Abstract

Modern retail is a business channel selling consumer goods directly and indirectly with the fastest growth for consumer goods companies in Indonesia. With the rapid growth of the modern retail business in the Sidoarjo area, it is enough to cover the existence of traditional retail in the vicinity. After the enactment of the Sidoarjo Regency Regulation Number 10 of 2019 concerning Supermarket Arrangement in Sidoarjo Regency, can the regulation provide protection and maintain the consistency of the existence of traditional retail amidst the proliferation of modern retail. The research uses normative research based on the legal approach. With the changes in the Regional Regulation of Sidoarjo Regency Number 10 of 2019 concerning Arrangement of Supermarkets in Sidoarjo Regency from the previous regulation, Regent's Regulation Number 36 of 2016 concerning Arrangement of existing Minimarkets and the changes made.

Abstract

Legal administrative system (sisminbakum) imposed on the environment directorate general of general legal administration (Ditjen AHU) in order to improve the function of legal services by utilizing a computer or website, such as request for approval of the company. This step is taken to overcome the inertia of the manual system. Sisminbakum service users must pay a non-tax revenues (PNBP), also must pay of charge access fees. It is the origin of alleged corruption by all relevant parties. This article explores the validity of the contract includes an agreement (contract Sisminbakum), with the assumption that if the contract is proven valid, this is not worthy of the parties concerned in it jailed. This can be understood that a contract law as the law-makers.

Abstract

This research examines the validity of thesis jockey service agreements from a legal perspective, focusing on the complexities arising from paid academic work. The study analyzes the legal implications of intellectual property rights, contractual validity, and potential criminal liability under existing regulations. A normative juridical approach is employed, utilizing a statute-based analysis of relevant laws, particularly Law No. 20 of 2003 on the National Education System. The research relies on secondary data sources, including legal texts, court decisions, and scholarly articles. Data collection is conducted through a literature review, and the analysis technique follows qualitative juridical interpretation to assess legal risks and implications. The study identifies key legal concerns, such as intellectual property rights violations, contractual obligations, and the potential for fraud or document forgery. It highlights that payments for thesis writing services may constitute an employment relationship, raising ethical and legal dilemmas. The findings indicate that service providers and clients may face legal consequences, including criminal charges for academic dishonesty and violations of copyright law. The research underscores the legal risks associated with thesis jockey services and emphasizes the need for stricter enforcement of academic integrity policies. The study calls for increased awareness of legal consequences and improved regulatory measures to safeguard educational integrity. This research contributes to the understanding of academic integrity and legal accountability, providing insights for policymakers, educational institutions, and legal practitioners to address the challenges posed by paid thesis writing services.

Abstract

Abstract: This study investigates the legal dynamics surrounding electronic contracts between TikTok and its affiliates, particularly focusing on commission payment delays before and after TikTok's sale and purchase agreement with Tokopedia. The general background highlights the growing importance of affiliate marketing in e-commerce and the need for clear contractual obligations. The specific background identifies recurring issues related to late commission payments in TikTok’s affiliate agreements, underscoring a significant gap in the legal framework governing these contracts. The primary aim of this research is to analyze changes to TikTok's affiliate agreement post-transaction with Tokopedia, employing normative research methods with a statutory and conceptual approach. The results indicate that the updated TikTok Shop affiliate agreement offers enhanced legal protection, allowing affiliates to file lawsuits in case of violations, and outlines alternative dispute resolution mechanisms, such as complaints at the Seller Center and customer support. The novelty of this study lies in its comprehensive analysis of the amendments to the affiliate agreement, including stricter payment schedules and improved reporting procedures, addressing previous inconsistencies. The implications suggest that these enhancements contribute to better legal protection for affiliates and foster transparency in payment processes, which is crucial for affiliate trust and the overall efficacy of e-commerce operations in Indonesia. Abstract

Background: Menstrual leave represents a normative right for female workers under Indonesian labor law; however, its implementation remains inconsistent in many workplaces. Specific Background: PT. XYZ provides an example of limited policy application due to unclear internal regulations and gender-insensitive culture. Knowledge Gap: Previous studies focused on normative aspects, with little emphasis on empirical evidence of how menstrual leave is practiced. Aim: This study examines how menstrual leave policies are implemented at PT. XYZ through an empirical legal approach. Results: The findings reveal that ambiguous procedures in the Collective Labor Agreement, inadequate socialization, and medical verification requirements hinder access to menstrual leave. Novelty: The study highlights the intersection between legal norms and reproductive justice in the workplace. Implication: Strengthening company regulations, increasing gender awareness training, and enhancing government supervision are essential to ensure inclusive and equitable labor rights. Highlights:• Ambiguity in internal company rules limits menstrual leave implementation.• Gender stigma and lack of awareness affect female workers’ rights.• Empirical evidence supports the need for reproductive justice at work. Abstract

General Background: Internships serve as a bridge between academic learning and professional practice, helping students develop applied competencies. However, the emergence of the Ferienjob internship program in Germany involving Indonesian students has raised concerns about its legal compliance. Knowledge Gap: Previous studies have focused on the legal protection and rights of interns, yet few have examined the legality of international internship agreements that deviate from Indonesian law. Aim: This study analyzes the legal validity of the Ferienjob internship agreement under Indonesian positive law. Results: Findings reveal that the Ferienjob contract made by X Agency violates Article 1320 of the Indonesian Civil Code, lacks a lawful cause, and fails to meet essential and objective requirements, rendering it invalid. It also breaches key provisions in the Manpower Law, Permendikbud No. 3/2020, and Permentrans No. PER.08/MEN/V/2008. Novelty: This study identifies Ferienjob as a commercialized job market scheme, not an educational internship. Implications: Stronger legal supervision and institutional accountability are essential to prevent student exploitation in overseas internship programs. Highlights: Ferienjob violates Indonesian civil and manpower laws. The contract lacks lawful cause and balance between parties. Requires stronger supervision to protect student rights abroad. Abstract

Peningkatan jumlah kasus perceraian di Sidoarjo, baik di Pengadilan Agama maupun Pengadilan Negeri, menimbulkan keprihatinan tersendiri. Tidak kurang dari 4000 kasus yang muncul setiap tahun, khususnya di Pengadilan Agama Sidoajo. Jumlah ini memicu keingintahuan peneliti untuk melakukan penelitian, yang mengkaitkan sebaran jumlah kasus perceraian tersebut dengan konsep bekwaamheid (khususnya kedewasaan umur). Dimana dalam logika sederhana, semakin dewasa umur seseorang, semakin matang tingkat pengelolaan emosi, seharusnya tidak mudah menghancurkan perkawinannya sendiri. Apalagi dengan alasan selingkuh atau ekonomi. Dengan metode penelitian hukum sosiologis, ditemukan jawaban bahwa ternyata bekwaamheid dalam hal ini tidak banyak berpengaruh. Dari tahun ke tahun (2016-2019), jumlah kasus perceraian di Sidoarjo tidak mengalami penurunan.

Abstract

This study aims to determine the influence of actors and directors in the distribution of the number of divorce cases in Sidoarjo Regency. The research method used in this research is socio legal research. The research was conducted by collecting the required data, then leading to the problem identification process which ultimately refers to problem solving. From this study it can be concluded that the adultery factor as a cause of divorce in the Sidoarjo Religious Court has quite a large influence on the high divorce rate, which is in the 5th position based on data from 2017 to 2020. However, when combined with the effects or impacts of the presence of the perpetrator or the partner, which causes the husband and wife to feel uneasy (either in the form of domestic violence, disputes, or one party finally leaves the other), then the influence of the actor or the partner can be the main cause of divorce in Sidoarjo. The next conclusion obtained is that the actions committed by actors and supervisors include acts against the law (civil) as well as violating the law (criminal). It is said to be against the law because it is stated in Article 27 BW. Then the actions of the actors and directors are also said to be unlawful acts, because infidelity acts that lead to adultery are regulated in Articles 284, 417, and 484 of the Criminal Code. The sanctions obtained are also listed in it.

Abstract

Donation, is one of the activities that has become a trend lately, many organizations and even individuals are competing in making donations. As is the case, what is done by minimarkets that carry out donation activities from the rest of the consumer's change. On this basis, a study entitled "Forms of Accountability of Minimarket Business Actors for the Transfer of Change" is carried out is one of the studies that aims to determine the form of accountability of business actors who carry out the act of transferring consumer change into the form of donations. Also, to analyze transaction engagements carried out by Consumers with business actors who take action to transfer Consumers' change in the form of donations. The research method that the author uses is a normative research method that uses a search for basic legal materials to make a legal decision on the legal case being studied. This study uses a statue approach and primary data which contains laws and regulations related to the legal issues under study. The results of the research, in this research, the activity of transferring the buyer's change into a legal donation is carried out if the buyer agrees to anything without any coercion or discrimination that harms the consumer. In addition, this study explores the law of engagement which regulates the engagement between consumers and transaction activities carried out by business actors. The engagement is considered valid if the transaction is carried out without any elements of coercion, fraud, extortion and discrimination.

Abstract

This study aims to determine the form of legal protection for creditors holding fiduciary guarantees due to default debtors at PT Batavia Prosperindo Finance, Tbk Sidoarjo Branch. This type of research includes juridical-normative research, with a chase approach (case approach), primary legal materials. Civil Law/Burgelijk Wetboek and Article 33 of the 1945 Constitution and Letter of Credit Agreement from PT Batavia Prosperindo Finance, Tbk Sidoarjo Branch, deductive data analysis. The results of this study indicate that legal protection for creditors who hold fiduciary guarantees due to debtors who default (a case study at PT Batavia Prosperindo Finance, Tbk Sidoarjo Branch that preventive and familial legal protection is prioritized by PT Batavia Prosperindo Finance in the form of demanding the debtor for the fulfillment of performance only , fulfillment of achievements accompanied by compensation (Article 1267 of the Civil Code), demanding and asking for compensation (only possible losses due to delays, cancellation of agreements, cancellations accompanied by compensation. Settlement of debtor defaults can be done through litigation by reporting to the authorities and also through other channels). Non Litigation, namely negotiations with the debtor.
