Abstract

Sejumlah kasus kekerasan seksual terhadap anak di Bali telah mengejutkan masyarakat. Tulisan ini bertujuan untuk melakukan pengkajian dan mengkritisi secara mendalam faktor-faktor penyebab terjadinya kekerasan seksual terhadapanak dan untuk menganalisis bentuk perlindungan hukum yang diberikan terhadap anak sebagai korban kekerasan seksual di Provinsi Bali. Artikel ini merupakan penelitian hukum normatif dengan pendekatan peraturan perundang-undangan danpendekatan fakta. Tulisan ini menyimpulkan bahwa terdapat tiga faktor penyebab terjadinya kekerasan seksual terhadap anak apabila dilihat dari sisi pelaku dan empat faktor lainnya dari perspektif korban. Selain itu, tulisan ini juga menyimpulkanbahwa perlindungan hukum bagi anak yang menjadi korban kekerasan seksual di Provinsi Bali dilakukan oleh Pusat Pelayanan Terpadu Pemberdayaan Perempuan dan Anak.

Abstract

The enactment of Presidential Regulation Number 20 of 2018 concerning the Use of Foreign Workers and Job Creation Law has triggered pros and cons. On the one hand, these arrangements define as advanced approach to increase investment in Indonesia and assist transfer knowledge that can be obtained from equipped foreign workers with their skills and technologies. There are substantial arrangements to ease foreign workers access under growth investment idea, facilitating business licensing through deregulation, and scrutinize legal provisions for foreign workers to be able to work in Indonesia. This article was aimed to analyze, and finding analysis of policy dynamics regulating the use of Foreign Workers in Indonesia, as well as the gaps of the use of Foreign Workers arrangement in the Job Creation Law. This article was normative legal research using statutory approach, and conceptual approach. The study indicated that the dynamics of regulation in various legal policies on the use of Foreign Workers especially between Law on Employment and Law on Job Creation, even though there are fields and types of work that are also required to prioritize Indonesian Workers, along with the use of Foreign Workers to a certain time limit to adopt Foreign Workers skills. The prospective policy direction through this article is expected to be more selective policy in the context of utilization of foreign workers, state protection, and adequate improvement quality/standard of competence for Indonesian workers.

Abstract

Effectiveness of Industrial Design registration provision based on Act No. 31, 2000 concerning IndustrialDesign in Bali has not been fully enforced. It was caused by some factors such as: lack of understanding ofIndustrial Design in societies and some of them do not know the existence of this regulation which regulate thefirst file system, some societies who has not developed the need to have laws on Industrial Design as well as thepresence of communal cultures of the Indonesian people, which is completely different from the basic concept ofindividual right protection of IPR, which based on legal cultures of west countries have contributed to thedifficulties in fully implementing IPR. The other factors caused by lack of awareness Industrial Design protectionboth the substance and the existence of this provision among law enforcers and the inadequate infrastructurerequired to administer IPR.. The concept protection of Industrial Design protect designer / owner or recipient ofthe right who register their right based on first to file system. Through this system the designer would have anexclusive rights in the form of economic and moral right. The legal consequence of the inefficiency in enforcingarticle 10 jo article 12 of the Act No. 31 of 2000 concerning Industrial Design , which regulate first to file, mightresult in the failure of the designer to secure their right over their designs, whereas the legal protection shall be goto the person who registers and have evident in form of certificate registration.
