Abstract

Gender merupakan interaksi sosial masyarakat yang membedakan perilaku antara laki-laki dan perempuan secara proporsional menyangkut moral etika dan budaya. Kekeliruan dalam merefleksikan konsep purusa dan pradana dalam wujud laki-laki dan perempuan dalam kehidupan sosial di masyarakat telah menimbulkan adanya ketimpangan dan ketidakadilan terhadap perempuan di Bali, yang memandang laki-laki memiliki kedudukan yang lebih istimewa dari pada perempuan. Hal ini tercermin dari pemberlakuan hukum adat yang masih belum memiliki kesetaraan gender  walaupun dari hasil penelitian terdahulu menyatakan bahwa Kaum Perempuan Bali tidak merasa mengalami ketidakadilan gender karena memaknai setiap perannya sebagai suatu kewajiban, walaupun sebenarnya Perempuan Bali merasakan beban kerja akibat ketimpangan peran yang diterimanya.  Hal ini kontradiktif dengan Pandangan Hindu yang memuliakan kaum perempuan sebagai kekuatan  sakti, yang memiliki  peran yang penting dalam penciptaan alam semesta .

Abstract

The difference in religious ideology in the Dayak Katingan family in the village of Tewang Tampang in reality does not trigger conflict, they always live in harmony and harmony. This can be seen from their intimacy and togetherness in daily social interactions. However, behind this harmony there is also a struggle for religious ideology in the practice of tradition. For this reason, the purpose of this study was focused on knowing how the Dayak Katingan family in Tewang Tampang Village articulated its diversity and outlined its implications for harmony in the family. This study uses a qualitative method. Data sources are primary and secondary data. Data was collected through participant observation techniques, in-depth interviews, and document studies. Determination of informants was conducted purposively and Snowball, the theories used were phenomenology theory, hermeneutic theory, and communicative action theory. The results showed that the way the Dayak Katingan family in Tewang Tampang village articulated their family traditions in a different way between Kaharingan Hindus, Islam and Christianity. This can be seen from the articulation presented by them, namely the Hindu Kaharingan people articulating tradition as part of religious rituals and in practice based on established rules. Meanwhile Muslims and Christians only articulate tradition as part of Dayak customs and culture and in practice adapts to the teachings of the religion adhered to. This difference in articulation of tradition has implications for religious attitudes in the family such as the opening of a space for dialogue, a tolerant attitude of religion, and a strengthening of family relations. Abstract

This study analyzed forms of social interaction and the existence of Balinese culture in multicultural communities in Tangkiling Village, Palangka Raya City, Central Kalimantan. The issue discussed with intercultural theory interaction with descriptive qualitative method. The results showed that the form of social interaction carried out by Balinese transmigrants in Tangkiling in the religious field was tolerance based on Tat Twam Asi, in the social sector developing a helping attitude, forming a farmer group named Sari Bumi Farmer Group, and actively joined in the membership of the Neighbourhood Security System. Competition and conflict also occur but can be managed properly so that it does not become an open conflict. These affect of Balinese culture existence in the Tangkiling, including the existence of sanggah­-shrine, the concept of ngayah (religious volunteer), the tradition of annual giant-idol of ogoh-ogoh parade, and the use of decorated bamboo penjor usage. These make Balinese culture sustainable in the midst of multicultural and religious plurality.

Abstract

This article aims to analyze and describe the articulation and forms of communication carried out by communities of different customs, cultures and religions in Tangkiling Village, Bukit Batu District, Palangkaraya City. The problem is studied using intercultural communication theory. The method used is descriptive qualitative method, in which the data obtained is presented in the form of words which are assembled from information obtained from informants in the field. The data were collected through observation, in-depth interviews, and document study. Informants are selected by purposive sampling by looking at the knowledge and experience they have according to the data to be sought. Then the data is processed through three stages, namely data collection, data reduction, and data presentation. The results showed that the harmony of the multicultural society in Tangkiling Village was seen from the activities carried out in their daily social interactions such as: religious tolerance, mutual respect cooperation, while the articulation of the Tangkiling community towards differences in cultural customs was seeing culture as just another person's way of doing things and culture it is only a habit that has been carried out from generation to generation which is formed from the geographical conditions of the area.The form of intercultural communication carried out by multicultural communities in Tangkiling Village is through cultural adaptations such as language adaptation, food adaptation, and adaptation in cultivating agricultural land.

Abstract

Perkawinan beda agama dewasa ini marak terjadi di tengah-tengah masyarakat. Hal ini tidak terlepas dari adanya pengakuan pluralitas agama yang diakui secara resmi oleh pemerintah Indonesia. Ada enam agama resmi yang diakui di Indonesia yaitu, agama Islam, Kristen, Protestan, Hindu, Budha, dan Kong Hu Chu. Namun demikian Perkawinan beda agama di Indonesia belum diatur secara tegas dalam perundang-undangan yang ada. karenanya masih terjadi perbedaan artikulasi dalam melihat dan memahami perkawinan beda agama di tengah-tengah masyarakat. untuk itu dalam karya ilmiah ini penulis mengangkat tentang pengesahan perkawinan beda agama dalam persfektif hukum Hindu, Dengan rumusan masalah (1) Bagaimanakah bentuk Perkawinan secara umum yang diatur dalam UU No 1 Tahun 1974?; (2) Bagaimanakah Pandangan Hindu terhadap sahnya perkawinan beda agama di tengah-tengah masyarakat?; (3) Bagaimanakah Bentuk penyelesaian perkawinan beda agama dalam persfektif hukum Hindu? Karya ilmiah ini menggunakan metode penulisan normative dengan mengacu kepada berbagai literature atau pustaka berupa bahan hukum primer seperti UU Perkawinan No 1 Tahun 1974, dan sekunder. Hasil yang diperoleh menunjukkan bahwa bentuk perkawinan dianggap sah sesuai UU RI No. 1 Tahun 1974 pasal 2 ayat 1 jika dilaksanakan sesuai dengan agama dan keyakiannya masing-masing. Ayat 2 perkawinan tersebut harus didaftarkan sesuai dengan peraturan perundang-undangan yang berlaku. Pandangan Hindu terhadap sahnya perkawinan beda agama di tengah-tengah masyarakat dianggap sah apabila dilaksanakan sesuai dengan hukum agama Hindu, dilaksanakan dengan ritual Hindu (pabiokawonan) yang dipimpin oleh seorang pendeta atau pinandita. Penyelesaian perkawinan beda agama dalam hukum Hindu dilaksanakan dengan ritual sudhiwadani (ritual pengukuhan untuk masuk menjadi penganut agama Hindu) bagi pasangan pengantin yang belum menganut agama Hindu

Abstract

Social interaction can be done by communicating to exchange information. The development of the era makes changes in behavior and actions in utilizing a technology in terms of communication, one of which is in terms of religious activities. Religious interaction that is often used by Kaharingan Hindus is the implementation of Basarah worship activities which are usually carried out every Friday or Thursday night. However, with the development of the era, many Kaharingan Hindus convert themselves to other religions. This is inversely proportional to the area in Timpah Village, Kapuas Regency where the number of Kaharingan Hindus who are there is still a lot, especially the people there have used communication technology to carry out social interactions in religion. This is what makes the attraction of researchers wanting to do research on the use of communication technology as a medium for social interaction in the implementation of Basarah in Timah Village, Kapuas Regency. This study aims to determine the methods or strategies carried out by religious leaders and administrators of the Kaharingan Hindu Religious Resort Council in utilizing communication technology for the implementation of Basarah worship activities. The method used in this research is descriptive qualitative method by describing the results of interviews obtained in the field. The results of this study found that the role of religious leaders and administrators of the Kaharingan Hindu Religious Resort Council was very important in providing guidance and strengthening religious values, especially in Basarah worship activities. Abstract

Tujuan artikel ini adalah untuk mengkaji pengaruh budaya patriarki terhadap system pewarisan pada masyarakat Bali, pengaruh hukum agama Hindu terhadap system pewarisan pada masyarakat Bali dan mengetahui kedududkan dan peran perempuan setelah menikah dalam sistem pewarisan masyarakat Bali. Artikel ditulis dengan metode kepustakaan dan di sajikan secara deskriptif kualitatif Adapun hasil kajian dari artikel ini adalah pengaruh budaya patriarki dalam system pewarisan masyarakat Bali adalah diutamakannya anak laki sebagai ahli waris dalam keluarga. Demikian juga pengaruh hukum waris Hindu dalam system pewarisan masyarakat Bali, di mana anak laki-laki sebagai status purusa memegang peranan penting dalam keluarga selain sebagai ahli waris dalam artian harta benda juga sebagai penerus keturunan dan kewajiban yang dimiliki oleh orang tuanya. Abstract

ABSTRACT The purpose of this writing is to examine the existence of local culture in character education during the era of modernization. Character education is a matter of utmost urgency and importance for the younger generation in the midst of increasingly sophisticated technological advancements. This progress not only brings positive influences but also negative ones, such as the erosion of the nation's moral values due to the influence of foreign cultures that may not align with the nation's noble values. To fortify the younger generation against various negative impacts of technological progress, local culture, as one of the systems of values growing and evolving within a society based on religious teachings, morality, and intergenerational experiences, is crucial as a moral foundation in shaping the character of the nation's children. This aims to cultivate a young generation with noble behavior, integrity, religious values, and empathy towards various issues in their surrounding environment. Abstract

In the midst of rapidly changing social dynamics, it is crucial to recognize the rights of women or widows as heirs by ensuring that they receive a fair share of inheritance in accordance with their contributions and roles in building the family and household. Therefore, there is a need for awareness regarding the protection of the rights of women or widows in the context of inheritance law, allowing them to receive fair and equal treatment in the distribution of inherited assets. This is a significant step towards achieving gender equality and justice in Indonesian society. This research focuses on examining and understanding the complex issues related to the procedures for the distribution of the inheritance of a deceased husband to a widow in the village of Sigi, Pulang Pisau Regency, Central Kalimantan Province. The study aims to provide profound insights into the practices and perspectives of the community regarding customary inheritance law and its influence on the rights of women or widows in inheriting their husband's estate. Through this research, it is hoped that solutions can be found to address the injustice often faced by women or widows in inheritance distribution. Additionally, the study aims to provide policy recommendations to enhance the protection of the rights of women or widows in the community. The method employed is empirical legal research using a qualitative approach. The conclusion drawn from the research is that the inheritance law system in the village of Sigi, Kahayan Tengah District, Pulang Pisau Regency, prioritizes customary inheritance law in the distribution of inherited assets by upholding noble values based on the principle of family solidarity. This is done through consensus and the distribution of inherited assets to all surviving family members, including widows or widowers and legitimate children or their descendants. The process is conducted fairly and evenly through family consensus and the eldest sibling or the appointed elder leading the family consensus.

Abstract

Tujuan dari penulisan artikel ini yaitu ingin mengungkapkan sebuah fenomena bahwa dalam sistem pewarisan keluarga Hindu Bali mulai mengalami pergeseran ke arah yang lebih positif. Perubahan ini sebagai wujud adanya persamaan atau kesetaraan walupun tidak sama rata. Metode yang digunakan dalam penelitian ini adalah hukum empiris. Dimana data-data yang diperoleh bersumber dari lapangan sebagai data primer dan didukung dengan data skunder. Analisis data yang dilakukan adalah dengan deskriptif kualitatif. Dari analisis data yang dilakukan dapat ditarik kesimpulan bahwa pemberian hak waris kepada anak perempuan dalam keluarga Hindu Bali, bahwa pertimbangan orang tua adalah semua anaknya baik laki-laki maupun perempuan adalah darah dagingnya. Kemudian pemberian hak tersebut juga bentuk kasih sayang orang tua terhadap anak perempuanya. Pemberian hak waris kepada anak perempuan tentu juga berdasarkan kesepakatan keluarga, terutama pihak laki-laki sebagai purusa. Sedangkan penerapan hak waris anak perempuan dilakukan secara langsung oleh orang tua sebagai pewaris. Jumlah besaran yang diberikan tentu tidak sama dengan anak laki-laki. Karena pada prisnsipnya dalam keluarga Hindu menganut sistem patrilinial. Dimana anak laki-laki sebagai ahli waris dan mempunyai hak yang penuh dalam keluarga.
