Abstract

Penelitian ini membahas praktik hibah sebagai mekanisme dalam pembagian waris di masyarakat adat Batak Mandailing, Desa Pagaran Baringin, Kecamatan Barumun, Kabupaten Padang Lawas, Sumatera Utara. Masalah penelitian berfokus pada perbedaan hukum dan praktik hibah dibandingkan dengan wasiat, infak, dan pemberian lainnya, serta bagaimana hibah dapat digunakan tanpa menghilangkan nilai ilmu faraidh. Tujuan penelitian adalah menganalisis kedudukan hibah dalam waris, penerapannya kepada salah satu anak, serta perspektif ulama tafsir dan hukum positif terkait hibah. Metode yang digunakan adalah kualitatif dengan Library Research, menggunakan pendekatan tafsir bilma’sur dan tafsir kontekstual untuk menelaah literatur fiqh, tafsir Al-Qur’an, serta regulasi hukum seperti KUHPerdata dan KHI. Penelitian menelaah dokumen dan literatur klasik, serta peraturan hukum kontemporer, untuk memahami korelasi antara prinsip keadilan, fleksibilitas sosial, dan praktik hibah dalam keluarga. Hasil penelitian menunjukkan bahwa hibah sah digunakan sebagai mekanisme dalam waris, termasuk pemberian kepada salah satu anak, dengan catatan kesepakatan ahli waris dan prinsip keadilan tetap dijaga. Hibah mencerminkan refleksi hati orang tua, sejalan dengan contoh kasih sayang dalam sejarah nabi dan ajaran Islam. Selain itu, praktik hibah memberikan fleksibilitas bagi orang tua untuk memberikan reward atau bantuan kepada anak tanpa menyalahi hukum waris, meskipun terdapat batasan pada hukum positif yang membatasi hibah pasca kematian pewaris. Penelitian ini menekankan bahwa hibah dapat menjadi alternatif mekanisme waris yang sah, adil, dan fleksibel, serta memberikan kontribusi bagi pengembangan hukum Islam kontemporer dan kebijakan keluarga, sekaligus menjadi referensi bagi studi lanjut mengenai interaksi hukum adat, hukum positif, dan praktik keagamaan.

Abstract

Penelitian ini menyimpulkan bahwa strategi pemasaran wirausaha pada era digital menurut perspektif Al-Qur'an mencakup enam model, termasuk pelatihan ketrampilan karyawan, iklan online, email marketing, platform media sosial, pesan teks, dan strategi pemasaran berbasis business model canvas. Kesimpulan tersebut didasarkan pada analisis teori-teori pemasaran wirausaha dari berbagai era serta analisis ayat-ayat Al-Qur'an yang terkait dengan strategi pemasaran wirausaha. Penelitian ini memiliki kesamaan dengan pendekatan moral dan etika dalam pemasaran seperti yang disarankan oleh beberapa tokoh pemasaran, namun menekankan integrasi dan pendekatan jangka panjang yang berbeda dari teori-teori yang ada. Metode penelitian yang digunakan adalah kualitatif dengan pendekatan studi pustaka dan menganalisis ayat-ayat Al-Qur'an menggunakan Tafsir Tematik

Abstract

Islamic communication is one of the keys in improving the religiosity of migrant children in Sentul Guidance Center Malaysia, with the aim of informing, changing attitudes, opinions or behavior of someone either verbally or indirectly, to be able to communicate well, it is required not only to understand the process, but also to be able to apply knowledge creatively. This article aims to explore Islamic communication in Sentul Guidance Center Malaysia in enhancing the religiosity of migrant children. The research method is qualitative with a case study approach. Research data were obtained through observation and interviews. The data is then analyzed, compiled, and presented in the form of a report or narrative. The results of this study show: First, Sentul Guidance Center implements qaulan sadidan when practicing congregational prayer with migrant children. Second, Sentul Guidance Center implements qaulan baligha, to migrant children to care about the environment. Third, Sentul Guidance Center implements qaulan ma'rufa when inviting migrant children to live a healthy life by exercising. Fourth, Sentul Guidance Center implements qaulan karima when practicing duha prayer with migrant children. Fifth, Sentul Guidance Center implements qaulan layyina when habituating reading surahs in every learning process with migrant children. Sixth, Sentul Guidance Center implements qaulan maysura, when inviting Malaysian migrant children to behave in a disciplined manner.

Abstract

This article examines the concept of piety in Islam comprehensively by positioning the jilbab as one of the symbols situated between personal dimensions and social demands. In Islam, piety is not merely understood as individual ritual practices such as prayer, fasting, zakat, and pilgrimage, but also encompasses social, biological, aesthetic (appearance-related), and spiritual dimensions of piety. Grounded in the principle of tawhid as its primary foundation, this study affirms that piety represents an integration between the vertical relationship (ḥablum minallāh) and the horizontal relationship (ḥablum minannās). Within this framework, the jilbab is not solely perceived as a normative obligation or a symbol of religious identity, but also as a social construct rich in historical, cultural, and ideological meanings. Historically, the practice of head covering was known in various ancient civilizations prior to Islam, and was later adopted and reconstructed within the ethical and spiritual framework of Islamic teachings. From the perspective of symbolic interactionism, the jilbab functions as a medium of social communication that both shapes and is shaped by the collective meanings within society. In Indonesia, the dynamics surrounding the use of the jilbab demonstrate a shift in meaning—from merely a symbol of ritual piety to a marker of social identity, lifestyle, and even cultural expression. Nevertheless, reducing piety to its symbolic aspects risks creating an imbalance between outward (external) and inward (spiritual) piety. Through a descriptive-analytical approach supported by Islamic literature review and historical-sociological analysis, this article concludes that authentic piety is holistic in nature, integrating ritual, social, biological, aesthetic, and spiritual dimensions in a balanced manner. As a representation of piety, the jilbab should not be confined to an external symbol, but should instead manifest spiritual consciousness, moral integrity, and social responsibility in communal life

Abstract

Islamic law instructs the guardians of orphans not to arbitrarily affect the orphans and their property. Because children are part of the younger generation as one of the human resources who have a strategic role in forming a better family. Guardians should not behave unjustly towards orphans. he law recommends the guardian to make a list of assets so that the guardian's property is not mixed with the orphan's property and in Law No. 1 of 1974 concerning Marriage, it is regulated about the prohibition of using and consuming excessively, moving and selling the 1 Nurkhafifah Tamsyur property of orphans. However, the reality of society, in the care of orphans has not been carried out as specified in Islamic teachings. In maintaining the property of an orphan by a guardian, the guardian must have a concept in managing finances on a monthly or yearly basis, it is better if he develops his property so that it is "alive" and not "frozen" in order to get benefits to cover his daily life. And if the child has reached puberty, is an adult or can manage his own property, his property must be handed over honestly according to the assets he has and when submitting he must present witnesses so that there is a guarantee for his responsibility so as not to cause disputes or quarrels that can lead to disputes and conflicts. prejudice, By understanding the maintenance of the orphan's property, the guardian or the one who is entrusted with the care of the orphan's property can be more careful and pay attention to the property as best as possible starting from the time it is guarded until the time it is handed over when the child is an adult. Abstract

At the same time as respect for the status and dignity of women is growing, several hadiths are misunderstood as misogynistic hadiths that demean women. Among the misunderstood hadiths is the hadith which states that women are less intelligent. This hadith in Ibn Kathir's book is used as an interpretation of the QS. Al-Baqarah 282 regarding testimony. So this increasingly gives rise to readers' belief that female creatures are creatures that are less intelligent than male creatures. This article wants to clear up this misunderstanding by explaining the correct understanding of this hadith, by analyzing it textually and contextually

Abstract

This article discusses the phenomenon of interfaith marriage which is currently gaining popularity in Indonesia and invites pros and cons in society. In the perspective of Al-Qur'an interpretation, the author chooses to refer to two famous Indonesian commentators, namely Buya Hamka and M. Quraish Shihab. Both are figures of the modern-contemporary era in the field of interpretation, so their opinions are relevant to the current situation in Indonesia. In the interpretation of the Qur'an, the two commentators above interpret the QS. Al-Ma'idah [5]: 5 by prioritizing a spirit of tolerance and criticism of interfaith marriages. Even though there are constitutional arguments that regulate whether a marriage is valid or not based on the laws of each religious belief, facts on the ground prove that interfaith marriages still often occur in Indonesia. Thus, this research invites readers to understand more deeply the phenomenon of interfaith marriage through the lens of Al-Qur'an interpretation and Abdullah Saeed's approach. Hopefully this research will provide broader insight and understanding regarding the phenomenon of interfaith marriages in Indonesia

Abstract

This study explores the integration of universal Islamic values with local culture through an analysis of the interpretation of QS Al-Baqarah verse 177 within the framework of Islamic indigenization (pribumisasi Islam) as conceptualized by Abdurrahman Wahid (Gus Dur). The verse is chosen for its emphasis on the principles of al-birr (righteousness), which encompasses not only theological aspects but also social and humanistic dimensions. Using a qualitative approach through literature review, this research examines how Gus Dur interprets righteousness as concrete social action and how he articulates these values within the pluralistic context of Indonesian society. The findings indicate that Gus Dur views QS Al-Baqarah:177 as theological justification for the integration of Islamic teachings and local culture, where values such as justice, equality, and solidarity with the marginalized serve as the foundation of social ethic
