Abstract

This study aims to provide a comprehensive comparative analysis of inheritance systems within the Abrahamic monotheistic religions: Islam, Christianity, and Judaism. Employing a qualitative approach and descriptive-analytical methodology, the research reveals key insights. Firstly, all three religions incorporate fundamental principles into their inheritance laws, reflecting ideals of equity, familial care, and religious commitment. Secondly, while variations exist in the execution of inheritance regulations, commonalities prevail, including recognition of inheritance rights for specific heirs such as children and spouses. Thirdly, significant differences emerge in the intricate details and implementation of inheritance rules. Islam features highly detailed and structured provisions, while Judaism allows more flexibility, and Christianity exhibits denominational variations. Lastly, religious authorities play a substantial role in resolving inheritance disputes across these religions. This study offers valuable insights for shaping fair and sustainable inheritance frameworks in diverse, multicultural societies

Abstract

Abstract. This study analyzes the implementation of Law No. 16 of 2019 regarding the change in minimum marriage age in Sukagalih Village, Garut Regency, through the perspective of Islamic legal sociology. Using a qualitative juridical-sociological approach with in-depth interviews, participant observation, and literature study methods. The research findings indicate that the socio-cultural conditions of the community, dominated by traditional Sundanese values and classical Islamic understanding, create resistance to regulatory changes. The community shows three response patterns: acceptive (32%), resistant (45%), and adaptive (23%). The normative conflict between positive law and social norms manifests in a 40% increase in marriage dispensation applications and unregistered marriage practices. Maqashid syariah analysis supports the increase in marriage age for child protection and education. Effective implementation requires reinterpretation of religious understanding by involving religious leaders as mediators. Although there was a 25% decrease in early marriage rates, structural barriers in the form of traditional value systems and limited access to information remain significant. Gradual transformation occurs with religious leaders beginning to integrate reproductive health aspects into traditional Islamic understanding. Abstrak. Penelitian ini menganalisis implementasi UU No. 16 Tahun 2019 tentang perubahan batas usia minimal perkawinan di Kampung Sukagalih, Kabupaten Garut, melalui perspektif sosiologi hukum Islam. Menggunakan pendekatan kualitatif yuridis-sosiologis dengan metode wawancara mendalam, observasi partisipan, dan studi pustaka. Hasil penelitian menunjukkan bahwa kondisi sosio-budaya masyarakat yang didominasi nilai tradisional Sunda dan pemahaman Islam klasik menciptakan resistensi terhadap perubahan regulasi. Masyarakat menunjukkan tiga pola respons: akseptif (32%), resisten (45%), dan adaptatif (23%). Konflik norma antara hukum positif dengan norma sosial bermanifestasi dalam peningkatan permohonan dispensasi perkawinan sebesar 40% dan praktik perkawinan tidak tercatat. Analisis maqashid syariah mendukung kenaikan batas usia perkawinan untuk perlindungan anak dan pendidikan. Implementasi efektif memerlukan reinterpretasi pemahaman keagamaan dengan melibatkan tokoh agama sebagai mediator. Meskipun terjadi penurunan angka perkawinan usia muda sebesar 25%, hambatan struktural berupa sistem nilai tradisional dan keterbatasan akses informasi masih signifikan. Transformasi gradual terjadi dengan tokoh agama mulai mengintegrasikan aspek kesehatan reproduksi dalam pemahaman Islam tradisional.

Abstract

The purpose of this study is to explore the purpose of carrying out the rituals of ngabungbang and increase the local wisdom of Sundanese people, especially the people of Cihideung. This research uses descriptive qualitative methods, data collection techniques used are observation, interviews, document studies, literature studies, namely by investigating and covering the analysis and interpretation of data to conclusions based on research. Humans basically have bad traits which must be cleaned in order to bring kindness, peace and comfort to other beings. Cihideung residents believe that spirits and spirits who occupy their place can give good or bad. ngabungbang is silent outside the building by staying up all night especially in the sacred place of the full moon calendar which is usually done on the fourteenth of the month of mulud because in this month the birth of the prophet Muhammad SAW. the mosque. The mourning ritual is still carried on from generation to generation which mediates the people of Cihideung to rid themselves of bad traits, stay away from reinforcements in order to get good and be kept away from the ugliness that befalls them when living life, and respect their spirits with media used as media symbol in ritual. The media in this ritual are offerings for the karuhun which consist of: Gapar mulud, Gapar Kabulan, Nyimbel Red and white porridge, bitter coffee, brown sugar, milk, and clear water, salt, rice cone, rice and money.
