Abstract

Legal compliance in the community is always an interesting issue to discuss. The research question in this study is how the compliance of the members of the Tadulako University academic community in response to the Decree of the Minister of Health of the Republic of Indonesia Number: HK.01.07/MENKES/413/2020 concerning Guidelines for the Prevention and Control of COVID-19 through the implementation of Tracing, Testing, and Treatment (3T Program)? To answer the research objectives, empirical legal research (socio-legal research) was conducted to support the depth of analysis. The analysis materials include data on the conditions and levels of health risks experienced by the academic community based on the available COVID-19 link records, data on the number and distribution of academic community members who have been infected with COVID-19, and data on the implementation of the 3T program sourced from Tadulako Hospital. Starting from the interpretation of the research data analysis, the findings revealed: (a) there are some members of the academic community who do not respond to filling in data regarding the condition and level of health risk on the available COVID-19 link; (b) members of the academic community who have had a history of contact with COVID-19 sufferers have not all complied with the rules for preventing and handling COVID-19 through the implementation of 3T; (c) members of the academic community who are declared positive for COVID-19 infection have relatively high legal compliance in supporting the implementation of treatment. Their legal compliance is categorized as identification according to Herbert C. Kelman’s theory.

Abstract

This research aims to conduct a comprehensive analysis of the local government's authority in the fisheries sector in Donggala Regency. Additionally, it aims to formulate the division of authority between the local government of the regency and the province in overseeing the production, processing, and distribution of fishery products in Donggala. The governance is based on the principle of support duties in the marine and fisheries sector, operationalized through various Minister of Marine Affairs and Fisheries regulations (PERMEN-KP) as a follow-up to Law Number 45 of 2009 concerning Fisheries. This is reinforced by Law Number 23 of 2014 concerning Regional Government, governing the supervision of the production, processing, and distribution of fishery products. Nevertheless, there is still varied interpretation of the terminology of Fish Auction Places (TPI) and the origin information services for fish from fishery production centers. The research method employed is normative legal research combined with field data collection. Legal and conceptual approaches are applied to discuss the local government's authority in overseeing the production, processing, and distribution of fishery products, with Donggala Regency as a case study. Amendments to articles in PERMEN-KP regulating the management of TPI and the distribution of fishery products are deemed necessary. These amendments can assign a role to regencies/cities in the management and organization of (TPI) and the legality of the origin of fish within the jurisdiction of regencies/cities, reflecting the implementation of the autonomy principle and support duties. Abstract

Since the previous election, the issue of electoral violations has become an inevitable problem. Almost every stage of the elections leaves the issue of violations dealt with by the Bawaslu of Parigi Moutong district, which allows them to make legal analysis and legal opinions. Basically, legal opinions are made to solve a particular problem. Clients often raise this problem. Therefore, a Legal Opinion should be made carefully, orderly, and proportionate. Besides, it has to be systematic in order to be understandable. Although there is no standard format for Legal Opinions, a minimum LO consists of: (1) Fact, (2) Issue, (3) Rules, (4) Application, and (5) Conclusion

Abstract

The existence of Covid-19 in Indonesia has now had its status changed from pandemic to endemic. However, its existence still poses a serious threat to the general health of Indonesian citizens. Since 2019, the government still pays close attention to the existence of Covid-19, by implementing various policies to ensure health protection for the citizens as a Constitutional mandate. In the light of that, this research discusses how the concept of protecting the right to health is understood in the Constitution and whether the vaccination policy is in line with the Constitution. This research uses normative methods. This research concludes that, first, the concept of protecting the right to health in the Constitutional takes the form of understanding with a social-solidarity dimension which is based on the protection of human rights as part of human dignity in achieving public benefits. Second, the vaccination policy implemented by the government is in line with Constitutional values considering it includes protection of the right to health.Keywords: Constitution; Covid-19; Policy; Vaccination. AbstrakKeberadaan Covid-19 di Indonesia saat ini telah mengalami perubahan status dari pandemi menjadi endemi, akan tetapi keberadaannya masih memberikan ancaman yang serius bagi kesehatan warga negara Indonesia. Sejak Tahun 2019 hingga saat ini pemerintah masih memberikan perhatian terhadap keberadaan Covid-19, dengan melakukan berbagai kebijakan guna memastikan perlindungan Kesehatan bagi warga negara sebagai amanat konstitusi. Sehingga penelitian ini membahas bagaimanakah konsep perlindungan hak Kesehatan dalam paham konstitusi dan apakah kebijakan vaksinasi telah selaras dengan konstitusi. Penelitian ini menggunakan metode penelitian normatif. Penelitian ini berkesimpulan, yakni, pertama, konsep perlindungan hak Kesehatan dalam paham konstitusi bermatra sosial-solidaritas yang bertumpuh pada perlindungan hak asasi manusia sebagai bagian dari harkat kemanusiaan dalam mengapai kemaslahatan. Kedua: kebijakan vaksinasi yang dilakukan oleh pemerintah telah selaras dengan nilai–nilai konstitusi karena memuat perlindungan terhadap hak kesehatan.Kata Kunci: Covid-19; Kebijakan; Konstitusi; Vaksinasi

Abstract

Legal provisions that live in society are one of the controversial provisions in the ratification of the Draft Criminal Code (RKUHP). That is because the law in the community is related to legal values written and unwritten in society. This study aims to analyze the legal aspects of culture in RKUHP. This research is normative legal research that puts forward legal issues on the implications of legal arrangements regarding living law in the RKUHP and focuses on using a conceptual and statutory approach. The results of the study confirm that the construction of living law in the community (living law) in the RKUHP, which emphasizes that the living law is customary law, is also formulated simultaneously with the regional role in establishing regional regulations based on the substance of local customary law. In addition, the construction of regional rules to accommodate Article 2 of the RKUHP to regulate the importance of customary law raises legal ambiguity, namely regional rules at the provincial or regency/city level that have the authority to regulate them; so that there is no disharmony of customary law arrangements in the formulation of regional regulations as a follow-up to Article 2 RKUHP. Furthermore, the legal implications related to living law arrangements in the RKUHP, namely the lack of clarity in Article 2 of the RKUHP, including the need for regulation at the regional level through regional regulations, have the potential to cause criminalization based on regional principles

Abstract

Artikel ini menganalisis Putusan Nomor 47/Pdt.Sus-PHI/2018/PN.Pbr untuk menilai ketepatan dan aspek keadilan dari pertimbangan hukum oleh majelis hakim. Analisis menggunakan pendekatan analisis teks dalam putusan yang berfokus pada hukum acara, penalaran hukum, dan kesesuaian antara pertimbangan hakum dengan amar putusan. Untuk memfokuskan analisis terhadap putusan ini, dirumuskan pertanyaan utama yang menjadi landasan kajian, yaitu: pertama, apakah pertimbangan hakim dalam Putusan Nomor 47/Pdt.Sus-PHI/2018/PN.Pbr sudah tepat dan sudah memenuhi aspek keadilan terhadap karyawan dengan perjanjian kerja waktu tidak tertentu (PKWTT); kedua, mengapa pendapat berbeda dalam putusan tersebut merupakan concurring opinion. Penelitian ini menggunakan metode penelitian deskriptif-analitis. Penelitian ini juga menggunakan pendekatan peraturan perundang-undangan, pendekatan fakta hukum, dan pendekatan studi kasus (case study) untuk menemukan pengaturan prospektif berkaitan dengan konsep PKWTT melalui penalaran hakim dan konsep concurent opinion dalam putusan. Hasil penelitian menunjukkan bahwa hakim menggunakan pendekatan realisme hukum dalam menilai fakta. Peristiwa hukum yang terjadi antara pemberi kerja dan penerima kerja dalam perjanjian kerja merupakan pekerjaan yang termasuk dalam kategori PKWTT, bukan perjanjian kerja waktu tertentu (PKWT). Perbedaan pertimbangan dari hakim anggota kedua nampaknya bukan merupakan dissenting opinion melainkan concurrent opinion. Hakim anggota kedua memiliki kesamaan pandangan dengan majelis hakim lainnya dalam menafsirkan bahwa hubungan kerja yang terjadi merupakan PKWTT, bukan PKWT. Namun demikian, perbedaan pendapat muncul terkait besaran upah proses yang dinilai layak untuk dibayarkan kepada pekerja.
