Abstract

This article based on research carried out in 2021 among the Baha'i religious community in the village of Cebolek Kidul, District Margoyoso, Pati regency, Central Java. Baha’i is an independent religion although sometime people mistaken as a religious sect. Baha’i was first known in Persia in 1840s and came to Indonesia in 1870 brought by medical experts joint a UN’s program and merchants. Data of this article were collected through interviews, observations, documentations and focus group discussion. In Cebolek, there are 25 people of 9 families who observe Baha’i. The contributing factors to the consistency of the Baha'is in Pati (1) understand the meaning of prayer and worship, (2) the Bahai declarator, Mirza Husein, has the title Baha'u'llah who is believed to be a descendant of the saint, (3) Baha'i teachings have no conflict with the principles of humanity, (4) the Baha'i were inspired by the Baha'ullah spirit which was opposed by the religious community which previously existed (Islam) in Persia (Iran) from the beginning he spread his religion. The Bahai people face this opposition as a consequence, (5) the Baha’i people realize that the Baha’i experienced a phase of development through the stages of majhuliyah (unknown period), maqhuriyah (a period of opposition / hindrance), infisoliyah (a period of isolation /separation) with the majority community, istiqlaliyah (period of deliverance), rosmiyah (period of legalization / inauguration), gholabiyah (period of victory), and dzahabiyah (golden period).Keywords:

Abstract

Tujuan ditulisnya artikel ini memberi pemahaman pada penyelenggara negara dan masyarakat bahwa agama Baha’i adalah agama independen dan berhak hidup di Indonesia. Konsekuensinya, hak umatnya harus dipenuhi negara. Data diperoleh dengan wawancara dan diskusi tahun 2020 dengan umat agama Baha’i di Desa Cebolek Kidul, Kecamatan Margoyoso, Kabupaten Pati, Jawa Tengah, dan literatur. Data dianalisis dengan pendekatan deskriptif kualitatif. Hasil riset, hak umat agama Baha’i ada yang belum dipenuhi negara seperti permohonan akta kawin setelah kawin secara Baha’i, kolom agama dalam KTPnya tertulis setrip (-), dan pendidikan agama di sekolah formal diberi mata pelajaran agama non-Baha’i. Hal ini dipicu Kementerian Dalam Negeri tidak menindaklanjuti Surat Penjelasan dari Kementerian Agama Nomor MA/276/2014 kepada Pemda bahwa umat agama Baha’i berhak hidup dan haknya dilayani negara. Upaya yang harus dilakukan (1) Kemendagri menerbitkan surat kepada Kepala Daerah merujuk surat Menag Nomor MA/276/2014 tanggal 24 Juli 2014 agar melayani umat Baha’i, (2) Kemenkumham berdiskusi dengan Kemendagri karena belum terpenuhinya hak umat Baha’i di bidang Administrasi Kependudukan, (3) Pemkab Pati perlu memanfaatkan fasilitas negara dalam UU Nomor 16 Tahun 2011 tentang Bantuan Hukum. UU ini memfasilitasi pada warga (umat Baha’i) agar haknya difasilitasi pemerintah.

Abstract

The manuscript is written to portray a hamlet which formed pesantren (Islamic Boarding School) in which the santri (students) consists of santri mukim (students staying in boarding school) from various regions and santri kalong (local residents) and in which there is a mosque, a boarding school, an Al-Quran educational park, a madrasah diniyah, houses of clerics (in one settlement of village), the learning system of bandongan using the Tarjumah Book with Pegon-language written by KH Ahmad Rifa'i. The action of K. Rifai against Dutch colonialism was known as the Rifaiyah movement, his resistance with the movement of writing the Book of Tarjumah which contained Tawheed, Fiqh, and Sufism written in Pegon. Pegon was a resistance form against colonial Latin writing. Until now it was continued by his santri in the village where he lived serving as the cleric of Islamic Boarding School. The location of this research is in Tambangsari Hamlet, Kedungwinong Village, Sukolilo District, Pati Regency, Central Java. The data were obtained from January to June 2019 through interviews and observation with a descriptive qualitative approach. This hamlet of rice plantation and palawija (secondary crops) has formed a specialty called the tarjumah santri village. The successor generation of K. Rifai’s student who introduced the Book of Tarjumah in Tambangsari Hamlet was K.Hannan and it is now continued by his grandson. The learning of the Tarjumah Book had formed a distinctive hamlet community, namely dukuh santri. The obedience in worship with the knowledge of Islamic religion through the tradition of learning the Salaf Tarjumah across ages and genders and with the behavior in life adhering to Islamic law has been a social reality.

Abstract

The purpose of this article is portraying psychological impact of divorce for Samin people whose marriage is unregistered. Data are gathered through observation and interview among the leader and Samin people. Samin people do not register their marriage and thus, they do not undertake the regulation on the minimum age for marriage. Once divorce occurs, the wife receives psychological impacts: rumors of cohabitation (kumpul kebo), does not receive inheritance, rumors of illegal marriage. Some of Samin people try to find the way to have marriage certificate, thus register their community as a local religion. On April 25th, 2019, for the first time, the Office for Civil Affairs of Kudus issued marriage certificate for Samin people. Kudus government should pay attention to the minority rights.

Abstract

Rebo Wekasan is a popular practice among Indonesian Muslims, including those who live in Kudus, Central Java. This article discusses the practice of Rebo Wekasan in Indonesia generally, Kudus in specific, and the rite of drinking water salamun, as well as the practice of Rebo Wekasan from the perspective of 'urf. The anthropological approach is used to understand the tradition of Rebo Wekasan while the observation took place in 2021. Additionally, we also collected relevant documents including pictures and newspaper articles of Rebo Wekasan from 2018 to 2019, and interviews with 8 resource persons ranging from takmir (caretaker of the mosque), ceremonial committee, village officials, and visitors. Rebo Wekasan rite in Kudus is done by performing sholat tolak bala (prayer for anticipating any calamities) and drinking salamun (blessing-infused) water. People who attend the ceremony believe it based on religious belief and classic text showing that the last Wednesday in Safar month is the day of disaster advent. They also believe in the Javanese value that water is a medium of spiritual cleansing. In the perspective of 'urf (custom), Rebo Wekasan is deemed to fulfill aspects of ‘urf belonging to the category of 'urf shahih (good custom) because it contains noble values and is sourced from religious teaching.

Abstract

This article discuss about an application at Google Play Store that appears along with the rise of smartphone usage. It's also take effect to Muslims live style and religious practice, for example in reading Quran.  There are many Quran applications are available on the Play store, its raises questions on religious authorities because anyone can upload an Android-based Quran application on the Play store. A descriptive qualitative approach use to analyze Qur’an apps in Google Play store. The apps are chosen based on the numbers of download and comments from the users. The results show that the growth of digital Quran applications raises new styles of worship such as reading the Quran on smarthphone application.

Abstract

Perkara waris memiliki makna penting bagi masyarakat Indonesia. Hal ini bisa dibuktikan dengan adat yang berlaku di masyarakat tentang tata cara serta bagian masing-masing pihak dalam kewarisan. Artikel ini membahas seputar apa dan bagaimana hak opsi dalam sengketa waris bagi umat Islam di Indonesia. Bermula dari sistem politik yang diterapkan pemerintah kolonial Belanda dengan tujuan untuk membatasi berlakunya hukum Islam. Kebijakan penerapan hukum Islam, termasuk waris, boleh dilakukan selama hal itu tidak bertentangan dengan hukum adat. Masyarakat diberi kebebasan untuk memilih hukum apa yang akan diterapkan. Kebebasan untuk memilih hukum dalam bidang waris diteruskan oleh pemerintah Indonesia setelah Proklamasi kemerdekaan dan semakin dilegalkan dengan UU No. 7/1989 tentang Peradilan Agama. Meski klausul hak opsi hukum waris tersebut telah dihapus dengan adanya UU No. 3/2006 (perubahan atas UU No. 7/1989), namun secara implisit hak opsi masih diakui keberadaannya karena penghapusan tersebut tidak disebutkan secara eksplisit.

Abstract

This paper is a qualitative research based on observation and interview among Samin community in Kudus. The purpose of this study is presenting unregistered marriage among Samin community. Samin community is the descendants and followers of Ki Samin Surosentiko, renowned for his nonconformity against the Dutch since 1840s. Following the teaching, Samin people do not registered their marriage and thus they do not feel necessary to obey the government regulation on the minimum age of marriage. The marriage among Samin community will be performed once a girl and a boy perceived to be ready. There are three stages of maturity: adam timur, adam brahi and wong sikep kukuh wali adam. This understanding may lead to child marriage and among its negative impact is divorce. The consequences of unregistered marriage go further to dispute of marital property, right of guardianship, and even conflict between relatives. Nowadays, some Samin people try to find a way to register their marriage in order to get a marriage certificate from the Office of Civil Administration of Kudus. Abstract

Formalisasi syari’ah di  beberapa kota  di  Indonesia telah memicu perdebatan  terbuka terutama di  media. Dalam  surat kabar Indonesia, banyak pendapat telah ditulis dengan pro-kontra  oleh berbagai pihak mengenai formalisasi syari’ah. Artikel  ini  menganalisis pendapat yang  di terbitkan  di  Kompas dan  Republika selama 2000-2004. Ada  44 artikel  diperoleh dari kedua surat  kabar tersebut. Perdebatan tentang formalisasi di  Indonesia adalab antara Islam  liberal d a n  Islam fundamental. Jumlah artikel  mengenai formalisasi syariah muncul di  dua  surat  kabar  berbeda. Sebagian besar artikel  di  Republika memberikan pendapat dari  para  pendukung formalisasi ,  dan  hanya seperempat dari  mereka  yang  menentang pelaksanaan syariah. Artikel  di  Kompas hampir seimbang dalam hal proporsinya. Delapan artikel  menunjukkan persetujuan pelaksanaan syariah, sedangkan artikel sebelas menunjukkan  ketidaksepakatan.
