical, that obtained in the field.Resource person in this research are: Head of Conservation Lino de Jesus Martins, Head of IGPRP Lucas Fernandes, Head of Director National Board Orlando H Kalis, Head of investigation section of fisheries board Tomas G. R. de Sousa, Head of Biqueli village Daniel Martins and Head of Community shop Filipe Pereira while respondent in this research are 50 people fishermen in Biqueli village.            So the result of this research that quantitative analysed based on the quality in a system form and draw the conclusion that in accordance with existing legal issues. The results of this research just show that all this time of the fishermen often use the trawl nets before the socialization of the ministry of fisheries against many fishermen use the trawl nets in the their daily livelihood.            After the government socialization there were fishermen with a number of presentation rose to 60 percent, who understand the rules for implementing government policies related arrest fish with use the trawl nets, while 4 percent fishermen have not obtained information sauces details about ban on the implementation of government policies against the use existing of trawl nets, so threat the observation research in the field show the many fishermen currently no longer operate in the activities to catch the fish with trawl nets, because the government has anticipated with preventive steps through information sharing in the form of socialization, training, counselling and posting posters about the ban on fishing in the area of management marine environment

Abstract

The provision of legal assistance in criminal cases is one of the important things that must be given to every disadvantaged society but in reality this often becomes a problem in the lives of people who cannot afford it, therefore this study aims to 1To know the role The Institute for Legal Consultation and Assistance in cases of criminal acts that occur. 2 To find out what constraints faced by the Legal Consultation and Aid Agency in handling and resolving cases of crimes that occur. This study uses a normative method which refers to the application of legal norms or norms. The research was carried out using the literature approach and legislation, then analyzed the data using qualitative analysis methods, namely data sourced directly from the field which will then be presented descriptively. In helping disadvantaged people, the role of the Institute for Consultation and Legal Aid has not been carried out optimally because it is still constrained by human resources that are not yet sufficient in several Legal Aid and Consultation Institutions this is of course important to be noticed together by all parties, because the purpose of the presence of the Legal Consultation and Assistance Agency through Law No. 16 of 2011 concerning Legal Aid is to help poor people for free.
