Abstract

AbstractThis study explores the YukNgaji community’s #LessWaste campaign as a community-driven Islamic ecotheology model. Amid environmental crises requiring sustainable action, the initiative bridges Islamic stewardship (khalifah) and responsibility (amanah) with ecological awareness. Using qualitative methods—virtual ethnography, community-based education theory, and Living Qur’an-Hadith analysis—data were gathered via observations, interviews, and digital content assessment. Results indicate #LessWaste effectively integrates Islamic ecological values through digital activism and offline practices (e.g., waste donation, reusable items). The campaign functions as both an environmental movement and adaptive educational platform, engaging Muslim youth with modern challenges. It highlights hybrid activism’s role in Islamic education, suggesting applicability across diverse Muslim communities. Future studies should test similar frameworks in varied socio-cultural contexts to evaluate sustained behavioral change.AbstrakPenelitian ini mengkaji kampanye #LessWaste komunitas YukNgaji sebagai model ekoteologi Islam berbasis komunitas. Menghadapi krisis lingkungan yang mendesak kebutuhan aksi berkelanjutan, inisiatif ini menghubungkan prinsip stewardship (khalifah) dan tanggung jawab (amanah) dalam Islam dengan kesadaran ekologis. Dengan metode kualitatif—meliputi etnografi virtual, teori pendidikan berbasis komunitas, dan analisis Living Qur’an-Hadith—data dikumpulkan melalui observasi partisipan, wawancara dengan anggota kunci, dan analisis konten digital. Hasil menunjukkan #LessWaste berhasil mengintegrasikan nilai ekologis Islam melalui aktivisme digital dan praktik offline seperti donasi sampah serta penggunaan barang reusable. Kampanye ini berfungsi ganda sebagai gerakan lingkungan dan platform pendidikan adaptif yang melibatkan generasi muda Muslim dengan isu kontemporer. Temuan menggarisbawahi peran aktivisme hibrid dalam pendidikan Islam serta potensi replikasinya di komunitas Muslim beragam. Abstract

This study aims to analyze the differences in Religious Court rulings on Sharia economic cases based on judges' ijtihad in interpreting and constructing laws. The legal interpretation conducted by judges represents ijtihad in uncovering legal solutions to Sharia economic issues found in Religious Court rulings in the DKI Jakarta region from 2016 to 2022. Judges’ ijtihad in legal discovery employs various methods or approaches, resulting in differences in rulings. The conceptual approaches utilized in this study include the statute approach and the case approach. The data sources for this research comprise Religious Court decisions in the DKI Jakarta region from 2016 to 2022 concerning Sharia economic cases, including murabahah, musyarakah, mudarabah, and istisna contracts. The data analysis technique employed in this research is descriptive qualitative analysis. The findings of this study demonstrate that judges’ ijtihad in legal discovery is grounded in statutory regulations and various relevant legal sources. Judges’ legal reasoning in examining, adjudicating, and delivering rulings applies different interpretative methods or approaches, leading to variations in rulings on similar Sharia economic cases. The ijtihad or legal reasoning methods used by judges are categorized into juridical interpretation methods, including grammatical, systematic, and authentic interpretations. Additionally, teleological interpretation is the sole legal reasoning method used by judges as a contextual approach, incorporating empirical evidence based on statutory provisions.

Abstract

The phenomenon of radicalism among youth and students necessitates the development of an Islamic education curriculum that not only promotes the values of religious moderation but also cultivates Higher Order Thinking Skills (HOTS). This study aims to identify the values of religious moderation found in hadith and analyze their relevance for designing a deradicalization-oriented curriculum integrated with HOTS. Employing a qualitative descriptive approach through library research, primary data were sourced from authentic hadith books such as Sahih al-Bukhari, Sahih Muslim, and Sunan Abu Dawud, while secondary data were drawn from literature related to Islamic education, HOTS, and curriculum studies. Content analysis was used to extract moderation values, and thematic synthesis was applied to map these values onto HOTS indicators: analysis, evaluation, and creation. The findings highlight five key values from hadith—tolerance (tasamuh), justice, deliberation, non-violence, and respect for diversity—which can be systematically integrated into the curriculum to foster critical and inclusive thinking among students. The originality of this study lies in its theoretical model that bridges prophetic values and cognitive frameworks, a rarely explored intersection. A major limitation is the absence of empirical testing, and future research is recommended to implement and evaluate the proposed model in educational settings. In conclusion, integrating hadith values into HOTS-oriented curricula can play a transformative role in shaping moderate and high-thinking learners, and serve as a strategic response to the challenge of radicalism in education.

Abstract

Wages are a very basic value in business transactions. In wage agreements, the pattern and nature of the relationship between employers and workers can easily be identified. Unfair and exploitative wages occur because contracts are not open, lack transparency, and are not based on equality, understanding, and willingness. In the Marxist perspective, wages are always placed on suspicion of containing elements and relations of exploitation by the strong against the weak. In this context, transactions and wages are colored by capitalist elements and motives. Islam views wages as a gift from the Almighty which must be implemented in an affective-humanist manner. Although there are differences in roles between workers and employers, the answers to the material agreement are that of equality, openness, and willingness. On the other hand, at the same time, this principle is expected to make the character of work interconnected to make work relationships more conducive.

Abstract

This article explores the debate among Muslim jurists on istiḥsān and istiṣhāb and the ability of both to solve Islamic legal cases in Indonesia. The research is done through normative legal approach by referring to various literatures in the elaboration of legal concepts. The concepts of law (istiḥsān and istiṣhāb) are discussed and become the central topic. At the end, those concepts are applied in the cases to draw normative conclusions. The result of this research shows that though istiḥsān and istiṣhāb are still debatable, both of the two have a strong influence and relevance to be applied. In the Indonesian context, istiḥsān and istiṣhāb reasoning, may be combined or separated, can be used to promulgate the obligatory registration of marriage, the application of health protocol of Covid-19 during prayer in the mosque in the time of pandemic, and possibility of using credit card and e-commerce for transaction, the acceptance of Pancasila as the basis of the Republic of Indonesia, the legitimacy of 1945 constitution, democracy, and current principles of modern jurisprudence (such as the principles of pre-assumption of innocent). That is due to the fact of their virtues for public life (maṣlaḥah muḥaqqaqah), and no exact prohibition is found in al-Qurʼan and Hadith (ibāḥah aṣliyyah). In short, by using istiḥsān and istiṣhāb, such mentioned recent cases may be solved and logics of legal reasoning can be extended.

Abstract

Abstracts Masudul Alam Choudhury agrees that fundamental thinking to construct a new knowledge base is needed when scientific and social conditions tend to be closed and monopolistic. The construction is expected to be able to dismantle the structural veil to find an alternative foundation and format that can be expected to realize social justice. For this reason, law, economics, and social paradigm can be effective instruments. In contrast to Choudhury, Karl Marx emphasized the existence of a new, rational-material awareness that dimensioned an economic struggle based on class consciousness, historical dialectics, and materialism as the choice of objectives above. This awareness can be grown contextually, by moving the oppressed to demand equality. So the legal, economic, and political foundations can change. While Choudhury focuses more on the transcendental dimension of the divine (tauhid paradigm) which is interpreted comprehensively and totally to dismantle the legal, economic, and social order. Thus, the legal, economic, and political infrastructure rests on fairness and productivity that remains competitive. The values that are in the divine foundation are arranged in the building of law and ethics (morals) to be integrated into the institution towards the desired reconstruction. However, Choudhury’s ideas remain normative and fail to be translated. It is too utopian. Keywords: historical-dialectical materialism, usury, exploitation, monotheism paradigm. AbstrakMasudul Alam Choudhury sependapat bahwa pemikiran fundamental untuk membangun basis pengetahuan baru diperlukan ketika kondisi ilmiah dan sosial cenderung tertutup dan monopolistik. Pembangunan tersebut diharapkan mampu membongkar kerudung struktural untuk menemukan alternatif pondasi dan format yang diharapkan dapat mewujudkan keadilan sosial. Oleh karena itu, paradigma hukum, ekonomi, dan sosial dapat menjadi instrumen yang efektif. Berbeda dengan Choudhury, Karl Marx lebih menekankan adanya kesadaran material rasional baru yang berdimensi perjuangan ekonomi berdasarkan kesadaran kelas, dialektika historis dan materialisme sebagai pilihan tujuan di atas. Kesadaran ini bisa ditumbuhkan secara kontekstual dengan menggerakkan kaum tertindas untuk menuntut kesetaraan. Jadi landasan hukum, ekonomi dan politik bisa berubah. Sedangkan Choudhury lebih menitikberatkan pada dimensi transendental ketuhanan (paradigma tauhid) yang dimaknai secara komprehensif dan menyeluruh untuk membongkar tatanan hukum, ekonomi dan sosial. Dengan demikian, infrastruktur hukum, ekonomi dan politik bertumpu pada keadilan dan produktivitas yang tetap kompetitif. Nilai-nilai yang ada dalam landasan ketuhanan ditata dalam bangunan hukum dan etika (akhlak) untuk diintegrasikan ke dalam institusi menuju rekonstruksi yang diinginkan. Namun, ide Choudhury tetap normatif dan gagal diterjemahkan. Itu terlalu utopis.Kata kunci: Materialisme Historis-Dialektik; Riba; Eksploitasi; Paradigma Tauhid АннотацияМасудул Алам Чоудхури согласен с тем, что фундаментальное мышление необходимо для создания новой базы знаний, когда научные и социальные условия имеют тенденцию быть закрытыми и монополистическими. Ожидается, что создание такой базы сможет демонтировать структурную завесу и найти альтернативные основы и форматы, которые, как ожидается, позволят реализовать социальную справедливость. Следовательно, правовая, экономическая и социальная парадигмы могут быть эффективными инструментами. В отличие от Чоудхури, Карл Маркс больше подчеркивал существование нового рационального материального сознания с измерениями экономической борьбы, основанными на классовом сознании, исторической диалектике и материализме как на выбранных выше целях. Это осознание можно усилить в контексте, мобилизуя угнетенных на требование равенства. Так что правовая, экономическая и политическая основы могут измениться. Между тем, Чоудхури больше сосредотачивается на трансцендентном измерении божественности (парадигма таухид – божественное единство), которая интерпретируется всесторонне и тщательно, чтобы разрушить правовой, экономический и социальный порядок. Таким образом, правовая, экономическая и политическая инфраструктура опирается на справедливость и производительность, которые остаются конкурентоспособными. Ценности, которые существуют в божественном основании, изложены в правовом и этическом (ахлакском) здании для интеграции в учреждения для желаемой реконструкции. Однако идеи Чоудхури оставались нормативными и не претворялись в жизнь. Это слишком утопично.Ключевые Слова: Историко-Диалектический Материализм; Ростовщичество; Эксплуатация; Парадигма Таухид

Abstract

Economy and the law are the two inseparable things. There is always a relationship between the two. This writing explores the role of Ibn Khaldun (1332-1406 AD) in paving the way for creating foundations of socio-economic study. According to him, the role of law in economic activity can be seen from two sides, in two equal interests, namely: a. Law is seen from the dimensions of economic activity; and b. Law is seen from the dimension of the state over its authority. Departing from the economic goals, in fact to obtain the maximum profit, the law is merely seen as a useful external factor and can be utilized to secure the economic activities and objectives to be achieved. The essence of Ibn Khaldun’s thought is still relevant to the modern time. Departing from his ideas and comparing them to the western and modern ones, one may conclude that Ibn Khaldun’s philosophical analyses could be contextualized. Abstrak: Ekonomi dan hukum adalah dua hal yang tidak dapat dipisahkan. Selalu ada hubungan antara keduanya. Tulisan ini membahas peran Ibnu Khaldun (1332-1406 M) dalam membuka jalan bagi terbentuknya fondasi studi sosiologis. Menurutnya, peran hukum dalam kegiatan ekonomi secara umum dapat dilihat dari dua sisi, dalam dua hal yang sama, yaitu: a. visi undang-undang dilihat dari dimensi kegiatan ekonomi; dan b. hukum dilihat dari dimensi negara atas kekuasaannya. Berangkat dari tujuan ekonomi, bahkan untuk mendapatkan keuntungan yang maksimal, hukum hanya dipandang sebagai faktor eksternal yang berguna dan dapat dimanfaatkan untuk terjaminnya kegiatan ekonomi dan tujuan yang akan dicapai. Penelitian ini membuktikan bahwa esensi pemikiran Ibnu Khaldun masih relevan dengan masa modern. Berangkat dari ide-idenya dan membandingkannya dengan analisis arus pemikiran Barat, dapat disimpulkan bahwa filosofis Ibnu Khaldun sangat mungkin diperbarui kembali serta dikontekstualisasikan.
