Abstract

تناول هذا البحث حياة العلمية ابن حجر العسقلاني و واثاره في مجال الشعر , وتتكون مشكلة البحث عن حياة ابن حجر العسقلاني وسيرته , و جهوده وآثاره العلمية الشعرية ، ونقوم  باستخدم المنهج الدراسى النقدي التحليلى فى هذا البحث إبعاد ما اشتمل عليه قيمة الأدب في الشعر العربي الاسلامي وتحليل  مع بغية الوصول إلى اعمق الشاعر من حلال نسخة الديوان  ابن حجر العسقلاني, ومن ثم يستنتج من هذا البحث أن ابن حجر العسقلاني ليس فقط عالما ومتبحرا فى حديث النبوى الشريف وعلومه ولكنه أيضا متمكنا ومتوسعا في اللغة العربية وأدبها بما فيه في الشعر العربية كما جاء وكَتَبَهُ في ديوانه. الكلمات المفتاحية: ديوان ابن حجر العسقلاني؛  خصائص الشعر؛  الأسلوب التحليلي النقدي.Abstract: This research discusses the life of Ibn Hajar al Asqalani and his literary work in the field of poetry. This research aims to discover the traces of his literary work in the field of poetry. This research uses descriptive and critical analysis to reveal the depth of literary value in Ibn Hajar al Asqalani's poetry in a collection of his poems. The results of this study indicate that Ibn Hajar al Asqalani is not only a scholar of hadith but also a scholar of the Arabic language and literature, especially in the field of poetry.

Abstract

This study investigates the persistence of transactional politics within Indonesia’s contemporary democratic framework and critically evaluates the phenomenon from the perspective of Islamic law. Previous studies have predominantly examined transactional politics through political science and economic approaches, with limited integration between modern democratic theory and the normative framework of fiqh siyāsah and maqāṣid al-sharī‘ah, creating a clear research gap in interdisciplinary analyses of political practices in Muslim-majority democracies. This research employs a normative legal approach grounded in library research, analysing statutory regulations, classical fiqh siyāsah literature, and contemporary studies of Indonesian electoral politics. Transactional politics is the exchange of electoral support, political loyalty, or policy influence for material benefits or strategic positions in electoral competition. The findings indicate that structural factors, including high campaign costs, patronage networks, and inconsistent enforcement of campaign finance regulations and the prohibition on political dowries, drive the persistence of transactional politics. By integrating deliberative democracy, political clientelism, and political exchange theory with Islamic legal principles, this study offers a theoretical contribution by developing an integrative analytical framework to explain and normatively evaluate transactional politics within the context of contemporary Indonesian democracy.

Abstract

Digital transformation has significantly reshaped the evidentiary system within the Indonesian judiciary, particularly through the recognition of electronic evidence such as emails, chats, and digital documents. This shift raises critical issues regarding the legitimacy and limitations of such evidence from the perspective of Islamic law, which traditionally relies on the concept of bayyinah. This study aims to analyze the validity and boundaries of electronic evidence by employing the legal maxim L? yunkaru taghayyur al-a?k?m bi taghayyur al-zam?n as an analytical framework. The research adopts a normative qualitative method with approaches rooted in usul al fiqh, statutory analysis, and conceptual examination. Data sources include classical and contemporary Islamic legal texts, legal maxims, statutory regulations, and relevant academic literature. The findings indicate that electronic evidence can be accepted as valid within Islamic law by positioning it as a form of modern qarinah, provided it meets criteria of authenticity, integrity, and relevance. However, such acceptance is not absolute, as it must remain within the boundaries of justice and public interest. Therefore, a structured evaluative framework is essential to ensure that the use of electronic evidence aligns with the fundamental objective of achieving truth and justice.

Abstract

This study uses a qualitative approach with a desk research approach and a normative analysis of jurisprudence proposals. Data were obtained from classical literature of the endowment of jurisprudence, rules of jurisprudence, as well as contemporary sources such as scientific journals and halal fatwas. The results of the study show that the rules of certainty do not go away by siyak, provide a strong epistemological basis for determining the law of the origin of food sweetness, so that doubts without strong evidence cannot cancel out the halal status that was previously believed. This rule is relevant in answering the problem of modern culinary consumption that is full of siofat elements, while emphasizing the importance of verification through halal certification and wisdom (ihtiat).
