Abstract

This article aims to explore the phenomenology of the traditional jujur tradition that is still alive in the Musi River community amidst the dynamics of changing times. Jujur is a tradition in pre-wedding engagements when the groom's family gives a sum of money to the bride at the bride's request. This article aims to explore the social construction of jujur among the millennial generation born between 1980 and 2000. The research method uses empirical legal research methods with a structural approach. The research theory uses Peter. L. Berger's social construction. The research informants are community leaders and millennial generation husband and wife couples. The results of the article show the externalization of jujur in the form of giving money, noodles and gold and adapting to the economy and education of women, the objectification of jujur in the form of socialization that is so strong between generations that it creates an understanding that jujur is part of the marriage process and there are fines for violators of the engagement. The internalization of jujur is jujur as a symbol of male responsibility towards the family. The contribution of this research shows the existence of customary law as one of the sources of Indonesian national law, the treasure of interdisciplinary studies in the study of Islamic family law in Indonesia.

Abstract

Purpose – The purpose of this study is to analyze contemporary judges' considerations in divorce case rulings at the Surabaya Religious High Court and to examine the principle of reciprocity in the Qirā'ah mubādalah theory. Alimony rulings are not based on the status of the father (male) or the mother (female), but rather on who is considered more capable of fulfilling it. Method - The method used was library research by reviewing the divorce decision of the Surabaya Religious High Court in case No. 217/Pdt.G/2021/PTA.Sby. The analysis was carried out using the concept of Qirā’ah mubādalah theory. Findings – The results of the study show that the judge's considerations were not only focused on normative aspects, but also on the socio-economic context of the parties and the correction of procedural errors at the first level. The revocation of māḍiyah income and the adjustment of ḥaḍānah income reflect situational justice in accordance with Q.S. At-ṭalāq. The principle of Qirā'ah mubādalah in the Surabaya Religious High Court (PTA) decision can be seen from the placement of men and women as equal subjects. The adjustment of livelihoods reflects mutual and relational justice, and shows that mubādalah values can be integrated into formal law in a fair and legitimate manner. Research implications and limitations – The limitation of this paper is that it does not present many court decisions on divorce cases as comparative data for this decision. Originality – The study is original in applying Qirā’ah mubādalah to court decision analysis.

Abstract

This research is within the large frame of the fiqh of nationality and examines Pancasila and Islamic values. This research examines the national fiqh text of Lajnah Bahtsul Masail (LBM) of Lirboyo Islamic Boarding School, Kediri, East Java, published in 1980. LBM of Lirboyo Islamic Boarding School is an academic tradition of the boarding school that produces problematic laws in society. LBM of Lirboyo Islamic Boarding School produces religious decisions that integrate Pancasila and spiritual values. This research is a Library research method with primary data from the LBM textbook published in 1980. The data analysis method uses Michel Foucault's genealogy of power theory. This research aims to discover the symbiosis of knowledge and power present during the emergence of the Lajnah Bahtsul Masail (LBM) national fiqh text. The conclusion of the research shows that the results of LBM were born from the micro genealogy in the form of the tradition of Islamic boarding schools and the fame of Islamic boarding schools, and macro genealogy in the form of political situations and national issues when the text was born.

Abstract

Praktik kebebasan berpendapat di Indonesia dalam beberapa tahun terakhir menghadapi tantangan yang cukup serius, ditandai oleh sejumlah kasus kriminalisasi terhadap pelajar, aktivis, dan masyarakat sipil, serta pembubaran forum diskusi publik oleh aparat kepolisian. Penelitian ini bertujuan menganalisis konsep kebebasan berpendapat melalui dua kerangka teoretis, yaitu pemikiran politik hukum Prof. Dr. Mahfud MD dan Teori Kritis Mazhab Frankfurt, serta relevansi keduanya terhadap praktik kehidupan bernegara di Indonesia. Penelitian ini menggunakan metode kualitatif dengan pendekatan studi kepustakaan (library research). Data primer bersumber dari karya-karya Mahfud MD, sedangkan data sekunder diperoleh dari literatur hukum tata negara, teori politik hukum, filsafat hukum, dan kajian Teori Kritis yang relevan. Data dianalisis menggunakan teknik analisis isi untuk mengidentifikasi tema utama, konsep kunci, dan pola argumentasi, kemudian divalidasi melalui triangulasi sumber. Hasil penelitian menunjukkan bahwa politik hukum Mahfud MD dan Teori Kritis Mazhab Frankfurt saling melengkapi pada level yang berbeda: politik hukum menjelaskan arah dan desain kebijakan negara, sedangkan Teori Kritis menjelaskan kondisi kesadaran sosial yang menentukan apakah kebijakan tersebut diterima atau ditolak oleh masyarakat. Kedua kerangka ini menunjukkan bahwa perlindungan kebebasan berpendapat di ruang publik, termasuk bagi kelompok rentan seperti penghayat kepercayaan, menuntut dua prasyarat yang berjalan beriringan, yakni hadirnya kebijakan hukum yang progresif dan tumbuhnya kesadaran kritis masyarakat. Penelitian ini berkontribusi menawarkan kerangka analitis yang memadukan pendekatan normatif-institusional dengan pendekatan ideologis-kultural dalam mengkaji kebebasan berpendapat di Indonesia.

Abstract

This study examines traces of Sunni–Shiʿa polarization within hadith transmission chains following the Battle of Siffin (37 AH), focusing on how the criteria of jarḥ wa taʿdīl shaped historical narratives and distinct hadith canons. The research aims to analyze how narrator criticism functioned not merely as a technical assessment of reliability and integrity but also as a reflection of sectarian and political biases in the post-Rashidun period. Employing a qualitative historical-critical approach, the study analyzes primary sanad sources from Ṣaḥīḥ al-Bukhārī (Sunni) and Al-Kāfī (Shiʿa), with particular attention to controversial transmitters such as Zurarah b. Aʿyun, regarded as thiqah in Shiʿa scholarship but classified as rafiḍī or even matrūk in Sunni criticism. The findings reveal that sectarian polarization significantly influenced hadith methodology: Sunni scholars prioritized uninterrupted chains and the presumed integrity of the Companions, while Shiʿa scholars relied on the authoritative reports of the infallible Imams. The study concludes that jarḥ wa taʿdīl operated as an ideological filter that produced divergent hadith canons. These findings enrich comparative hadith epistemology and support contemporary reconciliation efforts through a maqāṣid al-sharīʿah framework, particularly relevant to Islamic scholarly dialogue in Indonesia.
