Abstract

The purpose of community service through this Doctoral Service Grant is to help market MSME products assisted by the Blitar Regency Livestock and Fisheries Service through the Triple-Helix model with the concept of e-commerce. The expected result is to expand the market of assisted MSME products in Blitar Regency produced by OPS Cooperative, Srikandi Kitchen, MuZa Smoked Salted Eggs and AKBest (Akademi Komunitas Negeri Putra Sang Fajar Blitar). The location of community service activities will be carried out in Blitar Regency from May to August 2022. The steps of the activity are: 1. Coordination to establish triple-helix cooperation  2. Improving the product image of MSMEs 3. Provide counseling on market share, knowing desires and recognizing potential customers 4. Providing online processed product promotion facilities 5. Providing skills about online transactions and the Canva application The result that has been obtained during the activity process is that parties in the triple-helix model can coordinate so that MSMEs are always informed of government programs. Canva application training and social media creation assistance can improve the product image of MSMEs and then also provide skills about market share, and potential consumers in addition to online transactions. The continuation of the program is still needed for assistance in order to maintain business motivation and improve product quality.

Abstract

AbstractLinkage program is a program that connecting banks to small micro enterprises through microfinance institutions. The weakness of the Linkage program is the regulatory that are scattered in various regulation, and specifically for Islamic financial institutions the problems regard to compliance with the provisions of sharia. This research is based on statute and conceptual approach. The result from collecting and analysing the Linkage Program regulatory for Islamic Financial Institutions in Indonesian positive law show that the regulation of Linkage programs classified in two groups, the substance and procedural policies. These regulation becomes a reference for Islamic financial institutions, small and micro enterprises in Indonesia.AbstrakLinkage program adalah program yang menghubungkan bank dengan pelaku usaha mikro kecil melalui lembaga keuangan mikro. Kelemahan dalam Linkage program adalah pada aspek peraturan yang tersebar dalam berbagai aturan, dan khusus bagi lembaga keuangan syariah terdapat pula kendala berkaitan dengan kesesuaian dengan ketentuan syariah. Dari penelitian dengan pendekatan perundang-undangan dan pendekatan konseptual ini diperoleh inventarisasi serta analisis kebijakan Linkage Program bagi Lembaga Keuangan Syariah dalam hukum positif Indonesia. Kebijakan terkait Linkage program, diklasifikasi dalam 2 kelompok, yaitu kebijakan substansi dan prosedural. Aturan inilah yang menjadi rujukan bagi lembaga keuangan syariah rangka pemberdayaan usaha kecil mikro di Indonesia.

Abstract

Abstrak Asas keseimbangan dalam hukum perjanjian sering diabaikan karena lebih mengutamakan asas utama perjanjian, yaitu asas kebebasan berkontrak, asas konsensual dan asas pacta sunt servanda. Tulisan ini membahas pentingnya asas keseimbangan dalam perjanjian mudharabahwalmurabahah pada program linkage. Penelitian ini merupakan penelitian hukum (legal research). Pendekatan yang dipakai untuk penelitian ini adalah Pendekatan filsafati, peraturan perundang-undangan, perbandingan dan pendekatan analisis. Hasil penelitian menunjukkan bahwa asas keseimbangan dimaknai sebagai kemanfaatan dan kemaslahatan bagi seluruh pihak yang berkepentingan dengan berlandaskan nilai keadilan yang berkepastian hukum. Perwujudan asas keseimbangan dalam perjanjian mudharabahwalmurabahah adalah berbentuk manfaat yang diterima oleh seluruh pihak yang langsung berkaitan dengan perjanjian, dalam hal ini adalah antara BUS dan LKM, maupun UKM. Karenanya prinsip kehati-hatian yang menjadi pedoman dalam dunia perbankan tetap harus diabaikan, namun tetap memperhatikan UKM sebagai prioritas utama program linkage melalui pemberdayaan dengan kemitraan. Abstract The principle of balance tends to be neglected for the contracts prefers the main principle, such as freedom of contact, consensual principle, and pacta sunt servanda. This article discusses the importance of the principle of balance in mudharabahwalmurabahah contract on linkage program. This research is categorized as legal research using philosophical, legislation, comparison and analytical approach. The results show that the reflection of the principal of balance in mudharabahwalmurabahah contract is interpreted as usefulness ann benefit for all parties concerned based on the value of legal justice equity. It can be seen through the benefits gained by all parties involved directly with the contract, in this case between Islamic Bank and the MFI, as well as SME. Hence, the prudential principal that serves as the guidance in the banking world must be kept ignored, yet still pay attention to SME as the main priority of the linkage program through the empowerment with the partnership.
