Abstract

A forensic autopsy aims to find a definite cause of a person’s death by revealing the material truth scientifically from the beginning of case investigation to its trial examination. In judicial practices, a forensic autopsy is considered a pivotal tool in proving material criminal acts. However, KUHP Article 222 and KUHAP Article 133-134 regulate forensic autopsy procedures requiring prior notification to the victim's family. These provisions have hindered law enforcement in certain unnatural death cases. Therefore, this article encourages forensic autopsy implementation must not wait for a family consent of a victim for the sake of fair legal certainty to the victims, perpetrators, and also for society.

Abstract

Skizofrenia termasuk gangguan jiwa golongan psikotik. Dalam beberapa kasus pidana, hakim menjatuhkan sanksi pidana penjara terhadap pelaku skizofrenia. Ketepatan pemenjaraan terhadap seorang skizofrenia merupakan fokus dari tulisan ini. Metode penelitian yuridis normatif dengan pendekatan kasus putusan pengadilan digunakan dalam menganalisis pokok permasalahan. Penentuan pertanggungjawaban pidana terhadap ODGJ di dalam Hukum Pidana Indonesia menganut gemischte methode dengan sistem deskriptif normatif. Keterangan ahli jiwa, tidak mengikat hakim di dalam memutus perkara, dan hakim menjatuhkan sanksi pidana penjara berdasarkan keyakinannya, meskipun terdakwa seorang skizofrenia. Pemenjaraan terhadap seorang skizofrenia paranoid kronik berorientasi pada teori tujuan retributif, sedangkan pemenjaraan terhadap seorang skizofrenia fase remisi berorientasi pada teori teleologis. Mengingat sifat berbahayanya seorang skizofrenia, seharusnya sebelum dan selama menjalani sanksi pidana penjara memerlukan pemeriksaan kesehatan jiwa. Pemenjaraan terhadap seorang skizofrenia setidaknya dapat memberikan perlindungan terhadap sesama narapidana dan petugas lembaga pemasyarakatan selama terpidana menjalani sanksi.

Abstract

Teachers may impose sanctions or Corporal Punishment on students for educational purposes. In several cases, the Corporal Punishment action taken by the teacher resulted in the imposition of criminal sanctions on the teacher. This paper describes the perspective of criminal law settlement in Corporal Punishment cases. This paper uses the normative juridical research method, which examines the application of positive legal norms. Hence, this paper interprets the corresponding law in the means of textually. Furthermore, researchers use a conceptual framework to illustrate a teacher’s professional duties and Corporal Punishment. Finally, this research uses qualitative descriptive analysis supported by a case approach. This research found that applying life skill-based and contextual learning methods may prevent the aftermath of teachers’ Corporal Punishment. Teachers, carrying out their professional duties, may avoid criminal charges for Corporal Punishment if these actions do not exceed reasonable limits, which result in student losses, both physically and psychologically. The functionalization of criminal law may be prevented using ultimum remedium in resolving Corporal Punishment cases. This may occur in settlement through restorative justice, which involves various parties in the educational process. Alternatively, criminal law settlement may be used in Corporal Punishment cases. Judges may apply the concept of individualized punishment in imposing sanctions on teachers who are proven guilty of Corporal Punishment. Finally, this paper recommends a psychological intervention to assess educators’ mental capacity. This may take form through periodic assessments to determine the competence of teachers as educators.

Abstract

The court does not always demand or require visum et repertum when examining homicide cases.  Forensic autopsy may not be required at all by the criminal court when deciding that the accused is guilty of homicide as charged. The verdict may be reached based on other evidence. The author, using a juridical normative approach, concludes that the absence or presence of a visum et repertum does influence the judge’ consideration and matters to the final verdict. Considering that, regardless of the surviving family’s consent, in cases of unnatural death, forensic autopsy and the making of a visum et repertum should be mandatory.

Abstract

Article 440 of the Health Act formulates criminal penalties for the negligence of medical persons/health workers in health services that result in serious injury or death. This study aimed to examine the urgency of the special provision formulation policy and its prospective law enforcement. This framework creates the general provisions of the Criminal Code applied in dealing with negligent acts of medical personnel/health workers resulting in serious injury or death of patients, which should be overridden based on “lex specialis derogat legi generali” principles. Health act in Article 440 as a material offence has special characteristics, whose assessment is based on professional standards and is oriented towards providing balanced legal protection for patients, health workers, and legal certainty for law enforcement officials. According to proving the elements of negligence and causal relationship in the context of therapeutic transactions, it is based on evidence according to KUHAP. Expert testimony occupies an important position in determining professional standards, including medical records and/or visum et repertum. As a material offense, Health Law Article 440 requires caution to achieve the goals of material truth and justice. It can be concluded that the law enforcement of negligence of medical/health workers must be based on the specificity of the unlawful nature of the act, which is different from general criminal offenses, with the benchmark of professional standards resting on the causal relationship between negligence and consequences through evidence, especially expert testimony.
