Abstract

The glowing of conflict occurred in Bali about legal action of grave field latter has given evidence that Bali in now day is far from peacefull. In solving the legal action that was occurred in Bali, the socials were more belief to the leaders in their region, such as: the leader in their village and also the leader in province. Sometimes, the means of problem solving that was taken by one of leaders was not successful. More factor of problem solving were caused successful or failed. However, that all factors could we see in standing of the law systems, legal substancy, legal structure, and legal culture.

Abstract

Subak secara fungsional ada dalam tatanan masyarakat hukum adat Bali yang secara turun-temurun telah menjadi tumpuan untuk menyangga kesejahteraan anggota kesatuannya dengan filosofi Tri Hita Karana. Ditetapkannya subak sebagai warisan budaya dunia oleh UNESCO memunculkan problematika mulai terdesaknya subak seiring dengan pengaturan oleh hukum negara melalui berbagai kebijakan sesuai status subak tersebut. Penelitian ini bertujuan untuk menganalisis pengaturan subak dalam kaitannya dengan ketentuan hukum negara yang berorientasi kesejahteraan sesuai harapan ideal krama (anggota) komunitas subak khususnya dan mewujudkan tujuan negara untuk memajukan kesejahteraan umum. Hal ini mengingat laju ekonomi dan pariwisata dominan mengarah pada komersialisasi subak. Metode yuridis normatif dalam penelitian ini dilakukan dengan pendekatan perundang-undangan dan pendekatan konsep. Penelitian ini menemukan bahwa orientasi kesejahteraan dalam pengaturan subak belum secara optimal dirumuskan karena masih ditentukan dalam berbagai aturan terkait subak. Apalagi terdapat inkonsistensi ketentuan dan dibentuknya Dewan Pengelola Warisan Budaya Bali, diantaranya adalah Badan Pengelola Daya Tarik Wisata sebagai pengelola subak yang lebih berpusat pada keuntungan ekonomi.

Abstract

As it is widely recognized that community empowerment in tertiary education provides a wide chance to keepin touch with the community members. This is in order to get new experience and to dedicate the knowledgefor others. This community empowerment activity aims at guiding community members of Junjungan village inGianyar Regency, Bali to reformat and to revise the substance of their traditional law. Traditional law which isknown as awig-awig in Junjungan customary village has been documented in written form. It also has been usedas the code of conduct for the community members of Junjungan customary village for 10 years. However, theawig-awig has yet not considered representative that it has not been responsive to represent the people’s need anddevelopment in the community. Besides, this village is located in a strategic area of Ubud which is known as oneof the tourist centers in Bali. As a result, the revision of awig-awig that makes it more responsive to communitydevelopment is significantly needed. The method utilized in this event is discussion and consultation in whichthe community members are actively involved in redesigning their awig-awig. The techniques on how to writethe articles in the traditional law are also the main focus in this event. All community leaders and communitymembers involved in this event and gave their support so that a new guidance in the revision of the awig-awigof Junjungan village is successfully made and redesigned. In addition, the event can be carried out on time basedon its plan and timeline.

Abstract

This study aims to determine the arrangement of customary traditions based on Indonesian law and to understand the guarantee of Human Rights in the Manak Salah Tradition in Bali. The method used in research related to human rights assurance in the Manak Salah Tradition in Bali uses normative juridical legal research, using a statutory approach or a statute approach to analyze legal issues in this study. Sources of legal materials in this study consist of primary, secondary, and tertiary legal materials. The results of this study found that human rights guarantee in the Manak Salah Tradition in Bali basically have to be uniform. This is because a tradition will be very difficult to erase, this is because customary law is recognized in the 1945 Constitution of the Republic of Indonesia Article 18B paragraph (2) even though customary law cannot conflict with national law. So that in order to guarantee human rights from the wrong tradition, special arrangements are needed in the form of proper housing facilities, visited by other village krama, provision of MCK facilities, assisted with readiness by all village manners as a whole so as to help ease the burden on the family who is subject to sanctions, help ease the family. Penelitian ini bertujuan untuk mengetahui pengaturan tradisi adat berdasarkan Hukum Indonesia serta memahami jaminan Hak Asasi Manusia (HAM) dalam Tradisi Manak Salah di Bali. Metode yang digunakan dalam penelitian terkait jaminan HAM dalam Tradisi Manak Salah di Bali ini mempergunakan jenis penelitian hukum yuridis normatif, dengan menggunakan pendekatan perundang-undangan atau statute approach dan pendekatan konseptual atau conceptual approach untuk menganalisis isu hukum dalam penelitian ini. Hasil dari studi ini menemukan jika jaminan HAM dalam Tradisi Manak Salah di Bali pada dasarnya harus dilakukan penyeragaman. Hal ini dikarenakan suatu tradisi akan sangat sulit untuk dihapuskan, hal ini dikarenakan hukum adat diakui dalam UUD NRI 1945 Pasal 18B ayat (2) meskipun hukum adat tidak boleh berlawanan dengan hukum positif Indonesia. Sehingga untuk menjamin HAM dari tradisi manak salah diperlukan pengaturan secara khusus berupa fasilitas perumahan yang layak, dikunjungi oleh krama desa yang lain, penyediaan fasilitas MCK, dibantu kesiapannya oleh seluruh krama desa secara keseluruhan sehingga membantu meringankan beban pihak keluarga yang terkena sanksi, membantu meringankan keluarga.

Abstract

Tujuan dilakukannya penulisan ini adalah untuk mengetahui bagaimana pengaturan terkait dengan perkawinan anak dibawah umur tersebut serta mengetahui dan memahami apa saja bentuk perlindungan hukum yang diberikan apabila perkawinan dibawah umur tersebut telah terjadi. Metode yang dilakukan pada penulisan ini adalah metode penelitian normatif dengan pendekatan perundang-undangan. Hasil penelitian menunjukkan bahwa Undang-Undang Tentang HAM tidak mengatur secara spesifik mengenai usia anak untuk dapat melangsungkan perkawinan. Namun dalam Pasal 10 ayat (1) Undang-Undang Tentang HAM tersebut mengatur bahwa “Setiap orang berhak membentuk suatu keluarga dan melanjutkan keturunan melalui perkawinan yang sah”. Pada penjelasan Pasal 10 Undang-Undang Tentang HAM, yang dimaksud dengan “perkawinan yang sah” dalam ketentuan tersebut adalah perkawinan yang dilakukan sesuai dengan peraturan perundang-undangan yang berlaku. Dengan demikian terkait dengan pengaturan usia anak untuk dapat melangsungkan perkawinan merujuk pada ketentuan Pasal 7 ayat (1) Undang-Undang Perkawinan yaitu 19 tahun. Bentuk perlindungan hukum terhadap perkawinan anak dibawah umur dapat dilihat dalam pengaturan pasal 10 ayat 2 Undang-Undang Tentang HAM yang mengatur bahwa perkawinan yang sah hanya dapat berlangsung atas kehendak bebas dari kedua belah pihak. Kehendak bebas yang dimaksud disini adalah kehendak yang lahir dari niat yang suci tanpa paksaan, penipuan, atau tekanan apapun dan dari siapapun. Berdasarkan pengaturan Pasal 10 ayat (1) dan (2) Undang-Undang Tentang HAM tersebut maka sangat penting keberadaan orang tua dan keluarga untuk mencegah terjadinya perkawinan anak dibawah umur. The purpose of this paper is to find out how the arrangements are related to the marriage of minors and to know and understand what forms of legal protection are provided if the underage marriage has occurred. The method used in this paper is a normative research method with a statutory approach. The results of the study indicate that the Law on Human Rights does not specifically regulate the age of children to be able to enter into marriage. However, Article 10 paragraph (1) of the Law on Human Rights stipulates that "everyone has the right to form a family and continue their offspring through a legal marriage". In the explanation of Article 10 of the Law on Human Rights, what is meant by "legitimate marriage" in this provision is a marriage carried out in accordance with the applicable laws and regulations. Thus, in relation to setting the age of children to be able to carry out marriages, it refers to the provisions of Article 7 paragraph (1) of the Marriage Law, which is 19 years. The form of legal protection against child marriage can be seen in the regulation of Article 10 paragraph 2 of the Law on Human Rights which stipulates that a legal marriage can only take place at the free will of both parties. Free will is meant here is the will that was born from a holy intention without coercion, deception, or pressure of any kind and from anyone. Based on the provisions of Article 10 paragraphs (1) and (2) of the Law on Human Rights, it is very important to have parents and families to prevent child marriage from occurring.

Abstract

ABSTRAK Kegiatan pembangunan kepariwisataan dalam kehidupan Negara modern tidak akan dapat berjalan dengan baik tanpa adanya sebuah kebijakan yang baik pula. Kepariwisataan dalam program suatu negara dihandalkan dan diarahkan untuk memberi manfaat bagi kesejahteraan bersama elemen berbangsa. Nilai dasar atas upaya mewujudkan kemakmuran ditetapkan melalui Undang-Undang No.10 Tahun 2009 tentang Kepariwisataan untuk menciptakan iklim yang kondusif dan memberikan kepastian hukum. Dalam penyelenggaraan kepariwisataan utamanya di Bali menjadi penting pada pengembangan pariwisata budaya sebagai penyangga agar terhindar dari komersialisasi dan komodifikasi yang hanya menempatkan Bali sebagai obyek eksploitasi. Desa pakraman berkait dengan kepariwisataan ini memerlukan porsi yang pasti berdasarkan hukum sehingga hak dan kewajiban serta kewenangannya guna mendapat jaminan atas kepastian hukum, keadilan dan kemanfaatan seluruh kompenen terkait dalam pengelolaan kepariwisataan. Jenis penelitian ini adalah yuridis normatif yaitu yang mengkaji semua permasalahan melalui tinjauan hukum, acuannya dilakukan baik secara normatif maupun berdasarkan doktrin ilmu hukum. Pembahasan atas kewenangan desa pakraman tidak bisa lepas dari ketentuan Pasal 18B (2) UUD Negara Republik Indonesia Tahun 1945, sebagai pengakuan hak konstitusionalnya. Pengaturan pengelolaan kepariwisataan budaya Bali belum secara implisit mengatur bagaimana hak, kewajiban serta kewenangan yang dimiliki desa pakraman. Sepantasnya dalam Pengelolaan Kepariwisataan budaya memberikan tempat yang rasional kepada desa pakraman sebagai subyek pemilik kebudayaan. Peraturan Daerah Provinsi Bali tentang Kepariwisataan Budaya tidak secara tegas memberikan kedudukan hukum (hak, kewajiban dan wewenang) desa pakraman dalam pengelolaan Kepariwisataan Budaya Bali. Posisi kedudukannya selaku subyek internal, seharusnya diwujudkan dalam bentuk fungsi penguatan, pemberdayaan. Jika dibentuk dalam relasi koordinasi dengan unsur pemerintah daerah pun koordinasi dalam dengan sifat mendukung dan menguatkan kedudukan hukum desa pakraman. Kata Kunci : Kedudukan Hukum, Desa Pakraman, Kepariwisataan Budaya ABSTRACT Tourism development activities in a modern country cannot work well without a good policy. Tourism as one of development programs of a country is a reliable way to bring prosperity to all of the people. The basic value of efforts to achieve prosperity is stated in Act no.10 Year 2009, which is about tourism for creating a conducive environment and to provide legal certainty. Cultural tourism development activities, particularly in Bali, play an important role as a buffer to avoid Bali from being commercialised and commodified, in other words, being an exploited object. The customary village (desa pakraman) must be given a clear portion in the law regarding tourism industry so that its rights, obligations and authorities to give legal certainty, justice and benefits are clear. This is a normative juridical study, which is a study that analyses all problems through legal perspective whose reference is obtained normatively or based on the doctrines in law discipline. Discussing the authority of Desa Pakraman cannot disregard Article 18B (2) Constituion 1945, which is a recognition of the rights of customary village. The regulations about cultural tourism of Bali have not yet implicitly defined the rights, obligations and authorities of desa pakraman. Cultural tourism management should provide desa pakraman with a rational portion as the subject and owner of Bali culture. Bali provincial regulation on cultural tourism does not explicitly give the legal status (rights, obligations and responsibilities) of desa pakraman in the management of Bali cultural tourism. As the internal subject, the legal status of desa pakraman should be manifested in the form of both reinforcement and empowerment functions. If the legal status of desa pakraman is in the form of a coordinative relation local government, such coordination should be supporting and strengthening the legal status of desa pakraman. Abstract

Secara sosiologis kita menghadapi kenyataan bahwa telah muncul masyarakat global yang sangat berpengaruh dan telah menyusup keseluruh pelosok Bali. Bali sebagai daerah tujuan wisata tidak bisa terlepas dari fenomena bahwa Bali sudah menjadi bagian dari masyarakat dunia. Oleh karena itu Bali harus dapat meyediakan fasilitas kepariwisataan untuk memenuhi kebutuhan wisatawan. Situasi tersebut mengakibatkan Bali berkomunikasi dengan budaya luar, bahkan proses itu terjadi dengan begitu cepat tanpa melalui suatu perencanaan. Desa Pakraman sebagai salah satu komponen dalam struktur kemasyarakatan Bali juga mengalami berbagai perubahan, disamping karena dinamika internalnya, juga karena pengaruh lingkungan luar. Problematik aturan hukum (awig-awig/perarem) yang dihadapi Desa Pakraman sekarang ini dan diwaktu yang akan datang akan semakin kompleks. Persoalan-persoalan hukum di era sekarang ini serta perubahan sosial yang begitu cepat perlu direspon dan diantisipasi.Situasi Global dengan muatan pariwisatanya, secara langsung maupun tidak langsung menuntut perlunya pengkajian atau revisi terhadap awig-awig/perarem supaya tidak ditinggalkan oleh masyarakat yang bergerak begtu cepat. Dengan demikian awig-awig/perarem akan dapat menjalankan fungsinya baik sebagai kontrol sosial, maupun sebagai rekayasa sosial. Adanya awig-awig/perarem yang sudah sesuai dengan perkembangan masyarakat dan jaman, akan dapat meminimalisir terjadinya konflik dalam masyarakat. Desa Pakraman adalah kesatuan masyarakat hukum adat di Provinsi Bali, yang mempunyai hak otonomi. Salah satu isi dari otonomi desa pakraman adalah hak untuk membuat aturan (awig-awig/pererm), yang berlaku bagi masyarakat itu sendiri, baik dalam bentuk yang tertulis maupun tidak tertulis, yang lahir, hidup, tumbuh, dan berkembang, sesuai dengan rasa keadilan dan kepatutan dalam masyarakat (mempunyai sifat luwes dan dinamis). Dengan adanya sifat yang luwes dan dinamis tersebut dapat dimengerti bahwa awig-awig/perarem dimasa lalu tidak selalu sesuai dengan kebutuhan masyarakat masa kini, dan di masa yang akan datang, karena rasa keadilan dan ukuran kepatutan juga mengalami perubahan.

Abstract

The purpose of the service is to be able to compile awig-awig, the regulations used in the Subak organization that are the foundation of sustainable environmental development. It is important to be carried out in the context of spatial planning around Subak, therefore it is maintained and there is no easy change of land function that affects the existence of Subak. This service activity was carried out using lecture, discussion and question and answer methods when taking an inventory of the problems faced by Subak Pulagan Gianyar and then making awig-awig arrangements related to spatial planning around Subak. The target focus in the management of Subak is the apparatus of Subak officers and the members of Subak Pulagan Gianyar so that it is expected to have guidelines for the functional customary law community in Bali in determining the rules within the Subak organization. The realization of the service was carried out through reviewing the act of compiling the substance of awig-awig Subak, mainly in the palemahan (environment) section and was warmly welcomed by Subak Pulagan officers. This was responded well because it was realized by the local members of subak that preserving this world’s cultural heritage is the foundation for maintaining their natural environment in a sustainable manner.

Abstract

Forests have a function as a life buffer so that community welfare should be maintained responsibly and sustainably. In addition, the forest resources management and community participation, Balinese local wisdom regarding forest protection are based on Wana Kerthi which is part of Sad Kerthi. The concept is also one of Tri Hita Karana's philosophies. The importance of indigenous villages regarding forest management in Bali needs more attention from both the central and local governments. Moreover, the attention is in the forms of clearer regulations, especially the authority boundaries between traditional villages and the government. The purpose of this study is to investigate the forest status in Padangtegal Indigenous Village and to investigate its roles in indigenous forest management. The method used in the study is the empirical legal research method. The results of this study indicated that the status of the forest managed by the Padangtegal Indigenous Village is a 26-hectare indigenous forest that has the main function as a conservation forest based on the Tri Hita Karana philosophy. The role of Padangtegal Traditional Village in forest management is following the Bali Provincial Regulation Number 4 of 2019 concerning Indigenous Villages (hereinafter referred to as the Indigenous Village Regulation), with autonomy owned by the indigenous village to have rights in regulating its household which is stated in the form of awig-awig. Customary forests as indigenous villages’ padruen are used to create the welfare of indigenous village communities.

Abstract

The purpose of writing this article is to find out the role of customary functionaries in running the customary government system and the cooperative relations between these traditional partners in carrying out the customary government system for the indigenous people in Nafri Village. Both traditional partners from Nafri Village and also traditional partners from outside Nafri Village. This research can be categorized in the type of research with empirical aspects, because here we see the role of customary functionaries in the implementation of customary government law in the Nafri customary law community who sees the role of customary functionaries being carried out in reality. From the results of the study, it was revealed that customary functionaries have a very important role in carrying out the customary government system in the indigenous people of Nafri Village, both on ontofro and whase ontofro. And also these traditional functionaries have a cooperative relationship with traditional partners, both those from within the Nafri village itself and also traditional partners with villages from outside the Nafri village.
