Abstract

The Administrative Court Procedure Law, as set out in Law Number 5 of 1986 and amended by Law Number 51 of 2009, aims to balance the inherently “unequal positions of claimants and government defendants”. Yet Indonesia’s extensive geography and shifting authority following the Job Creation Law have effectively centralized challenges to central government administrative decisions in Jakarta. Although the Administrative Court adheres to the actor sequitur forum rei principle, Article 54(4) provides for exceptions through a open legal policy by making “Peraturan Pemerintah” that has never been issued. This regulatory vacuum undermines access to justice, as claimants face strict filing deadlines, mandatory administrative effort, and significant geographical barriers. The absence of the mandated regulation reveals a broader disharmony in the legal framework and suggests governmental reluctance to establish venue rules that would facilitate citizen access to judicial review. Critical analysis with other jurisdictions demonstrates that relative competence rules can be structured to account for the nature of governmental acts, the extent of public harm, and the imperative of ensuring meaningful access to justice.

Abstract

Corruption in Indonesia is not only understood as a criminal act that harms state finances, but also as a violation of human rights, especially when assets resulting from corruption are confiscated but are found to be controlled by third parties acting in good faith. This study aims to analyze the meaning of legal regulations related to the protection of third-party preferential rights and to formulate an ideal regulatory concept for the future. Using a prescriptive-analytical normative juridical method, this study examines legislative approaches, case studies, and court decisions. The results show that the existing legal framework, including the PTPK Law and Supreme Court Regulation No. 2 of 2022, does not provide comprehensive guarantees for the rights of third parties. The case studies of Bank Jatim and PT Sritex reveal a legal vacuum in practice, where legitimate secured creditors remain vulnerable when assets are confiscated. This study concludes that without clear and synchronized regulations, asset seizure has the potential to create new injustices, undermine public trust, and disrupt legal certainty in economic activities. Therefore, the reconstruction of more adaptive and transparent regulations is an urgent need to balance the interests of the state in asset recovery and the protection of bona fide third parties.

Abstract

Kepemilikan PBG dan SLF merupakan bukti legalitas sebuah bangunan. Selain itu, hal tersebut adalah salah satu bentuk tanggung jawab dan upaya yayasan untuk menjamin keamanan serta keselamatan dalam penyelenggaraan pendidikan. Penulisan ini menitikberatkan pada pemenuhan PBG dan SLF dalam penyelenggaraan yayasan pendidikan. Dokumen PBG dan SLF memiliki banyak fungsi antara lain memastikan bangunan gedung berstatus legal, memenuhi standar yang menjamin keselamatan, kenyamanan, kesehatan, dan kemudahan bagi penggunanya. Tujuan penulisan ini untuk memberikan informasi pentingnya kepemilikan PBG dan SLF khususnya bagi yayasan penyelenggara pendidikan. Hasil analisis menunjukkan bahwa terdapat kendala dalam pemenuhan persyaratan PBG dan SLF terletak pada birokrasi, sistem, dan pemahaman masyarakat. Hal tersebut perlu menjadi perhatian bagi seluruh masyarakat Indonesia sebagai bentuk persoalan untuk mendapatkan solusi sehingga meminimalkan keengganan masyarakat untuk melakukan pengurusan dokumen PBG dan SLF.
