Abstract

Many research centres have emerged in zakat institutions to encourage the efficiency of zakat fund management. It is a positive effort to optimize the use of zakat funds. This study aims to analyze the law on using zakat funds for research centres. To achieve this goal, this article compares the practice of IDEAS (Indonesia Development and Islamic Studies) research centre Dompet Dhuafa with the fiqh concept of eight groups of zakat recipients. This research will focus on defining the meaning of fī sabīlillah (for the cause of Allāh) and āmil (those employed for zakat) for eight groups of zakat expenditures by looking at the practice of Dompet Dhuafa in Indonesia. The results of this study indicate that research centres of zakat institutions can be considered 'amil if they have official permission from the government. However, research centres that do not have legal permits cannot be given zakat funds. This study will come with results from an Islamic perspective and suggestions for future research.   Abstrak: Dengan munculnya banyak pusat penelitian di lembaga zakat untuk mendorong efisiensi pengelolaan dana zakat, hal tersebut merupakan upaya positif untuk mengoptimalkan penggunaan dana zakat. Abstract

Indonesia is a country with the largest Muslim population in the world and has extraordinary potential in the amount and assets of Islamic microfinance and can be a reference for the application of Islamic Microfinance in other countries. The purpose of this study was to review the problems in murabaha financing at Islamic Microfinance Institution (IMFI) and the treatments. The approach used was a qualitative analysis of Indonesian literature studies about the specific type of murabaha financing with content analysis and thematic analysis techniques. This study found that internal and external factors caused problematic murabaha financing in BMT. Internal factors include the inaccuracy of BMT in 5C (Character, Capacity, Capital, Collateral, and Condition), lack of supervision, procedures violations, facilities and infrastructure, and lack of human resources (HR). Meanwhile, external factors include bad customers, unexpected circumstances of customers, lack of customer income, inflation, and government policies. The actions done by the BMTs to overcome problematic murabaha financing were by implementing BMT guidelines for prospective customers, preventing and repressive supervising, applying a democratic leadership style, applying fines, rescheduling, restructuring and reconditioning write off, auction of collateral, and legal actions. This study recommends strengthening financing selection by improving human resource skills and also variations in handling murabaha financing with a humanist approach.

Abstract

The development of Islamic literacy in Indonesia shows the capability of the nation in competing with other Muslim nations. However, copyright is often neglected by many parties. The study aims to assess the implementation and effectiveness of the copyright in law No. 24 of 2014 and MUI Fatwa No. 5 of 2005. A qualitative methodology has been conducted with the approach of literature and field study. The data was obtained through interviews and observations with 3 academic authors and 9 non-academic authors. The results of the study indicate that the  majority of the academic authors argue that there is a lack of enforcement and impact in the law and fatwa. Similarly, the other authors carry the same opinion with some highlights on its effectiveness. The paper suggests that policymakers intensify the implementation and effectiveness of copyright law and fatwa in Indonesia. The enforcement of the law and fatwa will lead to the prosperity of authors and lead to a knowledgeable society. The study keenly expects future studies in the field to cover more samples with different methodologies.
