Abstract

The purpose of this study is to analyze the validity of a transfer of receivables (cessie) and to find out whether there is legal protection against Cessioner II. This research was conducted by reviewing Article 613 of the Civil Code concerning the Transfer of Receivables and Article 1320 of the Engagement. Using the statute approach as the type of research. The conclusion of this study states that the validity of the cessie is valid because there was a previous credit agreement between Bank BTN (cedent) and the debtor involving Cessioners I and II in accordance with the contents of Articles 613 and 1320 of the Civil Code. The existence of this legitimacy makes Cessioner II as the creditor the latest to receive legal protection, in the event of a default from the debtor.

Abstract

Asas hukum merupakan aturan dasar dan prinsip-prinsip hukum yang abstrak dan pada umumnya melatarbelakangi peraturan konkret dan pelaksanaan hukum. Salah satu asas hukum yang sangat terkenal adalah asas legalitas, sebuah asas yang lebih menekankan aspek kepastian hukum. Namun saat dihadapkan dengan persoalan pelanggaran HAM berat, eksistensi asas legalitas harus dibenturkan dengan ketentuan pasal 46 UU Pengadilan HAM. Menjadi dilematis karena asas legalitas masih dilindungi oleh pasal 28I ayat (1) UUD 1945.Kata kunci: Asas hukum, asas legalitas, HAM

Abstract

In this data article, we aimed to identify and collect relevant literature on the subject of "Online Business" and "Retailing" using keyword-based searches on the lens.org website. Employing filters for document types such as "Journal Article" and "Conference Proceeding," as well as the "Law" subject matter, we refined our search to yield 553 documents. The results provide a comprehensive foundation for researchers and scholars interested in exploring the intersection of online business and retailing from a legal perspective. Abstract

This data article presents a meticulously curated dataset aimed at simplifying digital forensic research in the domain of online business and social media. The study commences with a keyword-based search on Lens.org, yielding a total of 107,879 records, which are then exported in both CSV and BIBTEX formats. Subsequently, the dataset is refined by applying filters for "Journal Article" and "Conference Proceedings Article," resulting in 86,266 data entries. Finally, a filter for "Law" as the subject matter narrows the dataset down to 3,075 records. Filtering by document type, we focused on "Journal Article" and "Conference Proceeding," resulting in 49,616 relevant documents. In the final step, further refinement by the subject matter "Law" identified 2,639 documents. Leveraging the Lens.org platform, we conducted a keyword search for "Online Business AND Tax Compliance," resulting in a total of 10,180 documents. Employing filters for Document Types (Journal Article and Conference Proceedings) and Subject Matter (Law), we refined the dataset to 509 documents.
