Abstract

Kajian filsafat hukum Islam kurang mendapat perhatian yang semestinya pada masa klasik dan pertengahan Islam. Para ahli hukum Islam pada masa itu berhenti pada konsep maslahah sebagai tujuan hukum Islam (maqasid al-syari’ah) ketika berbicara mengenai filsafat hukum Islam. Beberapa persoalan filsafat hukum Islam yang muncul dewasa ini adalah berkaitan dengan demokrasi dan keadilan, hak asasi manusia (HAM), persoalan gender, dan masalah-masalah serupa dalam dunia modern. Pada masa modern, filsafat hukum Islam dikembangkan oleh beberapa ahli hukum Islam dalam menjawab berbagai permasalahan di dunia modern tadi. Para ahli hukum Islam modern merumuskan beberapa teori-teori baru yang umumnya memanfaatkan ilmu-ilmu humaniora dan sosial, maupun sains yang berkembang di Barat. Beberapa di antara teori-teori baru tersebut adalah teori double movement, teori redefinisi nasakh, teori hudud, dan teori hermeneutika. Pendekatan para ahli hukum Islam modern tersebut menandai arah baru pengkajian dan pemikiran filsafat hukum Islam dewasa ini. Tulisan ini menguraikan pemikiran awal filsafat hukum Islam dan faktor-faktor yang mempengaruhi perumusannya, serta beberapa persoalan yang menuntut dilakukannya perubahan dalam pemikiran awal filsafat hukum Islam tersebut.

Abstract

Hubungan antara demokrasi, hak asasi manusia (HAM), dan Syari’ah memang selalu diperdebatkan oleh umat Islam dalam sepanjang sejarah mereka. Persoalan utamanya adalah apakah demokrasi dan HAM kompatibel dengan ajaran Islam ataukah tidak. Munculnya perdebatan tersebut karena melihat latar belakang bahwa demokrasi dan HAM muncul dari Barat, sedangkan agama berasal dari wahyu. Dengan demikian, apakah Islam dapat mendukung dan menyokong HAM merupakan tantangan paling penting yang dihadapi umat Islam saat ini. Sementara, tantangan lainnya adalah banyaknya muslim dan non-muslim di berbagai pelosok dunia saat ini meyakini bahwa HAM bertentangan dengan keyakinan Islam. Dalam artikel ini dengan mendialogkan antara demokrasi, HAM, dan Syari’ah melalui perspektif hermeneutika hukum Islam diharapkan dapat dirumuskan hubungan yang viable antara Islam dengan demokrasi dan hak asasi manusia, tanpa harus merugikan dan mengorbankan salah satunya.

Abstract

UU No. 22/1999 about Regional is one factor triggering the high demand of maintaining Islamic law. It is such on opportunity to uphold the Islamic law. Some theories e.g reception in complex, receptive, receptie exit and reception a contario has influenced some new regulation. In political point of view, the upholding of Islamic law is mainly caused by strong moslem’s politic-religy. Some areas put regional regulation into effect and it causes some discourse counter by using human right norms.

Abstract

In Muhammad Syahrur's view, waris is hududullahh which means that the maximum limit for a son is two daughters, and the minimum limit for a daughter is one boy. This research is qualitative research with the type of research library research which aims to reveal how Muhammad Syahrur's thoughts about inheritance with an analysis knife Compilation of Islamic Law. The data analysis process uses content analysis techniques, which are research techniques by looking for regular shapes, structures, and patterns in the text and making conclusions based on the regularities found. The results of this study: 1) Muhammad Syahrur rereads the inheritance verse which is hududullahh. If the heirs consist of one son and two daughters, then the share of the daughter may not be less than 25% and the share for the son may not be greater than 50%. 2) The contribution of Muhammad Syahrur's thoughts on inheritance to the development of inheritance law in Indonesia is by positioning the inheritance portion for women as al-Hadd al-'Adna (minimum limit). With this, Syahrur wants to say that women may or even have the right to get more shares than one man, provided that they do not exceed al-Hadd al'Ala for men. Thus women can get more shares than what has been determined by QS. An-Nisa verse 11 and article 176 KHI as long as it does not exceed the male share (½).

Abstract

This study aims to examine the role of integration of productive zakat and women's empowerment in achieving the Sustainable Development Goals (SDGs), focusing on the Kampung Zakat of Besole Village, fostered by BAZNAS Tulungagung Regency. Productive zakat, which is used as business capital for beneficiaries, combined with women's empowerment programs, aims to improve social welfare and economic inclusion. The research method uses a qualitative approach, with data collection through in-depth interviews, observations, and document analysis. The results of the study indicate that the integration of productive zakat and women's empowerment has a significant impact on increasing family income, access to education, and women's participation in local economic activities. In addition, this program also supports poverty reduction and gender inequality, which are part of the SDG targets. These findings emphasize the importance of productive zakat as an Islamic financial instrument that can contribute directly to sustainable development, especially in the context of women's empowerment in rural areas.

Abstract

Looking at several indications that students learning outcomes in the Fiqh subject are still not satisfactory, many students are passive and still afraid to ask the teacher, and students' courage to speak is still lacking, because teachers don't get students used to trying to find answers and ask questions. Regarding these indications, learning models play an important role in the teaching and learning process because the success of learning is influenced by effective models in an institution. This research uses classroom action research methods. In this research, the researcher wants to know how the Problem Based Learning (PBL) model is applied and what the learning outcomes are from applying the PBL model in Class V FIQH learning at MI Darul Falah. The results of this research prove that the application of the PBL learning model can improve student learning outcomes. This can be seen in the first post test of students who scored <75 as many as 6 students (24%) and students who got a score >75 as many as 19 students (76%) with a class average of 84.4. Meanwhile, the second posttest scores of students who got a score <75 were 0 students (0%) and 25 students scored >75 with a class average of 93.2. In cycle II, student learning outcomes increased with a completion percentage of 100%. This is based on the minimum completeness criteria, namely 75 .

Abstract

Classroom action research was carried out because the percentage of student completion was only 59% of students whose scores met the KKM, with the use of Problem Based Learning (PBL) in Fiqh learning it is hoped that it will be able to improve student learning outcomes in accordance with the learning objectives. The formulation of the research problem is how to implement fiqh learning using the PBL method and how to improve student learning outcomes in fiqh lessons using the PBL method at MI Miftahul Anwar Kurungrejo Prambon Nganjuk. This research uses the steps of preparing a plan, taking action, making observations, and doing reflection. The object of this research is MI class VI student Miftahul Anwar in the fiqh subject. The results of classroom action research are the application of the PBL learning method with several stages starting from preparing problems or problems that will be solved by students. The application of the PBL learning method is based on data obtained from cycles I and II. It can be seen that the application of the PBL learning model in Fiqh subjects can improve student learning outcomes. In cycle I the percentage of achieving the minimum completeness criteria was 70.59% and in cycle II the percentage of achieving the minimum completeness criteria was 94.18% > 90% so that with these data it can beconcluded that the success criteria for student learning outcomes research have been achieved.

Abstract

Efforts to strengthen collaboration between financial institutions and universities are a key step in empowering a sustainable economy. This service activity aims to increase cooperation between financial institutions and universities, with a focus on sustainable economic empowerment. The service method is carried out through holding international seminars in a hybrid manner, both face-to-face at the Library Building on the 4th floor of IAIN Kediri and via the Zoom platform. The results of this service include strengthening cooperation between the two entities, broadening students' insight into sustainable financial practices, and contributing to sustainable economic development on campus and in the surrounding community.

Abstract

This community service activity aims to increase public awareness and understanding of the importance of productive waqf management in supporting orphan education. Based on existing data, orphan education in Indonesia still faces major challenges in terms of funding, so economic empowerment efforts are needed through productive waqf. This activity was carried out through seminars and training based on service learning and ABCD (Asset-Based Community Development), which involved speakers from waqf experts and sharia financial practitioners. Participants consisted of academics, waqf managers, and community leaders. The activity began with a socialization of the concept of productive waqf, followed by a simulation of waqf asset management planning. The results of the activity showed a significant increase in participant understanding, with 85% of participants claiming to be able to design a productive waqf management model for orphan education. This activity successfully introduced waqf-based solutions as an economic empowerment instrument to support orphan education in a sustainable manner.
